VILLAGE OF DEERFIELD LAKE AND COOK COUNTIES, ILLINOIS ORDINANCE NO. 0-04-13 AN ORDINANCE AUTHORIZING A GROUND SIGN FOR DUNKIN DONUTS AS AMENDMENT TO THE APPROVED SIGN PLAN FOR LAKE COOK PLAZA WHEREAS, the owner of the property (the "Petitioner ") commonly known as Dunkin Donuts, 499 Lake Cook Road, in the Lake Cook Plaza Shopping Center Planned Unit Development, and legally described on Exhibit A attached hereto (the "Subject Property"), has petitioned the Plan Commission of the Village of Deerfield for approval of an amendment to the signage plan for the Subject Property as an amendment to the Special Use Planned Unit Development of the Lake Cook Plaza shopping center in the C -2 Outlying Commercial District to allow a monument ground sign for Dunkin Donuts on the Subject Property; and, WHEREAS, the Plan Commission of the Village of Deerfield held a public hearing on January 15, 2004 to consider said amendment to the approved signage plan for Lake Cook Plaza to allow a certain monument ground sign for Dunkin Donuts on the Subject Property, said hearing being held pursuant to public notice and conforming in all respects, in both manner and form, with the requirements of the statutes of the State of Illinois and the Zoning Ordinance of the Village of Deerfield; and, WHEREAS, the Plan Commission of the Village of Deerfield, after considering the proposed amendment to the approved signage plan for Lake Cook Plaza, and the evidence and supporting materials offered at said hearing, has submitted its written report and recommendation to the President and Board of Trustees of the Village of Deerfield that said amendment to the approved signage plan for Dunkin Donuts on the Subject Property be approved as an amendment to the Special Use Planned Unit Development for Lake Cook Plaza in the C -2 Outlying Commercial District; and, WHEREAS, the President and Board of Trustees of the Village of Deerfield find that proposed amendment to the approved signage plan for the Subject Property in Lake Cook Plaza should be approved as an amendment to the Special Use Planned Unit Development of Lake Cook Plaza in the C -2 Outlying Commercial District, authorizing and permitting a monument ground sign for Dunkin Donuts on the Subject Property in Lake Cook Plaza in accordance with plans and exhibits presented by the Petitioner and fisted in Section 3 of this Ordinance; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, in the exercise of its home rule powers, as follows: SECTION 1: That the President and Board of Trustees of the Village of Deerfield do hereby find that the amendment to the approved signage plan for Dunkin Donuts in Lake Cook Plaza fully complies with the requirements and standards set forth in Article 9.02 -B, Paragraph 11 and Article 13.11 of the Zoning Ordinance of the Village of Deerfield. SECTION 2: That the President and Board of Trustees of the Village of Deerfield do hereby authorize and approve the following ground sign for the Subject Property as an amendment to the approved signage plan for Lake Cook Plaza, and as an amendment to the Special Use Planned Unit Development of the Subject Property in the C -2 Outlying Commercial District, subject to the conditions, regulations and restrictions set forth in Section 3 of this Ordinance: An illuminated monument ground sign with illuminated channel letters shall be allowed for the Subject Property in the Lake Cook Plaza Planned 0 \ Unit Development Shopping Center in accordance with Drawing No. 02.0996b -4 dated 5 -6 -03 by Grate Signs depicting a Dunkin Donuts sign with a maximum height of 3'8" above grade, a maximum width of 5'4" SECTION 3: That the approval and authorization of said amendment to the approved signage plan for the Subject Property in Lake Cook Plaza is hereby granted subject to the following conditions, regulations and restrictions: A. Said monument ground sign for Dunkin Donuts shall constructed and maintained in accordance with said Drawing No. 02.0996b -4 dated 5 -6 -03 by Grate Signs depicting a Dunkin Donuts sign with a maximum height of 3'8" above grade, a maximum width of 5'4". B. Said monument ground sign for Dunkin Donuts shall be located in the northwest corner of the Subject Property as depicted on the Site Plan Sheet A -1, entitled "Dunkin Donuts Monument Sign 499 Lake Cook Road Lake Cook Plaza Deerfield, IL" dated September 8, 2003, by Warren Johnson Architects, Inc. C. Except as expressly provided herein, the construction development, maintenance and use of the Subject Property in the Lake Cook Plaza Planned Unit Development shall be in accordance with the final development plan heretofore approved as a Special Use Planned Unit Development of Lake Cook Plaza in the C -2 Outlying Commercial District. SECTION 4: That the amendment to the approved signage plan to allow a monument ground sign on the Subject Property hereby approved and authorized shall be binding upon and inure to the benefit of the Petitioner and Petitioner's successors, grantees, transferees and assigns, and any violation of the conditions herein set forth by Petitioner or its successors, grantees, transferees or assigns shall authorize the revocation of the amended Special Use hereby authorized. 3 SECTION 5: That the Village Clerk is hereby authorized and directed to record this Ordinance in the office of the Recorder of Deeds of Cook County, Illinois at Petitioner's expense. SECTION 6: 'That this Ordinance, and each of its terms, shall be the effective legislative act of a home rule municipality without regard to whether such Ordinance should: (a) contain terms contrary to the provisions of current or subsequent non - preemptive state law; or, (b) legislate in a manner or regarding a matter not delegated to municipalities by state law. It is 'the intent of the corporate authorities of the Village of Deerfield that to the extent that the terms of this Ordinance should be inconsistent with any non - preemptive state law, this Ordinance shall supersede state law in that regard within its jurisdiction. SECTION 7: That this Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form as provided by law. PASSED this 15th day of March , 2004.
