VILLAGE OF DEERFIELD LAKE AND COOK COUNTIES, ILLINOIS ORDINANCE NO. 0-03-12 AN ORDINANCE APPROVING A SPECIAL USE FOR AN AUTOMOBILE CONVENIENCE FOOD SHOP AT 1460 WAUKEGAN ROAD WHEREAS, the Plan Commission of the Village of Deerfield held a public hearing on the application of the owners of the property (the "Applicants ") at 1460 Waukegan Road, which property is legally described on Exhibit A attached hereto (the "Subject Property "), to permit an automobile convenience food shop as a Special Use of the Subject Property in the C -2 Outlying Commercial District; and, WHEREAS, said public hearing was held pursuant to public notice duly given in the time and manner provided by law; and, WHEREAS, the Plan Commission of the Village of Deerfield, after considering the evidence and supporting materials offered at said hearing, filed its report with the President and Board of Trustees containing its written findings of fact and recommendations that the requested Special Use be authorized pursuant to Article 5.02 -C,l,f and Article 13.11 of the Zoning Ordinance of the Village of Deerfield to allow an automobile convenience food shop to be located, established and operated on the Subject Property in conjunction with the existing Special Use automobile service station located on the Subject Property in the C -2 Outlying Commercial District; and, WHEREAS, the President and Board of Trustees of the Village of Deerfield have considered and reviewed the proposed plan and supporting materials submitted by the Applicant, and the findings of fact and recommendations of the Plan Commission of the Village of Deerfield; and, WHEREAS, the President and Board of Trustees have determined that the best interests of the Village will be served by the authorization and granting of said Special Use to permit an automobile convenience food shop to be established on the Subject Property in conjunction with the existing automobile service station to the extent provided herein. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, in the exercise of its home rule powers, as follows: SECTION 1: That the President and Board of Trustees do hereby affirmatively find that the Special Use as hereby authorized fully complies with the requirements and standards set forth in Articles 5.02 -C, If and 13.11 of the Zoning Ordinance of the Village of Deerfield. SECTION 2: That the President and Board of Trustees do hereby authorize and approve a Special Use for the Subject Property in the C -2 Outlying Commercial District to permit an automobile convenience food shop to be established in conjunction with the existing automobile service station located on the Subject Property, subject to the conditions, regulations and restrictions set forth in Section 3 of this Ordinance. SECTION 3: That the approval and authorization of said Special Use is hereby granted subject to the following conditions and restrictions: A. That the automobile convenience food shop to be established on the Subject Property in conjunction with the existing automobile service station shall be established, operated and used in accordance with the documents attached hereto and made a part hereof as Exhibit B, and with all representations submitted and made by the Applicant to the Plan Commission and to the President and Board of Trustees. B. That the existing driveway curb cuts on Waukegan Road shall be revised to provide for not more than four (4) driveway curb cuts on Waukegan Road, with one (1) physically restricted to right -out only turning movements, in accordance with the Site Plan listed on Exhibit B attached hereto. C. Applicant shall install and maintain light baffles or such other fixtures as may be necessary to prevent lighting from the automobile service station and the automobile convenience food shop from spilling over the property line of the Subject Property. D. The I VAC units serving the automobile convenience food shop shall be located on the ground at the southwest corner of the building and shall be enclosed with a six-foot high cedar board -on -board fence installed and maintained by Applicant. E. Subject to approval of a lease with Metra, the motor vehicle parking area for the Subject Property shall be configured, maintained and used in accordance with the Site Plan listed on Exhibit B attached hereto. In the event that the Metra leased premises are not available to the Applicant, now or at any time in the future, the motor vehicle parking area for the Subject Property shall be reconfigured by Applicant in accordance with applicable Village ordinances and requirements to remove the parking spaces and associated pavement depicted on the Site Plan as located on the Metra property. F. Applicant shall install a public sidewalk along Waukegan Road in accordance with the Site Plan listed on Exhibit B attached hereto, or in the location designated by the Village Engineer if the Site Plan fails to specify the location of the sidewalk. G. Applicant shall continue to comply with the applicable provisions of Ordinance 0- 78 -11, and with all applicable provisions of the Zoning Ordinance of the Village of Deerfield, except as hereby amended. SECTION 4: That the Special Use as hereby authorized shall be binding upon and inure to the benefit of the Applicant and Applicant's successors, grantees, transferees and assigns, and any violation of the conditions herein set forth by the Applicant or its successors, grantees, transferees or assigns shall authorize the revocation of the Special Use as hereby authorized. SECTION 5: That the Village Clerk is hereby authorized and directed to publish this Ordinance in pamphlet form and to record this Ordinance in the office of the Recorder of Deeds of Lake County, Illinois at Applicant's expense. SECTION 6: That this Ordinance, and each of its terms, shall be the effective legislative act of a home rule municipality without regard to whether such Ordinance should: (a) contain terms contrary to the provisions of current or subsequent non - preemptive state law; or, (b) legislate in a manner or regarding a matter not delegated to municipalities by state law. It is the intent of the corporate authorities of the Village of Deerfield that to the extent that the terms of this Ordinance should be inconsistent with any non - preemptive state law, this Ordinance shall supersede state law in that regard within its jurisdiction. SECTION 7: That this Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form as provided by law. PASSED this 7th day of April , 2003.
