AN ORDINANCE AUTHORIZING AN AMENDMENT
TO A SPECIAL USE FOR BRIARWOOD COUNTRY CLUB
TO PERMIT AN ENVIRONMENTAL FACILITY
WHEREAS, the Plan Commission of the Village of Deerfield held a public hearing on May
27, 2004 on the application of Briarwood Country Club, the owner of certain property commonly
known as Briarwood Country Club located at 355 Deerfield Road, said property being legally
described on Exhibit A attached hereto (the "Subject Property"), for approval of an amendment to
the Special Use for Briarwood Country Club to permit the construction, maintenance and use of an
environmental facility for the storage and mixing of chemicals to be used on the golf course as
herbicides, fungicides, pesticides and fertilizers, and for the washing and cleaning of golf course
equipment and vehicles, and an open air wash pad for washing off greens mowers, in the R -3 Single-
Family Residence District; and,
WHEREAS, said public hearing was held pursuant to public notice duly given and published
as required by statute and conforming in all respects, in both manner and form, with the statutes of
the State of Illinois and the Zoning Ordinances of the Village of Deerfield; and,
WHEREAS, the Plan Commission of the Village of Deerfield, after considering the evidence,
testimony and supporting materials offered at said public hearing, filed its report with the President
and Board of Trustees containing its written findings of fact and recommendation that the requested
amendment to Special Use be authorized pursuant to Article 4.03 -C, Paragraph 3,a and Article 13.11
of the Zoning Ordinance of the Village of Deerfield to allow the construction, maintenance and use
of an environmental facility for the storage and mixing of chemicals to be used on the golf course as
herbicides, fungicides, pesticides and fertilizers, and for the washing and cleaning of golf course
equipment and vehicles, and an open air wash pad for washing off greens mowers, as an amended
Special Use of the Subject Property in the R -3 Single- family Residence Districts; and,
WHEREAS, the President and Board of Trustees of the Village of Deerfield, have
determined that substantial evidence supporting the Plan Commission recommendations was adduced
at said public hearing, that the proposed amendment to the Special Use for the Subject Property fully
complies with the requirements and standards set forth in Article 4.03 -C, Paragraph 3,a and Article
13.11 of the Zoning Ordinance of the Village of Deerfield, and that the best interests of the Village
will be served by the authorization and granting of said amendment to the Special Use in accordance
with the plans and supporting materials submitted by the Applicant, which are incorporated herein
and made a part hereof by this reference;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS,
in the exercise of its home rule powers, as follows:
SECTION 1: That the President and Board of Trustees do hereby aflumatively find that the
amendment to the Special Use as hereby authorized fully complies with the requirements and
standards set forth in Article 4.03 -C, Paragraph 3,a and Article 13.11 of the Zoning Ordinance of the
Village of Deerfield, and that the amended Special Use is hereby authorized and approved as to the
Subject Property in the R -3 Single - Family Residence Districts, subject to the conditions, regulations
and restrictions set forth in Section 2 of this Ordinance, to permit the installation, maintenance and

use of (i) an 1800 square foot chemical storage, mixing and equipment wash structure to be used for
the storage, mixing, and loading of chemicals used on the golf course, for the washing of maintenance
equipment, vehicles and chemical spray units used on the golf course, for containing the release of
chemicals stored and mixed on the premises, and for the recycling of wash water; and (n) a 144
square foot open air wash water containment pad to be used for the cleaning and washing of greens
mowers and the recycling of wash water (collectively, the "Environmental Facility ").
SECTION 2: That the approval and authorization of said amended Special Use is granted
subject to full and complete compliance with the following conditions, regulations and restrictions:
(i) the construction, development, maintenance and use of said Environmental Facility in connection
with the golf course on the Subject Property shall be in accordance with the plans and supporting
materials attached hereto and made a part of this Ordinance as Exhibit B hereof, and with all
representations made and submitted by the Applicant to the Plan Commission and to the President
and Board of Trustees of the Village of Deerfield; (ii) compliance with all current and future
requirements of the Illinois Environmental Protection Agency, the Illinois Department of Agriculture
and all other federal, state and local environmental laws, ordinances, regulations and permits; (iii) the
Environmental Facility shall be located as depicted on the site plan marked as `Briarwood Country
Club Proposed Chemical and Wash Facility" dated 6/9/04 and Detail A Sheet 1 and Detail B Sheet
1; (iv) continued compliance with the requirements of the Special Use currently approved for the
Subject Property, which requirements will remain in full force and effect except as specifically
amended by this Ordinance; and (v) compliance by the Applicant with all other applicable provisions
of the Zoning Ordinance of the Village of Deerfield.

