ORDINANCE NO. 0 -04 -68
AN ORDINANCE REPEALING SECTION 15 -3 OF THE
MUNICIPAL CODE OF THE VILLAGE OF DEERFIELD
WHEREAS, Section 15 -3 of the Municipal Code of the Village of Deerfield prohibits
public intoxication in the Village; and,
WHEREAS, counties, municipalities and political subdivisions of the State of Illinois
are prohibited by state law (20 ILCS 301/55 -15) from adopting or enforcing any law that
includes being intoxicated as the sole basis of the offense; and
WHEREAS, the Chief of Police of the Village of Deerfield has recommended that
Section 15 -3 of the Municipal Code of the Village of Deerfield be repealed;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES,
ILLINOIS, in the exercise of its home rule powers, as follows:
SECTION 1: That Section 15 -3 ( "Intoxication ") of Article 1 ( "Offenses against Public
Peace, Public Safety and Order ") of Chapter 15 ( "Morals and Conduct ") of the Municipal Code
of the Village of Deerfield be and the same is hereby repealed.
SECTION 2: That this Ordinance shall be in full force and effect from and after its
passage and approval as provided by law.
