ORDINANCE NO. 0 -04 -51
AN ORDINANCE ADOPTING 2002 EDITION OF THE
NATIONAL ELECTRICAL CODE REGULATING AND
CONTROLLING THE INSTALLATION, ALTERATION AND USE
OF ELECTRICAL EQUIPMENT IN THE VILLAGE OF DEERFIELD
WHEREAS, three (3) copies of the National Electrical Code 2002 as published by the
National Fire Protection Association have been on file in the office of the Village Clerk for more
than thirty (30) days; and,
WHEREAS, the Village of Deerfield has identified the proposed adoption of the National
Electrical Code 2002 to the Illinois Building Commission as required by Section 1 -2 -3.1 of the
Illinois Municipal Code; and,
WHEREAS, the President and Board of Trustees of the Village of Deerfield have
determined that adoption of the National Electrical Code 2002, as provided in this Ordinance, is in
the best interests of the Village of Deerfield and will serve and promote public health, safety and
welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, in
the exercise of its home rule powers, as follows:
SECTION 1: That the National Electrical Code 2002 as published by the National Fire
Protection Association be and is hereby adopted as the code of the Village of Deerfield for regulating
the installation, alteration, repair, replacement and use of electrical systems in the Village of
Deerfield, and each and all of the regulations, provisions, standards, conditions and terms of such
National Electrical Code 2002 are hereby adopted and made a part hereof by this reference as if fully
set out in this Ordinance, with the additions, insertions, deletions and changes, if any, prescribed in
Section 2 of this Ordinance.
SECTION 2: That Section 8 -2 of Chapter 8, Electricity, of the Municipal Code of the
Village of Deerfield be and the same is hereby amended to read as follows:
Sec. 8 -2. Rules and regulations adopted.
(a) Pursuant to the recommendations of the Electrical Commission there
are hereby adopted as safe and practical standards for the installation, alteration
and use of electrical equipment in the Village the following:
(1) The rules and regulations of the National Fire Protection Association is
contained in the Code as the National Electrical Code 2002, as approved by
the American Standards Association and as last published, which shall
govern the installation and use of all electrical equipment in the Village
except as otherwise provided in this Chapter.
(2) All service entrances shall be rigid conduit. The Director of Building and
Zoning may authorize flexible cable if the use of rigid conduit could not be
installed in a safe and practical manner.
(3) Under no conditions shall flexible metal conduit or non - metallic sheathed
cable be used for any type installation.
(b) The rules and regulations regarding the installation, alterations and
use of electrical equipment last adopted by the electrical supply company now
supplying the Village, and as last published and filed with the Illinois Commerce
Commission, three (3) copies of said Code and the last mentioned rules and
regulations being now on file in the offices of the Clerk and Director of Building and
Zoning for the public use, examination and inspection.
(c) The Director of Building and Zoning shall act as and have all the
powers of and duties given to any electrical inspector.
SECTION 3: That nothing in this Ordinance or in the National Electrical Code 2002 hereby
adopted shall be construed to affect any suit or proceeding pending in any court, or any rights

acquired or liability incurred, or any cause or causes of action acquired or existing under any act or
ordinance hereby repealed as cited in Section 2 of this Ordinance, nor shall any just or legal right or
remedy vested as of the effective date of this Ordinance be lost, impaired or affected by this
Ordinance.
SECTION 4: That this Ordinance, and each of its terms, shall be the effective legislative act
of a home rule municipality without regard to whether such Ordinance should: (a) contain terms
contrary to the provisions of current or subsequent non - preemptive state law; or, (b) legislate in a
manner or regarding a matter not delegated to municipalities by state law. It is the intent of the
corporate authorities of the Village of Deerfield that to the extent that the terms of this Ordinance
should be inconsistent with any non - preemptive state law, this Ordinance shall supersede state law in
that regard within its jurisdiction.
SECTION 5: That this Ordinance shall be in full force and effect from and after its passage,
approval and publication in pamphlet form as provided by law.
