VILLAGE OF DEERFIELD LAKE AND COOK COUNTIES, ILLINOIS ORDINANCE NO. 0-03-31 AN ORDINANCE AUTHORIZING A SPECIAL USE FOR A KIDSNIPS HAIR SALON IN DEERFIELD CENTRE WHEREAS, the Plan Commission of the Village of Deerfield held a public hearing on June 12, 2003 to consider the application of Northern Realty Group, the owner of Deerfield Centre (the "Applicant "), for approval of a Special Use for the establishment of a KidSnips children's hair cutting salon and toy store at 675 Deerfield Road in Deerfield Centre, which property is legally described on Exhibit A attached hereto, in the Deerfield Centre Planned Unit Development in the C -1 Village Center District; and, WHEREAS, said public hearing was held pursuant to public notice duly given and published as required by statute and conformed in all respects, in both manner and form, with the provisions of the Zoning Ordinance of the Village of Deerfield; and, WHEREAS, the Plan Commission of the Village of Deerfield, after considering the evidence and supporting materials offered at said hearing, filed its report with the President and Board of Trustees containing its written findings of fact and recommendation that the requested Special Use be authorized pursuant to Article 5.01 -C,1 of the Zoning Ordinance of the Village of Deerfield to allow a KidSnips hair salon and toy store to be located, established and operated as a Special Use of the Deerfield Centre Planned Unit Development in the C -1 Village Center District; and, WHEREAS, the President and Board of Trustees of the Village of Deerfield have determined that the best interests of the Village will be served by the authorization and granting of said Special Use as provided -herein in accordance with the plans and supporting materials submitted by the Applicant, which are incorporated herein and made a part hereof by this reference. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, in the exercise of its home rule powers, as follows: SECTION 1: That the President and Board of Trustees do hereby affirmatively find that the proposed KidSnips Hair Salon, hereby authorized as a special use of the Subject Property in the Deerfield Centre Planned Unit Development in the C -1 Village Center District, fully complies with the requirements and standards for special uses set forth in Article 5.01 -C,1, and Article 13.11 of the Zoning Ordinance of the Village of Deerfield. SECTION 2: That the President and Board of Trustees do hereby authorize and approve, subject to certain conditions as more particularly set forth below, the establishment and operation of a KidSnips Hair Salon on the Subject Property in the Deerfield Centre Planned Unit Development, as Special Use of the Subject Property in the C -1 Village Center District. SECTION 3: That the approval and authorization of said Special Use is hereby granted subject to: (i) the requirement that the construction, development, maintenance and use of the Subject Property for said Special Use shall be in accordance with floor plan, site plan, elevations, and supporting materials attached hereto and made a part of this Ordinance as Exhibit B hereof, and with all representations made and submitted by the Applicant to the Plan Commission and to 2 the President and Board of Trustees; (ii) compliance with all documents, materials and exhibits filed in support of the application; (iii) compliance with the requirements of the Appearance Review Commission; (iv) continued compliance with the requirements of the Final Development Plan for the Deerfield Centre Planned Unit Development and Ordinance No. 0- 99 -34, as amended, which remain in full force and effect except as specifically amended by this Ordinance; and, (v) compliance by the Applicant with the terms of this Ordinance and with all other applicable provisions of the Zoning Ordinance of the Village of Deerfield. SECTION 4: That the Special Use, as hereby authorized, shall be binding upon and inure to the benefit of the Applicant and to Applicant's successors, grantees, transferees and assigns, and any violation of the conditions herein set forth by the Applicant or its successors, grantees, transferees or assigns shall authorize the revocation of the special use as hereby authorized. SECTION 5: That the Village Clerk is hereby authorized and directed to publish this Ordinance in pamphlet form and to record this Ordinance in the office of the Recorder of Deeds of Lake County, Illinois at Applicant's expense. SECTION 6: That this Ordinance, and each of its terms, shall be the effective legislative act of a home rule municipality without regard to whether such Ordinance should: (a) contain terms contrary to the provisions of current or subsequent non - preemptive state law; or, (b) legislate in a manner or regarding a matter not delegated to municipalities by state law. It is the intent of the corporate authorities of the Village of Deerfield that to the extent that the terms of this Ordinance should be inconsistent with any non - preemptive state law, this Ordinance shall supersede state law in that regard within its jurisdiction. 3 SECTION 7: That this Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form as provided by law. Update #3 11/16/00 Chipotle Mexican Grill Current Operations (Field Observation) Today, the site is very close to being fully occupied, with the exception of the 1,200 sf space that is the current subject, and a 2,200sf space adjacent to it. As a result, we have changed our approach to reviewing parking demand, instead, starting with the actual parking demand experienced on -site today, and simply adding the future tenant's demand on top. Since the last update, there have been several changes in the area, as well as on -site. On- site changes include following: • The loss of Sopraffina and its replacement with the Red Star Tavern, • Full occupancy of the second floor office area, • Full occupancy of the residential component, • Relocation of the majority of employee parking to the lot north of Deerfield Road as well as to the lot east of the condo building, • Maturity of the travel, shopping and parking patterns on site as well as in the other recently redeveloped sections of the Deerfield CBD, • Removal of construction staff and their equipment, including trucks, dumpsters, materials, etc. (Some of this will return temporarily to build out the KidSnips space, as well as in the future for eventual remodeling), Update #4 - KidSnips Deerfield Village Center Page 1 of 4 5345738, �� . t although adequate for short term operations. We do anticipate that the vacant spaces are likely to be outside the most popular north lot. Conclusion Based upon the above, the provided parking is adequate for the proposed uses and, overall, the actual measured parking demand is very nearly exactly that predicted at the commencement of this process, several years ago. We do anticipate the need for regular modifications to assigned employee parking areas, and other on -site management tasks related to parking availability, however, that has been well done to date and we anticipate the current level of attention continuing. We achieve this goal primarily by hiring "kid- friendly" stylists and providing them with special child oriented training. All staff try to make children (and their parents) feel comfortable and welcome.
