O-05-04VILLAGE OF DEERFIELD LAKE AND COOK COUNTIES, ILLINOIS ORDINANCE NO. 0 -05 -04 AN ORDINANCE ANNEXING CERTAIN TERRITORY AT THE NORTHEAST QUADRANT OF SAUNDERS ROAD AND LAKE -COOK ROAD TO THE VILLAGE OF DEERFIELD WHEREAS, the owner of record of the real property described in Section 1 of this Ordinance (the "Subject Property ") has executed and filed with the Village Clerk of the Village of Deerfield a petition seeking to have the Subject Property annexed to the Village of Deerfield pursuant to the terms of a certain Annexation Agreement made and entered into by and between said owner of record and the Village of Deerfield pursuant to the provisions of Division 15.1 of Article 11 of the Illinois Municipal Code (65 ILCS 5111 - 15.1 -1 et seq. ); and, WHEREAS, all of the owners of the Subject Property have joined in said Petition; and, WHEREAS, there are no electors residing on the Subject. Property; and, WHEREAS, such territory is not within the corporate limits of any municipality, but is contiguous to the boundaries of the Village of Deerfield and is eligible for annexation to the Village of Deerfield; and, WHEREAS, due notice has been given as provided for in Section 7 -1 -1 of the Illinois Municipal Code to the Board of Town Trustees for West Deerfield Township; and, WHEREAS, the territory proposed to be annexed does not include any highway under the jurisdiction of any township; and, J WHEREAS, the Subject Property is not located within any public library district and the Village of Deerfield does not provide fire protection service; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, in the exercise of its home rule powers, as follows: SECTION 1: That the territory legally described on Exhibit A attached hereto (the "Subject Property ") be and the same is hereby annexed to the Village of Deerfield. SECTION 2: That this ordinance is conditioned upon the execution of a certain Second Amendment to Lake -Cook Road Corridor Agreement (hereinafter referred to as the "Second Amendment ") by the Village of Northbrook, a true and correct copy of said Agreement being attached to approved by the Village of Deerfield pursuant to Resolution No.R -05 -01 adopted by the corporate authorities of the Village of Deerfield on January 18, 2005. SECTION 3: That the Village Clerk of the Village of Deerfield is hereby authorized and directed to cause a certified copy of this Ordinance, together with an accurate map of the Subject Property described on Exhibit A attached hereto, to be filed with the Recorder of Deeds of Lake County, Illinois, and with the County Clerk of Lake County, Illinois, being the county in which said annexed territory is situated, after said Second Amendment has been fully executed by the Village of Northbrook and delivered to the Village of Deerfield.
