VILLAGE OF DEERFIELD LAKE AND COOK COUNTIES, ILLINOIS ORDINANCE NO. 0-02-35 AN ORDINANCE AMENDING ARTICLE 9.02 -B OF THE ZONING ORDINANCE OF THE VILLAGE OF DEERFIELD TO PROVIDE FOR TENANT IDENTIFICATION DIRECTIONAL SIGNS IN CERTAIN PLANNED UNIT DEVELOPMENT SHOPPING CENTERS IN THE C -1 VILLAGE CENTER COMMERCIAL DISTRICT WHEREAS, the petitioner CRM Properties Group, the owner of the property commonly known as Deerfield Square ( "Deerfield Square" or the "Subject Property "), has petitioned for a text amendment to Article 9.02 -B of the Zoning Ordinance of the Village of Deerfield to permit tenant identification directional signs for shopping center /planned unit developments of more than 255,000 square feet of gross floor area in the C -1 Village Center Commercial District; and, WHEREAS, the Plan Commission of the Village of Deerfield held a public hearing on June 13, 2002 to consider said text amendment, said hearing being held pursuant to public notice duly given and published as required by statute and conforming in all respects, in both manner and form, with the provisions of the Zoning Ordinance of the Village of Deerfield; and, WHEREAS,, the Plan Commission of the Village of Deerfield, after considering the evidence presented at said hearing, has made written findings of fact and a recommendation that the Zoning Ordinance of the Village of Deerfield be amended to allow certain tenant identification signs to be approved as part of the signage plan for planned unit development shopping centers of more than 255,000 square feet of gross floor area in the C -1 Village Center Commercial District; and, WHEREAS, the President and Board of Trustees of the Village of Deerfield concur in the recommendation of the Plan Commission and have determined that it is in the best interests of the Village of Deerfield that the text of the Zoning Ordinance be amended as provided herein; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, in the exercise of its home rule powers, as follows: SECTION 1: That Section 9.02 -B of Article 9, Signs, of the Zoning Ordinance of the Village of Deerfield, as amended, be and the same is hereby further amended to add the following as paragraph 10 thereof: 10. C -1 Village Center District/Commercial Planned Unit Development of more than 255,000 square feet of Gross Floor Area. Notwithstanding anything to the contrary elsewhere in this Ordinance, tenant identification directional ground signs shall be allowed in planned unit development shopping centers of more than 255,000 square feet of gross floor area in the C -1 Village Center District subject to the following regulations only: a. Tenant Identification Directional Signs (1) Twe Tenant identification directional signs may be pole mounted ground signs. (2) Number and Content There shall not be more than three (3) tenant identification directional signs for each zoning- lot. Each sign shall indicate the name only of not more than four (4) business establishments. Said signs may include a directional arrow. (3) Area The maximum area of any tenant identification directional sign shall not exceed ten (10) square feet per face. He— The maximum height of such sign shall not exceed eleven feet (I F) in height. (5) Illumination Pole mounted tenant identification directional signs shall not be illuminated. SECTION 2: That this Ordinance, and each of its terms, shall be the effective legislative act of a home rule municipality without regard to whether such Ordinance should: (a) contain terms contrary to the provisions of current or subsequent non - preemptive state law; or, (b) legislate in a manner or regarding a matter not delegated to municipalities by state law. It is the intent of the corporate authorities of the Village of Deerfield that to the extent that the terms of this Ordinance should be inconsistent with any non - preemptive state law, this Ordinance shall supersede state law in that regard within its jurisdiction. SECTION 3: That this Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form as provided by law. PASSED this 3rd day of September , 2002.
