VILLAGE OF DEERFIELD LAKE AND COOK COUNTIES, ILLINOIS ORDINANCE NO. 0-04-26 AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE VILLAGE OF DEERFIELD TO AUTHORIZE CERTAIN GROUND SIGNS IN THE I -1 OFFICE, RESEARCH AND RESTRICTED INDUSTRIAL DISTRICT WHEREAS, the owner (the "Petitioner ") of certain property at 111 Pfingsten Road legally described on Exhibit A attached hereto (the "Subject Property ") has petitioned the Plan Commission of the Village of Deerfield for a text amendment to Article 9.02 -C of the Zoning Ordinance of the Village of Deerfield that would permit the building identification ground sign for a building within an I -I Planned Unit Development to include the name of not more than one tenant located in the building; and, WHEREAS, the Plan Commission of the Village of Deerfield held a public hearing on March 25, 2004 to consider said text amendment, said hearing being held pursuant to public notice and conforming in all respect, in both manner and form, with the requirements of the statutes of the State of Illinois and the Zoning Ordinance of the Village of Deerfield; and, WHEREAS, the Plan Commission of the Village of Deerfield, after considering the evidence and supporting materials presented at said hearing, submitted its written report and findings of fact to the Board of Trustees of the Village of Deerfield recommending a text amendment to Article 9.02 -C, I -1 Office Research, Restricted Industrial District, Planned Unit Development, Paragraph 1, Subparagraph a(2), to permit a business ground sign for a building within an I -1 Planned Unit Development to include the name of not more than one tenant located in the building; and, WHEREAS, the President and Board of Trustees of the Village of Deerfield concur in the recommendation of the Plan Commission and have determined that it is in the best interests of the Village of Deerfield that the text of the Zoning Ordinance be amended as provided herein; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, in the exercise of its home rule powers, as follows: SECTION 1: That Subparagraph a (Number and Content), (2) (Ground Signs), of Paragraph 1 (Business Identification Signs of Article 9.02 -C I -1 Office, Research, Restricted Industrial District, Planned Unit Development, of the Zoning Ordinance of the Village of Deerfield, as amended, be and the same is hereby further amended to add the following underscored language: (2) Ground Signs Not more than one (1) ground sign shall be permitted for each frontage. Where a Planned Unit Development has a frontage on a public street or public right -of -way in excess of five hundred (500) feet, one additional ground sign shall be permitted on that frontage. Said sign shall be located at least a distance equal to one half of the length of the frontage from each other except that if said Planned Unit Development is serviced by more than one entrance'drive and said drives are closer than a distance equal to one half of the length of the frontage, said signs may be located at the entrance drives. Such signs shall contain only the name of the building, or the name of the development, or the name of one (1) tenant located in the building. Said sign may include the address of the development. SECTION 2: That this Ordinance, and each of its terms, shall be the effective legislative act of a home rule municipality without regard to whether such Ordinance should: (a) contain terms contrary to the provisions of current or subsequent non - preemptive state law; or, (b) 0 legislate in a manner or regarding a matter not delegated to municipalities by state law. It is the intent of the corporate authorities of the Village of Deerfield that to the extent that the terms of this Ordinance should be inconsistent with any non - preemptive state law, this Ordinance shall supersede state law in that regard within its jurisdiction. SECTION 3:. That this Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form as provided by law. PASSED this 17th day of May , 2004.
