VILLAGE OF DEERFIELD LAKE AND COOK COUNTIES, ILLINOIS ORDINANCE NO. 0-03-22 AN ORDINANCE AMENDING THE MUNICIPAL CODE OF THE VILLAGE OF DEERFIELD TO PROVIDE FOR CERTAIN SEWER AND WATER RATE INCREASES BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, in the exercise of its home rule powers, as follows: SECTION 1: That Section 23 -3 (Deposit) of Chapter 23 (Water) of the Municipal Code of the Village of Deerfield, as amended, be and the same is hereby further amended to read as follows: Sec. 23 -3. Deposit. A deposit in accordance with the following schedule shall be made with each such application, this sum to be retained by the Village to insure the payment of all bills. When service to the applicant is discontinued permanently, this deposit, less any amount still due to the Village for services relating to the use of Municipal water supply, shall be refunded without interest. Provided that where the applicant for water service is the owner of the premises to be served, no such deposit shall be required.. Water Rates. (a) The charge for water furnished to each lot, parcel of land, building or premises situated within the corporate limits of the village having any connection with the municipal water supply shall be the following rates for the volume of water furnished for the billing period, but in no event less than the minimum monthly charge set forth in paragraph (b) hereof Water Rate: $2.96 per 100 cubic feet. (b) The minimum monthly charge to be paid for any lot, parcel of land, building or premises within the Village having any connection to the municipal water supply shall be as follows: Meter size Minimum Monthly Charge 518 " $ 5.00 314" 5.00 Pt 6.50 1 Y2 15.00 2" 26.00 3 " 60.00 4" 105.00 6" 150.00 8" or more 200.00 (c) Where the building or premises served contains more than one family dwelling unit or business establishment, the minimum rate for the premises shall be the minimum above prescribed in paragraph (b) above for each family unit or business establishment, even though the premises are served by one meter. (d) The charges to premises outside the corporate limits served by the municipal water system shall be one and one -half (I Y2) times the charge for similar service to premises inside the corporate limits. (e) Where water is purchased for resale the rate shall be as determined by the Board of Trustees. SECTION 3: That Section 23 -21 (Delinquent Bills; Water Shutoff; Resumed Water Service Charges) of Chapter 23 (Water) of the Municipal Code of the Village of Deerfield, as amended, be and the same is hereby further amended to read as follows: Sec. 23 -21. Delinquent bills; water shut off,• resumed water service charges. (a) The water supply may be shut off from any premises for which the water bill remains unpaid thirty (30) days after the bill is presented or mailed. (b) Whenever water services have been discontinued from the municipal water supply system to any lot, building or premises, the following resumed water service charges shall be paid before service shall be resumed: (1) Twenty-Five Dollars ($25.00) for reconnection of water service performed between the hours of 7:00 a.m. and 3: 00 p.m. on business days. (2) Fifty Dollars ($50.00) for reconnection of water service performed outside normal working hours, or on weekends or holidays. SECTION 4: That Section 16 -18 (Rates) of Chapter 16 (Plumbing and Sewers) of the Municipal Code of the Village of Deerfield, as amended, be and the same is hereby further amended to read as follows: Sec. 16 -18. Rates: (a) There are hereby established the following rates and charges for the use and service of the sanitary sewerage system of the Village. Such rates shall.be based on the amount of water supplied by the municipal water supply system to the lot, parcel of land building or premises receiving service of the Village's sanitary sewerage system, unless the lot, parcel of land, building or premises is served by a separate meter approved by the Village for measuring water that will not be discharged into the sanitary sewerage system, in which case no separate sewer user charge shall be calculated or charged on the amount of water measured by such separate meter. (b) The charges for the use and service of the Village's sewerage system to any lot, parcel of land, building or premises situated within the corporate limits of the Village are hereby fixed and established as follows, but in no event less than the minimum monthly charge set forth in paragraph (d) hereof (1) User Charge ........................ $1.84 per 100 cubic feet of water (2) Maintenance Charge ............ $0.06 per 100 cubic feet of water (c) The charges for the use and service of the Village's sewerage system to any lot, parcel of land, building or premises situated outside the corporate limits of the Village are hereby fixed and established as follows, but in no event less than the minimum monthly charge set forth in paragraph (e) hereof (1) User Charge ........................ $1.84 per 100 cubic feet of water (2) Maintenance Charge ............ $0.06 per 100 cubic feet of water (3) Equalization Charge ............ $1.00 per 100 cubic feet of water to equalize plant capital expenses between users inside and outside of the corporate limits of the Village. (d) The minimum monthly sewer user charge to be paid for any lot, parcel of land, building or premises within the Village having any connection to the sanitary sewerage system shall be $2.00 per month. (e) The minimum monthly sewer user charge to be paid for any lot, parcel of land, building or premises outside the corporate limits of the Village having any connection to the sanitary sewerage system shall be $3.00 per month. SECTION 5: That Section 16 -19 (Bills, Charges) of Chapter 16 (Plumbing and Sewers) of the Municipal Code of the Village of Deerfield, as amended, be and the same is hereby further amended to read as follows: Sec. 16 -19. Bills; Sewer User Charges: (a) For any lot, parcel of land, building or premises used for residential purposes, other than for premises with four (4) or more dwelling units, which have been occupied during the preceding winter, the bill for each billing period shall be based on the water used during the billing period which included the preceding month of January. For any other lot, parcel of land building or residential premises of four (4) or more dwelling units, such rates and charges shall be based on the amount of water used during the current billing period as measured by the water meter in use. (b) Any lot, parcel of land, building or premises served either in or without the corporate limits of the Village may, at the owner's expense, be serviced by the installation of a separate meter for measuring water not to be discharged directly into the Village sanitary sewerage system, and no sewer charge or rental for the service herein provided for shall be made on the amount of water measured by such separate meter. Such installation shall be subject to the supervision and approval of the Director of Public Works. (c) In all cases in which users of the said sewer system are not supplied with metered water from the Municipal or other water works system, the charge for the use of the sewerage service shall be such as may be set by this Code or by ordinance from time to time, but not less than a minimum of ninety cents ($.90) per month, plus twenty five cents ($0.25) per month additional for each person over three (3) living or employed on the premises served by said sewerage system on the first day of each billing period for which such charge is made. The charge to premises outside the corporate limits shall be three and one -half (3 -112) times the charge for similar service within the corporate limits. (d) A ten percent (10%) additional delinquency shall be paid if the bill is not paid by the first day of the month following the month in which the bill is rendered. (e) Between the hours of seven o'clock (7:00) A.M. and twelve o'clock (12:00) noon daily, the Village shall make available a manhole at the Village treatment plant for use in disposing of domestic sanitary waste only. Payment for the use of said facility shall be in cash at the time of use and shall consist of a service fee of five dollars ($5.00) per use and a charge of two cents ($0.02) per gallon of sanitary waste disposed. The operation of this facility may be discontinued at any time at the discretion of the chief plant .operator of the Village treatment plant. . SECTION 6: That Section 16 -20 (Deposit, Schedule) of Chapter 16 (Plumbing and Sewers) of the Municipal Code of the Village of Deerfield, as amended, be and the same is hereby further amended to read as follows: Sec. 16 -20. Deposit, Schedule: A deposit in accordance with the following schedule shall be made with each application for sewer service, this sum to be retained by the Village to ensure the payment of all bills. When service to the applicant is discontinued permanently, this deposit, less any amount still due to the Village for services relating to the use of the Municipal sanitary sewer system shall be refunded without interest. Provided, that where an applicant for sanitary sewer service is the owner of the premises to be served, no such deposit shall be required. SECTION 8: That this Ordinance, and each of its terms, shall be the effective legislative act of a home rule municipality without regard to whether such Ordinance should: (a) contain terms contrary to the provisions of current or subsequent non - preemptive state law; or, (b) legislate in a manner or regarding a matter not delegated to municipalities by state law. It is the intent of the corporate authorities of the Village of Deerfield that to the extent that the terms of this Ordinance should be inconsistent with any non - preemptive state law, this Ordinance shall supersede state law in that regard within its jurisdiction. SECTION 9: That this Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form as provided by law. PASSED this 21st day of April , 2003.
