PASSED AND APPROVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, this 20th day of September 2004. 5125485 !fi VILLAGE OF DEERFIELD LAKE AND COOK COUNTIES, ILLINOIS ORDINANCE NO. 0 -04 -54 AN ORDINANCE ADOPTING THE 2000 EDITION OF THE INTERNATIONAL FUEL GAS CODE ESTABLISHING REGULATIONS GOVERNING THE CONDITIONS AND MAINTENANCE OF ALL PROPERTY, BUILDINGS AND STRUCTURES AND PROVIDING STANDARDS AND CONDITIONS FOR UTILITIES AND UTILITY FACILITIES FOR SAFE AND SANITARY GAS UTILITY SERVICE TO BUILDINGS AND STRUCTURES INTENDED FOR HUMAN OCCUPANCY IN THE VILLAGE OF DEERFIELD WHEREAS, three (3) copies of the 2000 Edition of the International Fuel Gas Code as published by the International Code Council, Inc., have been on file in the office of the Village Clerk for more than thirty (30) days; and, WHEREAS, the Village of Deerfield has identified the proposed adoption of the 2000 Edition of the International Fuel Gas Code to the Illinois Building Commission as required by Section 1 -2 -3.1 of the Illinois Municipal Code; and, WHEREAS, the President and Board of Trustees of the Village of Deerfield have determined that adoption of the 2000 Edition of the International Fuel Gas Code, as provided in this Ordinance, is in the best interests of the Village of Deerfield and will serve and promote public health, safety and welfare; BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, in the exercise of its home rule powers, as follows: 5 25485 41"-) SECTION 1: That the 2000 Edition of the International Fuel Gas Code as published by the International Code Council be and is hereby adopted as the code of the Village of Deerfield for the control of building and structures as herein provided for safe and sanitary gas utility service to buildings and structures intended for human occupancy in the Village of Deerfield, and each and all of the regulations, provisions, penalties, conditions and terms of such 2000 Edition of the International Fuel Gas Code are hereby adopted and made a part hereof by this reference as if fully set out in this Ordinance, with the additions, insertions, deletions and changes, if any, prescribed in Sections 2 and 3 of this Ordinance. SECTION 2: That Section 6 -2.1 entitled "Adoption of National Building Codes and Modifications" of Article 1, In General, of Chapter 6, Building, of the Municipal Code of the Village of Deerfield, be and the same is hereby amended to add the following as Subsection E thereof: E. The 2000 Edition of the International Fuel Gas Code, as published by the International Code Council, Inc., with the following modifications: (1) Section 101.1 Insert: The Village of Deerfield. (2) Section 1065.2 Insert: As specified in the Deerfield Municipal Code. (3) Section 106.5.3 Insert: 50% for 106.5.3(2.), 75 %for 106.5.3(3.) (4) Section 108.4. Insert: Any person violating any provision of this Code shall be fined not less than Fifty Dollars ($50.00) nor more than One Thousand Dollars ($1, 000.00) for each offense. A separate offence shall be deemed committed each day during or on which a violation occurs or continues. (5) Section 108.5. Insert: Any person continuing to work in violation of a stop work order shall be fined not less than One Hundred Dollars ($100.00) nor more than One Thousand Dollars ($1, 000.00) for each offense. A separate offense shall be deemed committed each day during or on which such person works or continues to work in violation of a stop work order. 2 57"25' 485 SECTION 3: That nothing in this ordinance or in the 2000 Edition of the International Fuel Gas Code hereby adopted shall be construed to affect any suit or proceeding pending in any court, or any rights acquired, or liability incurred, or any cause or causes of action acquired or existing, under any act or ordinance hereby repealed as cited in Section 2 of this ordinance, nor shall any just or legal right or remedy of any character be lost, impaired or affected by this ordinance. SECTION 4: That this Ordinance, and each of its terms, shall be the effective legislative act of a home rule municipality without regard to whether such Ordinance should: (a) contain terms contrary to the provisions of current or subsequent non - preemptive state law; or, (b) legislate in a manner or regarding a matter not delegated to municipalities by state law. It is the intent of the corporate authorities of the Village of Deerfield that to the extent that the terms of this Ordinance should be inconsistent with any non - preemptive state law, this Ordinance shall supersede state law in that regard within its jurisdiction.
