and, WHEREAS, West Deerfield Township, the owner of the Subject Property, has petitioned the Village for: (1) the Subject Property to be rezoned from the R -5 General Residence District to the P -1 Public Lands District; (2) for approval of a Special Use pursuant to Section 7.02 -C,8 of the Zoning Ordinance of the Village of Deerfield; and, (3) for an amendment to the Deerfield Centre Planned Unit Development to provide for seven (7) Deerfield Centre Parking spaces to be partially located on the Subject Property and for motor vehicle access to the Subject Property through the Deerfield Centre development, all for the purpose. of permitting a new office facility for West Deerfield Township on the Subject Property; and, WHEREAS, the Plan Commission of the Village of Deerfield held a public, hearing on December 11, 2003 to consider said request for rezoning the Subject Property to the P -1 Public Lands District, for a Special Use pursuant to Section 7.02 -C,8 of the Zoning Ordinance of the Village of Deerfield, and for an amendment to the Deerfield Centre PUD to permit a new office facility for West Deerfield Township, said hearing being held pursuant to public notice and 3 conforming in all respect, in both manner and form, with the requirements of the statutes of the State of Illinois and the Zoning Ordinance of the Village of Deerfield; and, WHEREAS, the Plan Commission of the Village of Deerfield, after considering the testimony and documentary evidence and supporting materials offered at said public hearing, filed its report with the President and Board of Trustees containing its written findings of fact and recommendation to rezone the Subject Property from R -5 General Residence District to P -1 Public Lands District, to authorize a Special Use pursuant to' Article 7.02 -C,8 of the Zoning Ordinance of the Village of Deerfield, and to approve an amendment to the Deerfield Centre Planned Unit Development to allow seven (7) Deerfield Centre Parking spaces to be partially located on the Subject Property and for motor vehicle access for the Subject Property to be provided through the Deerfield Centre development, all for the purpose of permitting a new public office facility for West Deerfield Township to be located on the Subject Property; and, WHEREAS, the President and Board of Trustees of the Village of Deerfield have considered and reviewed the proposed plan for the Subject Property, the supporting materials submitted by the Applicant, the evidence adduced at said public hearing, and the findings of fact and recommendations of the Plan Commission of the Village of Deerfield; and, WHEREAS, the President and Board ' of Trustees of the Village of Deerfield have determined that the best interest of the Village will be served by amending the Zoning Map of the Village of Deerfield to change the zoning classification of the Subject Property from R -5 General Residence District to P -1 Public Lands District in accordance with the plans and supporting materials submitted by the Applicant which are incorporated herein and made a part hereof by this reference; and, WHEREAS, the President and Board of Trustees of the Village of Deerfield have further determined that substantial evidence supporting the Plan Commission recommendations was 2 adduced at said public hearing, that the proposed Special Use for the Subject Property fully complies with the requirements and standards set forth in Article 7.02 -C,8 and Article 13.11 of the Zoning Ordinance of the Village of Deerfield, and that the best interests of the Village will be served by the further authorization and granting of the requested Special Use and the authorization and granting of an amendment to the Deerfield Centre Planned Unit Development to allow a public office facility for West Deerfield Township to be located on the Subject Property to the extent provided herein and in accordance with the plans and supporting materials submitted by the Applicant, all of which are incorporated herein and made a part hereof by this reference; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES; ILLINOIS, in the exercise of its home rule powers, as follows: SECTION 1: That the President and Board of Trustees of the Village of Deerfield do hereby authorize and approve an amendment to the Zoning Map of the Village of Deerfield to change the zoning classification of the Subject Property legally described on Exhibit A attached hereto from the R -5 General Residence District to the P -1 Public Lands District, subject to the Special Use for the proposed public office facility and the amendment to the Deerfield Centre Planned Unit Development hereby approved and authorized. SECTION 2: That the President and Board of Trustees of the Village of Deerfield do hereby authorize and approve the establishment, operation and maintenance of a West Deerfield