SECTION 3: That the amended Special Use as hereby authorized shall be binding upon and .
inure to the benefit of the Applicant and Applicant =s successors, grantees, transferees and assigns,
and any violation of the conditions herein set forth by the Applicant or its successors, grantees,
transferees or assigns shall authorize the revocation of the amended Special Use as hereby authorized.
SECTION 4: That the Village Clerk is hereby authorized and directed to publish this
Ordinance in pamphlet form and to record this Ordinance in the office of the Recorder of Deeds of
Lake County, Illinois.
SECTION S: That this Ordinance, and each of its terms, shall be the effective legislative act
of a home rule municipality without regard to .whether such Ordinance should: (a) contain terms
contrary to the provisions of current or subsequent non - preemptive state law; or, (b) legislate in a
manner or regarding a matter not delegated to municipalities by state law. It is the intent of the
corporate authorities of the Village of Deerfield that to the extent that the terms of this Ordinance
should be inconsistent with any non - preemptive state law, this Ordinance shall supersede state law
in that regard within its jurisdiction.
SECTION 6: That this Ordinance shall be in full force and effect from and after its passage,
approval and publication in pamphlet form as provided by law.

Briarwood Country Club
Proposed Chemical and Wash Facilities
Purposes and Description
Briarwood Country Club is proposing the construction of two projects as follows:
1. Chemical and Wash Facility
2. Small Wash Area
Purposes of Facilities
With the ever - increasing environmental demands on golf courses, Briarwood
Country Club is proposing to construct equipment wash areas and a chemical
storage and rinsate facility that will meet, or exceed, existing legal requirements
for such facilities in the state of Illinois. Specifically, the facilities will meet, or
exceed, the following legal requirements from the following respective agencies:
A. Illinois Environmental Protection Agency — Directive for Washing of Golf
Course Maintenance Equipment
B. Illinois Department of Agriculture — Lawn Care Products Application and
Notice Act
The chemical rinsate facility will be permitted, as required, by the Illinois
Department of Agriculture.
The Chemical and Wash Facility (located by the existing storage building off of
Waukegan Rd.) will be used for:
a) Storing chemical's used on the golf course such as herbicides, fungicides,
pesticides and fertilizers.
b) Mixing and loading chemicals into chemical spay units for appropriate
application to the golf course
c) Washing the chemical spray units.
d) Washing off maintenance equipment used on the golf course such as;

The Small Wash Area (located by the existing maintenance facility off of
Waukegan Rd.) will be used for:
a) Washing off greens mowers.
Description of Facility(s)
1. Chemical and Wash Facility Structure
Design and build as per the attached drawings an environmental center for a turf care
facility. Included in the design is an equipment wash pad, an equipment- mounting pad, a

chemical sprayer loading facility, and a secured chemical storage building. The
maximum footprint is 60' -0" X 30' -0 ". The Contractor shall furnish all of the materials and
perform,all of the work shown on the drawings and /or described in the specifications as
annexed hereto as it pertains to work to be performed on property located at: Briarwood
Country Club, 355 Deerfield Rd., Deerfield, IL. The structure will be located adjacent to
the existing equipment storage building just off of Waukegan Rd.
Wash Water Containment
Design and construct a 600SF approximate dimension 20' -0" W X 30' -0" D drive - through
wash water containment pad.
1) Open air with 14' eaves height pre- engineered steel shed type roof.
2) Emergency and exit lighting to meet local code.
3) All electrical components, fixtures, wiring, and devices will be moisture proof
installed according to NEC and local codes.
4) Overhead lighting to meet NEC and local code requirements.
5) Install Waste2Water central wastewater collection sump and grating.
6) All underground pipe connections as per local code.
7) All underground electrical connections as per local code.
8) Waste2Water grass clipping separation sump installation and under ground
connections.
9) Wash water collection sump installation and all under ground pipe connections.
10) Install Waste2Water closed loop wash water reclaim and recycle system.
11) Provide startup and training on all contractor installed equipment.
12) Wash pad to be min 6" thickness of 4000psi reinforced concrete.
13) Equipment pad is elevated by 6" to serve as a guard and housekeeping pad.

