VILLAGE OF DEERFIELD LAKE AND COOK COUNTIES, ILLINOIS ORDINANCE NO. 0-04-29 AN ORDINANCE AMENDING CHAPTER 6 OF THE MUNICIPAL CODE OF THE VILLAGE OF DEERFIELD TO PROVIDE A CONSOLIDATED SCHEDULE OF PERMIT FEES AND CHARGES RELATED TO BUILDING CONSTRUCTION ACTIVITIES WHEREAS, the Village Manager and administrative staff have reviewed the various fees that are charged for Village services related to building permit plan review, permits, inspections and other private construction related activity and have found that these fees have not been increased at a rate commensurate with inflation and do not otherwise reasonably approximate the Village's costs and expenses in providing such Village services; and, WHEREAS, the Village Manager and staff have recommended that these fees be increased to more accurately account for the costs and expenses of providing such Village services; and, WHEREAS, the Village Manager and staff are also recommending that the miscellaneous fees related to such building and construction related activity now contained in several locations in the Municipal Code of the Village of Deerfield should be consolidated in a comprehensive fee schedule for administrative clarity and efficiency; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, in the exercise of its home rule powers, as follows: SECTION 1: That Chapter 6, Building, of the Municipal Code of the Village of Deerfield be and the same is hereby amended to add the following as Article 10 thereof entitled Comprehensive Building Fee Schedule. Article 10. Comprehensive Building Fee Schedule. 6 -10 -1. Purpose: The purpose of this Article 10 is to consolidate all Village fees and charges related to plan review, permitting, inspection and other activities related to building and construction related activities into one article of Chapter 6 of the Municipal Code for ease of reference and administrative purposes. 6 -10 -2. Applicability: Each fee, charge, or rate set forth in this Article 10 shall apply to the provisions of the corresponding section of the Municipal Code of the Village of Deerfield as set forth below. To the extent that any fee, charge or rate referenced in this Article 10 is inconsistent with any provision contained elsewhere in the Municipal Code, the provisions of this Article shall control. 6 -10 -3. SECTION 3: That this Ordinance, and each of its terms, shall be the effective legislative act of a home rule municipality without regard to whether such Ordinance should: (a) contain M terms contrary to the provisions of current or subsequent non - preemptive state law; or, (b) legislate in a manner or regarding a matter not delegated to municipalities by state law. It is the intent of the corporate authorities of the Village of Deerfield that to the extent that the terms of this Ordinance should be inconsistent with any non - preemptive state law, this Ordinance shall supersede state law in that regard within its jurisdiction. SECTION 4: That this Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form as provided by law. PASSED this 17th day of May , 2004.