Township public office facility as a Special Use of the Subject Property in the P -1 Public Lands District pursuant to Article 7.02 -C,8 of the Zoning Ordinance of the Village of Deerfield, subject to the conditions, regulations and restrictions set forth in Section 4 of this Ordinance. s r SECTION 3: That the President and Board of Trustees do further authorize and approve an amendment to the Deerfield Centre Planned Unit Development to provide for vehicular access to the Subject Property through the Deerfield Centre Shopping Center property immediately west of the Subject Property and for the reconfiguration of 22 existing parking spaces in Deerfield Centre's east parking lot as 24 parking spaces, with 7 parking spaces to be partially located on the Subject Property, subject to the conditions, regulations and restrictions set forth in Section 4 of this Ordinance. SECTION 4: That the approval and authorization of said Zoning Map amendment, Special Use and amendment to the Deerfield Centre Planned Unit Development is hereby granted subject full and continued compliance with the following conditions, regulations and restrictions: A. That the construction, development and use of the Subject Property for said public office facility shall be in accordance with the documents, materials and exhibits attached hereto and made a part hereof as Exhibit B. B. That the construction, development and use of the Subject Property and of the east parking lot of the Deerfield Centre Shopping Center shall be in accordance with the proposed site plan for the proposed office building for West Deerfield Township, Sheet A -1 of 3, bearing a revision date of 12- 19 -03, by Daniel Robison Architects, P.C. C. That the Applicant and the owner of the Deerfield Centre property shall enter into a Cross - Easement Agreement providing the ' Applicant with a permanent easement right for access to Deerfield Road through the Deerfield Centre property substantially as depicted on said proposed site plan, and granting Deerfield Centre a permanent easement right to establish, maintain and use seven (7) parking spaces 4 Z partially located on the Subject Property substantially as depicted on said proposed site plan. D. That the Applicant shall dedicate a seven foot (7') strip at the north end of the Subject Property to the Village of Deerfield to provide for the future improvement of a sidewandbicycle path along the south side of Deerfield Road in accordance with the Comprehensive Plan of the Village of Deerfield. E. Applicant's initial and continued compliance with all other applicable provisions of the Zoning Ordinance of the Village of Deerfield. SECTION 5: That the Special Use as hereby authorized shall be binding upon and inure to the benefit of the Applicant and Applicant's successors, grantees, transferees and assigns, and any violation of the conditions herein set forth by the Applicant or its successors, grantees, transferees or assigns shall authorize the revocation of the Special Use as hereby authorized. SECTION 6: That the amendment to the Deerfield Centre Planned Unit Development hereby approved and authorized shall be binding upon and inure to the benefit of the Applicant and the Deerfield Centre property owner and their respective successors, grantees, transferees and assigns, and any violation of the conditions hereinabove set forth by the Applicant or the Deerfield Centre property owner, or their respective successors, grantees, transferees or assigns, shall authorize the revocation of the amendment to the Deerfield Centre Planned Unit Development hereby authorized. SECTION 7: That the Village Clerk is hereby authorized and directed to publish this Ordinance in pamphlet form and to record this Ordinance in the office of the Recorder of Deeds of Lake County, Illinois at Applicant's expense. 5 SECTION 8: That this Ordinance, and each of its terms, shall be the effective legislative act of a home rule municipality without regard to whether such Ordinance should: (a) contain terms contrary to the provisions of current or subsequent non - preemptive state law; or, (b) legislate in a mariner or regarding a matter not delegated to municipalities by state law. It is the intent of the corporate authorities of the Village of Deerfield that to the extent that the terms of this Ordinance should be inconsistent with any non - preemptive state law, this Ordinance shall supersede state law in that regard within its jurisdiction. SECTION 9: That this Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form as provided by law. PASSED this 2nd day of February , 2004. VILLAGE OF DEERFIELD LAKE AND COOK COUNTIES, ILLINOIS ORDINANCE NO. 0-04-06 AN ORDINANCE REZONING CERTAIN PROPERTY AT 601 AND 607 DEERFIELD ROAD, AUTHORIZING A SPECIAL USE AND APPROVING AN AMENDMENT TO THE DEERFIELD CENTRE PUD TO PERMIT A NEW OFFICE