AN ORDINANCE AUTHORIZING A GOUND SIGN FOR
SIMTH BARNEY AS AN AMENDMENT TO THE APPROVED SIGN
PLAN FOR 111 PFINGSTEN ROAD.
WHEREAS, the owner (the "Petitioner ") of certain property at 111 Pfingsten Road
legally described on Exhibit A attached hereto (the "Subject Property") has petitioned the Plan
Commission of the Village of Deerfield for approval of an amendment to the signage plan for the
Subject Property as an amendment to the Special Use Industrial Planned Unit Development for
the Subject Property in the I -1 Office, Research, Restricted Industrial to allow the tenant name
"Smith Barney" and logo to be placed on the existing business ground sign on the Subject
Property; and,
WHEREAS, the Plan Commission of the Village of Deerfield held a public hearing on.
March 25, 2004 to consider said amendment to the approved signage plan for 111 Pfingsten
Road to allow the existing monument ground sign for 111 Pfingsten Road on the Subject
Property to bear the name "Smith Barney," said hearing being held pursuant to public notice and
conforming in all respect, in both manner and form with the requirements of the statutes of the
State of Illinois and the Zoning Ordinance of the Village of Deerfield; and,
WHEREAS, the Plan Commission of the Village of Deerfield, after considering the
proposed amendment to the approved signage plan for 111 Pfingsten Road, and the evidence and
supporting materials offered at said hearing, has submitted its written report and
recommendation to the President and Board of Trustees of the Village of Deerfield that said
amendment to the approved signage plan for 111 Pfingsten Road on the Subject Property be
approved as, an amendment to the Special Use Industrial Planned Unit Development of the
Subject Property in the I -1 Office, Research, Restricted Industrial District; and,
WHEREAS, the President and Board of Trustees of the Village of Deerfield find that
said amendment to the approved signage plan for the Subject Property should be approved as an
amendment to the Special Use Industrial Planned Unit Development of the Subject Property in
the I -1 Office, Research, Restricted Industrial District, authorizing and permitting the requested
signage plan modifications in accordance with the evidence, testimony, plans and supporting
materials presented by the Petitioner at the public and listed in Section 3 of this Ordinance;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES,
ILLINOIS, in the exercise of its home rule powers, as follows:
SECTION 1: That the President and Board of Trustees of the Village of Deerfield do
hereby find that the amendment to the approved signage plan for 111 Pfingsten Road fully
complies with the requirements and standards set forth in Article 9.02 -C I -1, Office, Research,
Restricted Industrial District, Planned Unit Development, Paragraph 1, Subparagraph a(2) and
Article 13.11 of the Zoning Ordinance of the Village of Deerfield.
SECTION 2: That the President and Board of Trustees of the Village of Deerfield do
hereby authorize and approve the following ground sign for the Subject Property as an
amendment to the approved signage plan for 111 Pfingsten Road, and as an amendment to the
Special Use Industrial Planned Unit Development of the Subject Property in the 1 -1 Office,
Research, Restricted Industrial District, subject to the conditions, regulations and restrictions set
forth in Section 3 of this Ordinance:
A granite panel containing the logo /graphics for Smith Barney shall be
allowed on the existing monument ground sign located at the entrance to
the building on the west side of the Subject Property in accordance with
plans for "Smith Barney - Monument Sign" by North Shore Sign dated
3/9/04.
SECTION 3: Except as expressly provided herein, the construction, maintenance,
development and use of the Subject Property shall be subject to continued compliance with the
approved signage plan for the Subject Property, as amended, and with all requirements of the
Special Use Industrial Planned Unit Development approved for the Subject Property, as
amended.
SECTION 4: That the amendment to the approved signage plan for the Subject Property
at 111 Pfingsten Road, hereby approved and authorized as an amendment to the Special Use
Planned Unit Development of the Subject Property, shall be binding upon and, inure to the
benefit of the Petitioner and Petitioner's successors, grantees, transferees and assigns, and any
violation. of the conditions herein set forth by Petitioner or its successors, grantees, transferees or
assigns shall authorize the revocation of the. amended Special Use hereby authorized.
SECTION 5: That the Village Clerk is hereby authorized and directed to record this
Ordinance in the Office of the Recorder of Deeds of Lake County, Illinois, at Petitioner's
expense.
SECTION 6: That this Ordinance, and each of its terms, shall be the effective legislative
act of a home rule municipality without regard to whether such Ordinance should: (a) contain
terms contrary to the provisions of current or subsequent non - preemptive state law; or, (b)
legislate in a manner or regarding a matter not delegated to municipalities by state law. It is the

intent of the corporate authorities of the Village of Deerfield that to the extent that the terms of
this Ordinance should be inconsistent with any non - preemptive state law, this Ordinance shall
supersede state law in that regard within its jurisdiction.
SECTION 7: That this Ordinance shall be in full force and effect from and after its
passage, approval and publication in pamphlet form as provided by law.
