R-88-02STATE OF ILLINOIS ) COUNTIES OF LAKE AND COOK ) SS VILLAGE OF DEERFIELD ) The undersigned hereby certifies that she is the duly appointed Deputy Village Clerk of the Village of Deerfield, Lake and Cook Counties, Illinois, and that the attached is a true and accurate copy of Resolution No. R -88 -02 passed by the President and Board of Trustees of the said Village at a regular meeting thereof held on February 1, 1988 , and now in full force and effect, all as appears in the records and files of the office of the Village Clerk. R-88 -02 WHEREAS, the Village of Deerfield is a member of the Lake County Joint Action Solid Waste Planning Agency (hereinafter referred to as Agency); and WHEREAS, the funding of the Agency's work has been a combined effort of initial cash contributions from member governments, carry -over funds left from the work of the Lake County Solid Waste Advisory Committee (SWAC), an additional $100,000.00 contribution from the County of Lake, and a grant of $350,000.00 from the Illinois Environmental Protection Agency (IEPA); and WHEREAS, the IEPA has notified the Agency that its planning grant will be terminated January 31, 1988 due to constitutional problems with the language of the State 'landfill surcharge, (the source of funding for said planning grant); and WHEREAS, the General Assembly has failed to take action to "constitutionalize" appropriate statutory language in order to continue the funding of the IEPA planning grants; and WHEREAS, the Board of Directors of the Agency voted unanimously on January 14, 1988 that it was their stated intent to continue the current planning program uninterrupted with local funding; and WHEREAS, the By -Laws of the Agency prescribe the methodology for the allocation of future shared costs among the members; and WHEREAS, the Village of Deerfield intends to participate in the funding of the Agency through November 30, 1988 or until such time as the IEPA reinstates State funding, whichever occurs first: NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Board of Trustees of the Village of Deerfield,;that we do appropriate $10,542.00 for continued funding of the Agency; and BE IT FURTHER RESOLVED that the commitment of said funds to the Agency is made with the understanding that should IEPA funding be reinstated, all monies paid to the Agency pursuant to this Resolution shall be paid back to the Village of Deerfield in full; and BE IT FURTHER RESOLVED that the commitment of said funds to the Agency is made with the further understanding that proceeds from the County of Lake's recently enacted local landfill surcharge may also be available to fund the Agency's work; and BE IT FURTHER RESOLVED that notwithstanding the reinstatement of IEPA funding, it is understood by the Village of Deerfield that additional local funding may be requested to complete the Agency's work for the period of December 1, 1988 through February 28, 1989; and BE IT FURTHER RESOLVED that the Village of Deerfield has made this commitment to continue what is felt to be an essential intergovernmental effort to help solve the very real dilemma of future solid waste disposal in our community. t, r r RESOLUTION NO.
