DAVIS Deputy Village Clerk r Submitted by: Village of Deerfield 850 Waukegan Road Deerf eld, IL 60015 I VILLAGE OF DEERFIELD LAKE AND COOK COUNTIES, ILLINOIS ORDINANCE NO. 0 -04 -66 AN ORDINANCE AMENDING ARTICLE 9.02 -C OF THE ZONING ORDINANCE OF THE VILLAGE OF DEERFIELD TO AUTHORIZE SIGNAGE FOR PRIVATE HIGH SCHOOL FACILITIES IN THE I -1 OFFICE, RESEARCH AND RESTRICTED INDUSTRIAL DISTRICT WHEREAS, Petitioner Chicagoland Conservative Jewish High School Foundation, the owner of certain property commonly known as 1095 Lake Cook Road, has petitioned for a text amendment to Article 9.02 -C PUD of the Zoning Ordinance of the Village of Deerfield to permit identification signage for private high schools located in I -1 Office, Research and Restricted Industrial District Planned Unit Developments; and, WHEREAS, the Plan Commission of the Village of Deerfield held a public hearing on June 10, 2004 to consider said text amendment, said hearing being held pursuant to public notice and conforming in all respects, in both manner and form, with the requirements of the Zoning Ordinance of the Village of Deerfield and the statutes of the State of Illinois.; and, WHEREAS, the Plan Commission of the Village of Deerfield, after considering the evidence and supporting materials presented at said hearing, submitted its written report and findings of fact to the Board of the Trustees of the Village of Deerfield recommending a text amendment to Article 9.02 -C PUD, I -1 Office, Research and Restricted Industrial District, Planned Unit Development, to permit not more than one (1) wall sign and not more than two (2) on -site ground signs for a private high school located within I -1 Planned unit Developments; and, VILLAGE OF DEERFIELD LAKE AND COOK COUNTIES, ILLINOIS ORDINANCE NO. 0 -04 -66 AN ORDINANCE AMENDING ARTICLE 9.02 -C OF THE ZONING ORDINANCE OF THE VILLAGE OF DEERFIELD TO AUTHORIZE SIGNAGE FOR PRIVATE HIGH SCHOOL FACILITIES IN THE I -1 OFFICE, RESEARCH AND RESTRICTED INDUSTRIAL DISTRICT PASSED AND APPROVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, this 15th day of November , 2004. WHEREAS, the President and Board of Trustees of the Village of Deerfield concur in the recommendation of the Plan Commission and have determined that it is in the best interests of the Village of Deerfield that the text of the Zoning Ordinance be amended as provided herein; NOW, THEREFORE, BE -IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, in the exercise of its home rule powers, as follows: SECTION 1: That Article 9.02 -C PUD, I -1 Office, Research and Restricted Industrial District, Planned Unit Development, of the Zoning Ordinance of the Village of Deerfield be and the same is hereby amended to add the following as Paragraph 10 thereof. 10. Signage for private high school facilities located in the I4 Office, Research and Restricted Industrial District a. Number and Content (1) Wall Sian Not more than one (1) wall sign shall be permitted for a private high school. Said sign shall only indicate the naive of the school. Such sign may contain the name of a building donor. (2) Ground Sian Not more than two (2) on -site ground signs shall be permitted for a private high school. Said signs shall only indicate the name and /or address of the school. b. Area (1) Wall Sian The maximum surface area shall not exceed 200 square feet in area. (2) Ground Sian The maximum surface area shall not exceed 21 square feet. -2- c. Location (1) Wall Sign The wall sign may be located on the wall of the principal building which fronts on a private road or main entranceway to the private high school. (2) Ground Sign An on -site ground sign may be located in a required front yard provided it does not cause a safety problem for entering and exiting vehicles and pedestrians. d. Height (1) Wall Sign A wall sign shall not project higher than ten (10) feet from grade on the wall o f the building on which it is placed. (2) Ground Sign An on -site ground sign shall project no higher than seven (7) feet above grade. e. Illumination (1) Wall Sign A wall sign may be illuminated. (2) Ground Sign An on -site ground sign may be illuminated. SECTION 2: That this Ordinance, and each of its terms, shall be the effective legislative act of a home rule municipality without regard to whether such Ordinance should: (a) contain terms contrary to the provisions of current or subsequent non - preemptive state law; or, (b) legislate in a manner or regarding a matter not delegated to municipalities by state law. It is the intent of the corporate authorities of the Village of Deerfield that to the extent that the terms of this Ordinance -3- f should be inconsistent with any non - preemptive state law, this Ordinance shall supersede state law in that regard within its jurisdiction. SECTION 3: That this Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form as provided by law. PASSED this 15th day of November 2004.
