VILLAGE OF DEERFIELD LAKE AND COOK COUNTIES, ILLINOIS ORDINANCE NO. 0 -04 -53 AN ORDINANCE ADOPTING THE 2000 EDITION OF THE INTERNATIONAL ENERGY CONSERVATION CODE REGULATING AND CONTROLLING THE CONSTRUCTION, INSTALLATION, REPAIR, LOCATION, USE AND MAINTENANCE OF BUILDING ENVELOPE, MECHANICAL, LIGHTING AND POWER SYSTEMS IN THE VILLAGE OF DEERFIELD WHEREAS, three (3) copies of the International Energy Conservation Code, 2000 Edition, as published by the International Code Council, Inc., have been on file in the office of the Village Clerk for more than thirty (30) days; and, WHEREAS, the Village of Deerfield has identified the proposed adoption of the International Energy Conservation Code, 2000 Edition, to the Illinois Building Commission as required by Section 1 -2 -3.1 of the Illinois Municipal Code; and, WHEREAS, the President and Board of Trustees of the Village of Deerfield have determined that adoption of the 2000 Edition of the International Energy Conservation Code, as provided in this Ordinance, is in the best interests of the Village of Deerfield and will serve and promote public health, safety and welfare; BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, in the exercise of its home rule powers, as follows: SECTION 1: That the 2000 Edition of the International Energy Conservation Code, as published by the International Code Council, be and is hereby adopted as the code of the Village of Deerfield for regulating the design, construction, quality of materials, erection, installation, alteration, repair, location, relocation, replacement, addition to, use or maintenance of the building envelope, mechanical, lighting and power systems in the Village of Deerfield, and providing for the issuance of permits and collection of fees therefore, and each and all of the regulations, provisions, conditions and terms of such International Energy Conservation Code, 2000 Edition, published by the International Code Council, on file in the office of the Village of Deerfield, are hereby adopted and made a part hereof by this reference as if fully set out in this ordinance. SECTION 2: That Section 6 -2.1 entitled "Adoption of National Building Codes and Modifications" of Article 1, In General, of Chapter 6, Building, of the Municipal Code of the Village of Deerfield, be and the same is hereby amended to add the following as Subsection G thereof. G. The 2000 Edition of the International Energy Conservation Code, as published by the International Code Council, Inc., with the following modifications: SECTION 3: That nothing in this Ordinance or in the 2000 Edition of the International Energy Conservation Code hereby adopted shall be construed to affect any suit or proceeding pending in any court, or any rights acquired or liability incurred, or any cause or causes of action acquired or existing, under any repealed act or ordinance, including but not limited to the BOCA National Energy Conservation Code /1993 which is hereby repealed, nor shall any just or legal right or remedy vested as of the effective date of this Ordinance be lost, impaired or affected by this Ordinance. SECTION 4: That this Ordinance, and each of its terms, shall be the effective legislative act of a home rule municipality without regard to whether such Ordinance should: (a) contain terms contrary to the provisions of current or subsequent non - preemptive state law; or, (b) legislate in a manner or regarding a matter not delegated to municipalities by state law. It is the intent of the corporate authorities of the Village of Deerfield that to the extent that the terms of this Ordinance should be inconsistent with any non - preemptive state law, this Ordinance shall supersede state law in that regard within its jurisdiction. SECTION 5: That this Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form as provided by law. PASSED this 20th day of September _'2004.
