VILLAGE OF DEERFIELD LAKE AND COOK COUNTIES, ILLINOIS ORDINANCE NO. .0-04-32 AN ORDINANCE AUTHORIZING A TENANT DIRECTIONAL GROUND SIGN AS AN AMENDMENT TO THE APPROVED SIGN PLAN FOR THE LAKE COOK PLAZA SHOPPING CENTER PUD WHEREAS, the Owner (the "Applicant ") of certain property commonly known as the Lake Cook Plaza .Shopping Center and legally described on Exhibit A attached hereto (the "Subject Property ") has the petitioned the Plan Commission of the Village of Deerfield for approval of an amendment to the signage plan for the Subject Property as an amendment to the Special Use Shopping Center Planned Unit Development for the Subject Property in the C -2 Outlying Commercial District to allow a certain tenant directional ground sign to be established on the Subject Property; and, WHEREAS, the Plan Commission of the Village of Deerfield held a public hearing on March 25, 2004 to consider said amendment to the approved signage plan for the Lake Cook Plaza Shopping Center Planned Unit Development to allow an internally illuminated, single -faced tenant directional ground sign with eight (8) individual tenant panels on the Subject Property, said hearing being held pursuant to public notice and conforming in all respects, in both manner and form, with the requirements of the statutes of the State of Illinois and the Zoning Ordinance of the Village of Deerfield; and, WHEREAS, the Plan Commission of the Village of Deerfield, after considering the proposed amendment to the approved signage plan for the Lake Cook Plaza Shopping Center, and the evidence and supporting materials offered at said hearing, has submitted its written report and recommendation to the President and Board of Trustees of the Village of Deerfield that the requested amendment to the approved signage plan for the Lake Cook Plaza Shopping Center on the Subject Property be authorized pursuant to Article 9.02 -B,12 and Article 13.11 of the Zoning Ordinance of the Village of Deerfield as an amendment to the Special Use Shopping Center/Planned Unit Development of the Subject Property in the C -2 Outlying Commercial District; and, WHEREAS, the President and Board of Trustees of the Village of Deerfield, having determined that substantial evidence supporting the Plan Commission recommendations. was adduced at said public hearing, find that said amendment to the approved signage plan for the Subject Property should be approved as an amendment to the Special Use Shopping Center/Planned Unit Development of the Subject Property in the C -2 Outlying Commercial District, authorizing and permitting the requested tenant directional ground sign in accordance with evidence, testimony, plans and supporting materials presented by the Petitioner at the public hearing and as provided herein; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, in the exercise of its home rule powers, as follows: SECTION 1: That the President and Board of Trustees of the Village of Deerfield do hereby find that the amendment to the approved signage plan for the Lake Cook Plaza Shopping Center fully complies with the requirements and standards set forth in Article 9.02 -B,12 and Article 13.11 of the Zoning Ordinance of the Village of Deerfield. SECTION 2: That the President and Board of Trustees of the Village of Deerfield do hereby authorize and approve the following tenant directional ground sign for the Subject Property as an amendment to the approved signage plan for the Lake Cook Plaza Shopping Center and as an -2- amendment to the Special Use Shopping Center/Planned Unit Development of the Subject Property in the C -2 Outlying Commercial District, subject to the conditions, regulations and restrictions set forth in Section 3 of this Ordinance: An internally illuminated, single -faced ground sign, 27.5 square feet in area with eight (8) individual acrylic tenant panels with directional arrows and bearing the name "Lake Cook Plaza" on the top of the sign. Said sign shall be not larger than six (6) feet tall by six (6) feet in width, and shall be constructed, installed and maintained . in substantial conformance with the plan by Sign Effects, 100 West Central Avenue, Roselle, Illinois, which plan is hereby incorporated and made a part of this ordinance as if fully set forth herein. Said sign shall be located on the grassy area at the terminus of the access road from Lake Cook Road into the shopping center as depicted on the Lake Cook Plaza Site Plan, which is hereby incorporated and made a part of this ordinance. The sign cabinet and base shall be a burgundy color to match the shopping center color scheme. . SECTION 3: Petitioner shall comply with the requirements and recommendations of the Appearance Review Commission with respect to the proposed tenant directional ground sign. Except as otherwise expressly provided herein, the construction, maintenance, development and use of the Subject Property shall be subject to continued compliance with the approved signage plan for the Subject Property, as amended, and with all requirements of the Special Use Shopping Center/Planned Unit Development approved for the Subject Property, as amended. SECTION 4: That the amendment to the approved signage plan for the Subject Property commonly known as the Lake Cook Plaza Shopping Center, hereby approved and authorized as an amendment to the Special Use Shopping Center/Planned Unit Development of the Subject Property, shall be binding upon and inure to the benefit of the Petitioner and Petitioner's successors, grantees, transferees and assigns, and any violation of the conditions herein set forth by Petitioner or its successors, grantees, transferees or assigns shall authorize the revocation of the amended Special Use hereby authorized. -3- SECTION 5: That the Village Clerk is hereby authorized and directed to record this Ordinance in the office of the Recorder of Deeds of Cook County, Illinois at Petitioner =s expense. SECTION 6: That this Ordinance, and each of its terms, shall be the effective legislative act of a home rule municipality without regard to whether such Ordinance should: (a) contain terms contrary to the provisions of current or subsequent non - preemptive state law; or, (b) legislate in a manner or regarding a matter not delegated to municipalities by state law. It is the intent of the corporate authorities of the Village of Deerfield that to the extent that the terms of this Ordinance should be inconsistent with any non - preemptive state law, this Ordinance shall supersede state law in that regard within its jurisdiction. SECTION 7: That this Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form as provided by law. PASSED this 7th day of June '2004. VILLAGE OF DEERFIELD LAKE AND COOK COUNTIES, ILLINOIS ORDINANCE NO. 0-04-32 AN ORDINANCE AUTHORIZING A TENANT DIRECTIONAL GROUND SIGN AS AN AMENDMENT TO THE APPROVED SIGN PLAN FOR THE LAKE COOK PLAZA SHOPPING CENTER PUD WHEREAS, the Owner (the "Applicant ") of certain property commonly known as the Lake Cook Plaza .Shopping Center and legally described on Exhibit A attached hereto (the "Subject Property ") has the petitioned the Plan Commission of the Village of Deerfield for approval of an amendment to the signage plan for the Subject Property as an amendment to the Special Use Shopping Center Planned Unit Development for the Subject Property in the C -2 Outlying Commercial District to allow a certain tenant directional ground sign to be established on the Subject Property; and, WHEREAS, the Plan Commission of the Village of Deerfield held a public hearing on March 25, 2004 to consider said amendment to the approved signage plan for the Lake Cook Plaza Shopping Center Planned Unit Development to allow an internally illuminated, single -faced tenant directional ground sign with eight (8) individual tenant panels on the Subject Property, said hearing being held pursuant to public notice and conforming in all respects, in both manner and form, with the requirements of the statutes of the State of Illinois and the Zoning Ordinance of the Village of Deerfield; and, WHEREAS, the Plan Commission of the Village of Deerfield, after considering the proposed amendment to the approved signage plan for the Lake Cook Plaza Shopping Center, and the evidence and supporting materials offered at said hearing, has submitted its written report and recommendation to the President and Board of Trustees of the Village of Deerfield that the requested amendment to the approved signage plan for the Lake Cook Plaza Shopping Center on the Subject Property be authorized pursuant to Article 9.02 -B,12 and Article 13.11 of the Zoning Ordinance of the Village of Deerfield as an amendment to the Special Use Shopping Center/Planned Unit Development of the Subject Property in the C -2 Outlying Commercial District; and, WHEREAS, the President and Board of Trustees of the Village of Deerfield, having determined that substantial evidence supporting the Plan Commission recommendations was adduced at said public hearing, find that said amendment to the approved signage plan for the Subject Property should be approved as an amendment to the Special Use Shopping Center/Planned Unit Development of the Subject Property in the C -2 Outlying Commercial District, authorizing and permitting the requested tenant directional ground sign in accordance with evidence, testimony, plans and supporting materials presented by the Petitioner at the public hearing and as provided herein; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, in the exercise of its home rule powers, as follows: SECTION 1: That the President and Board of Trustees of the Village of Deerfield do hereby find that the amendment to the approved signage plan for the Lake Cook Plaza Shopping Center fully complies with the requirements and standards set forth in Article 9.02 -B, 12 and Article 13.11 of the Zoning Ordinance of the Village of Deerfield. SECTION 2: That the President and Board of Trustees of the Village of Deerfield do hereby authorize and approve the following tenant directional ground sign for the Subject Property as an amendment to the approved signage plan for the Lake Cook Plaza Shopping Center and as an -2- amendment to the Special Use Shopping Center/Planned Unit Development of the Subject Property in the C -2 Outlying Commercial District, subject to the conditions, regulations and restrictions set forth in Section 3 of this Ordinance: An internally illuminated, single -faced ground sign, 27.5 square feet in area with eight (8) individual acrylic tenant panels with directional arrows and bearing the name "Lake Cook Plaza" on the top of the sign. Said sign shall be not larger than six (6) feet tall by six (6) feet in width, and shall be constructed, installed and maintained in substantial conformance with the plan by Sign Effects, 100 West Central Avenue, Roselle, Illinois, which plan is hereby incorporated and made a part of thus ordinance as if fully set forth herein. Said sign shall be located on the grassy area at the terminus of the access road from Lake Cook Road into the .shopping center as depicted on the Lake Cook Plaza Site Plan, which is hereby incorporated and made a part of this ordinance. The sign cabinet and.base shall be a burgundy color to match the shopping center color scheme. SECTION 3: Petitioner shall comply with the requirements and recommendations of the Appearance Review Commission with respect to the proposed tenant directional ground sign. Except as otherwise expressly provided herein, the construction, maintenance, development and use of the Subject Property shall be subject to continued compliance with the approved signage plan for the Subject Property, as amended, and with all requirements of the Special Use Shopping Center/Planned Unit Development approved for the Subject Property, as amended. SECTION 4: That the amendment to the approved signage plan for the Subject Property commonly known as the Lake Cook Plaza Shopping Center, hereby approved and authorized as an amendment to the Special Use Shopping Center/Planned Unit Development of the Subject Property, shall be binding upon and inure to the benefit of the Petitioner and Petitioner's successors, grantees, transferees and assigns, and any violation of the conditions herein set forth by Petitioner or its successors, grantees, transferees or assigns shall authorize the revocation of the amended Special Use hereby authorized. -3- SECTION 5: That the Village Clerk is hereby authorized and directed to record this Ordinance, in the office of the Recorder of Deeds of Cook County, Illinois at Petitioner =s expense. SECTION 6: That this Ordinance, and each of its terms, shall be the effective legislative act of a home rule municipality without regard to whether such Ordinance should: (a) contain terms contrary to the provisions of current or subsequent non - preemptive state law; or, (b) legislate in a manner or regarding a matter not delegated to municipalities by state law. It is the intent of the corporate authorities of the Village of Deerfield that to the extent that the terms of this Ordinance should be inconsistent with any non - preemptive state law, this Ordinance shall supersede state law in that regard within its jurisdiction. SECTION 7: That this Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form as provided by law. PASSED this 7th day of June , 2004.