FACILITY FOR WEST DEERFIELD TOWNSHIP WHEREAS, the property legally described on Exhibit A attached hereto and commonly known as 601 and 607 Deerfield Road (the "Subject Property") is located in the Village of Deerfield and is currently zoned in the R -5 General Residence District; and, WHEREAS, West Deerfield Township, the owner of the Subject Property, has petitioned the Village for: (1) the Subject Property to be rezoned from the R -5 General Residence District to the P -1 Public Lands District; (2) for approval of a Special Use pursuant to Section 7.02 -C,8 of the Zoning Ordinance of the Village of Deerfield; and, (3) for an amendment to the Deerfield Centre Planned Unit Development to provide for seven (7) Deerfield Centre Parking spaces to be partially located on the Subject Property and for motor vehicle access to the Subject Property through the Deerfield Centre development, all for the purpose of permitting a new office facility for West Deerfield Township on the Subject Property; and, WHEREAS, the Plan Commission of the Village of Deerfield held a public hearing on December 11, 2003 to consider said request for rezoning the Subject Property to the P -1 Public Lands District, for a Special Use pursuant to Section 7.02 -C,8' of the Zoning Ordinance of the Village of Deerfield, and for an amendment to the Deerfield Centre PUD to permit a new office facility for West Deerfield Township, said hearing being held pursuant to public notice and conforming in all respect, in both manner and form, with the requirements of the statutes of the State of Illinois and the Zoning Ordinance of the Village of Deerfield; and, WHEREAS, the Plan Commission of the Village of Deerfield, after considering the testimony and documentary evidence and supporting materials offered at said public hearing, filed its report with the President and Board of Trustees containing its written findings of fact and recommendation to rezone the Subject Property from R -5 General Residence District to P -1 Public Lands District, to authorize a Special Use pursuant to Article 7.02 -C,8 of the Zoning Ordinance of the Village of Deerfield, and to approve an amendment to the Deerfield Centre Planned Unit Development to allow seven (7) Deerfield Centre Parking spaces to be partially located on the Subject Property and for motor vehicle access for the Subject Property to be provided through the Deerfield Centre development, all for the purpose of permitting a new public office facility for West Deerfield Township to be located on the Subject Property; and, WHEREAS, the President and Board of Trustees of the Village of Deerfield have considered and reviewed the proposed plan for the Subject Property, the supporting materials submitted by the Applicant, the evidence adduced at said public hearing, and the findings of fact and recommendations of the Plan Commission of the Village of Deerfield; and, WHEREAS, the President and Board of Trustees of the Village of Deerfield have determined that the best interest of the Village will be served by amending the Zoning Map of the Village of Deerfield to change the zoning classification of the Subject Property from R -5 General Residence District to P -1 Public Lands District in accordance with the plans and supporting materials submitted by the Applicant which are incorporated herein and made a part hereof by this reference; and, WHEREAS, the President and Board of Trustees of the Village of Deerfield have further determined that substantial evidence supporting the Plan Commission recommendations was 2 adduced at said public hearing, that the proposed Special Use for the Subject Property fully complies with the requirements and standards set forth in Article 7.02 -C,8 and Article 13.11 'of the Zoning Ordinance of the Village of Deerfield, and that the best interests of the Village will be served by the further authorization and granting of the requested Special Use and the authorization and granting of an amendment to the Deerfield Centre Planned Unit Development to allow a public office facility for West Deerfield Township to be located on the Subject Property to the extent provided herein and in accordance with the plans and supporting materials submitted by the Applicant, all of which are incorporated herein and made a part hereof by this reference; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, in the exercise of its home rule powers, as follows: SECTION 1: That the President and Board of Trustees of the Village of Deerfield do hereby authorize and approve an amendment to the Zoning Map of the Village of Deerfield to change the zoning classification of the Subject Property legally described on Exhibit A attached hereto from the R -5 General Residence District to the P -1 Public Lands District, subject to the Special Use for the proposed public office facility and the amendment to the Deerfield Centre Planned Unit Development hereby approved and authorized. SECTION 2: That the President and Board of Trustees of the Village of Deerfield do hereby authorize and approve the establishment, operation and maintenance of a West Deerfield Township public office facility as a Special Use of the Subject Property in the P -1 Public Lands District pursuant to Article 7.02 -C,8 of the Zoning Ordinance of the Village of Deerfield, subject to the conditions, regulations and restrictions set forth in Section 4 of this Ordinance. 