Design and construct a 180 SF approximate dimension 6' -0" W X 30' -0" D water
treatment plant mounting pad.
1) Install Waste2Water clipping cart drain sump and grating.

3) All underground electrical connections as per local code.
4) Install Waste2Water closed loop wash water reclaim and recycle system.

Special Use Criteria
1. Compatible with Existing Development.
The nature and intensity of the activities involved and the size, placement and design of any
structures proposed will be so planned that the Special Use will be compatible with the existing
development and will not impede the normal and orderly development and improvement of
surrounding property.
The nature and use of the proposed Chemical and Wash Facility and Small
Wash Area will have virtually no impact on the surrounding existing development
to the golf course. The activities on the golf course itself will have little change
other than the location which the washing, chemical storage, and chemical
mixing activities are performed. They will also be preformed in a more
environmentally - friendly fashion with the construction of the new facilities.
2. Lot of Sufficient Size.
The size of the lot will be sufficient for the use proposed.
The lot size will be more than sufficient for the facilities to be constructed. The
golf course is over one hundred acres with wide open fairways, green belts and
rough areas. There is more than ample space to build the two relatively small
facilities.
3. Traffic.
The location of the Special Use within the Village will be such that adverse effects on surrounding
properties will be minimal, particularly regarding the traffic generated by the Special Use.
Both facilities will be located with access from Waukegan Road via existing
access roads. The addition of the facilities will have little or no new impact on
traffic. The structures will neither increase nor decrease existing vehicle traffic
coming to and from Waukegan Road.
4. Parking and Access.
Parking areas will be of adequate size for the particular use and properly located, and the
entrance and exit drives will be laid out so as to prevent traffic hazards and nuisances.
There are existing access roads to the existing buildings where the proposed
facilities will be constructed. The new facilities will not require any additional
parking or access roads.

5. Effect on Neighborhood.
In all respects the Special Use will not be significantly or materially detrimental to the health,
safety and welfare of the public or injurious to the other property or improvements in the
neighborhood, nor will it diminish or impair property values.
The Special Use facilities will actually make the washing activities and the
chemical handling activities on the golf course safer and be more protective of
the environment and the health of the neighborhood. In addition, by containing
the wash water and chemical rinsate, the neighboring properties will be better
protected. The Special Use facilities will, at the same time, not diminish or impair
surrounding property values.
6. Adequate Facilities.
That adequate utilities, access roads, drainage and /or other necessary facilities
have been or are being provided.
The only utility required for the Special Use facilities is electricity. The electrical
utilities are in the process of being provided. Since the Special Use facilities are
designed to contain wash water, chemicals, and chemical rinsate, there will be
no hook up required to the sanitary sewer, storm sewer, drain fields and the like.
Existing access roads will be used occasionally in conjunction with the Special
Use facilities.
7. Adequate Buffering.
Adequate fencing and /or screening shall be provided to ensure the enjoyment of surrounding
properties, to provide for public safety or to screen parking areas and other visually incompatible
uses.
Chemical and Wash Facility - This facility will be approximately 140' from
Waukegan Road and will be hidden by trees and an existing 60'x 60' building.
Therefore, it will be very difficult to see, if visible at all, to the community.
Small Wash Area — This facility will consist of a concrete wash pad with no roof
structure. It will be approximately 200' from Waukegan Road on the West and
will be boarding an existing fenced area on the South. Again, this facility will be
virtually invisible to the community.
8. Other.
Exterior Lighting — There will be no exterior lighting on either facility unless