3 SECTION 3: That the President and Board of Trustees do further. authorize and approve an amendment to the Deerfield Centre Planned Unit Development to provide for vehicular access to the Subject Property through the Deerfield Centre Shopping Center property immediately west of the Subject Property and for the reconfiguration of 22 existing parking spaces in Deerfield Centre's east parking lot as 24 parking spaces, with 7 parking spaces to be partially located on the Subject Property, subject to the conditions, regulations and restrictions set forth in Section 4 of this Ordinance. SECTION 4: That the approval and authorization of said Zoning Map amendment, Special Use and amendment to the Deerfield Centre Planned Unit Development is hereby granted subject full and continued compliance with the following conditions, regulations and restrictions: A. That the construction, development and use of the Subject Property for said public office facility shall be in accordance with the documents, materials and exhibits attached hereto and made a part hereof as Exhibit 13. B. That the construction, development and use of the Subject Property and of the east parking lot of the Deerfield Centre Shopping Center shall be in accordance with the proposed site plan for the proposed office building for West Deerfield Township, Sheet A -1 of 3, bearing a revision date of 12- 19 -03, by Daniel Robison Architects, P.C. C. That the Applicant and the owner of the Deerfield Centre property shall enter into a Cross - Easement Agreement providing the Applicant with a permanent easement right for access to Deerfield Road through the Deerfield Centre property substantially as depicted on said proposed site plan, and granting Deerfield Centre a permanent easement right to establish, maintain and use seven (7) parking spaces 4 partially located on the Subject Property substantially as depicted on said proposed site plan. D. That the Applicant shall dedicate a seven foot (7) strip at the north end of the Subject Property to the Village of Deerfield to provide for the future improvement of a sidewalk/bicycle path along the south side of Deerfield Road in accordance with the Comprehensive Plan of the Village of Deerfield. E. Applicant's initial and continued compliance with all other applicable provisions of the Zoning Ordinance of the Village of Deerfield. SECTION 5: That the Special Use as hereby authorized shall be binding upon and inure to the benefit of the Applicant and Applicant's successors, grantees, transferees and assigns, and any violation of the conditions herein set forth by the Applicant or its successors, grantees, transferees or assigns shall authorize the revocation of the Special Use as hereby authorized. SECTION 6: That the amendment to the Deerfield Centre Planned Unit Development hereby approved and authorized shall be binding upon and inure to the benefit of the Applicant and the Deerfield Centre property owner and their respective successors, grantees, transferees and assigns, and any violation of the conditions hereinabove set forth by the Applicant or the Deerfield Centre property owner, or their respective successors, grantees, transferees or assigns, shall authorize the revocation of the amendment to the Deerfield Centre Planned Unit Development hereby authorized. SECTION 7: That the Village Clerk is hereby authorized and directed to publish this Ordinance in pamphlet form and to record this Ordinance in the office of the Recorder of Deeds of Lake County, Illinois at Applicant's expense. G SECTION 8: That this Ordinance, and each of its terms, shall be the effective legislative act of a home rule municipality without regard to whether such Ordinance should: (a) contain terms contrary to the provisions of current or subsequent non - preemptive state law; or, (b) legislate in a manner or regarding a matter not delegated to municipalities by state law. It is the intent of the corporate authorities of the Village of Deerfield that to the extent that the terms of this Ordinance should be inconsistent with any non - preemptive state law, this Ordinance shall supersede state law in that regard within its jurisdiction. SECTION 9: That this Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form as provided by law. PASSED this 2nd day of February '2004.
