AN ORDINANCE APPROVING AN AMENDMENT TO
THE APPROVED SIGNAGE PLAN FOR DEERFIELD SQUARE
AS AN AMENDMENT TO A SPECIAL USE PLANNED UNIT DEVELOPMENT
WHEREAS, CRM Properties Group, Ltd. ( "Petitioner "), the owner of certain property
described on Exhibit A attached hereto, commonly known as Building 7 in Deerfield Square, has
petitioned the Plan Commission of the Village of Deerfield under and pursuant to the provisions
of Article 5.01 -C,2 and Article 13 -11 of the Zoning Ordinance of the Village of Deerfield, as
amended, for approval of an amendment to the Signage Plan for Building 7 as an amendment to
the Special Use Planned Unit Development of the Deerfield Square property in the C -1 Village
Center District to allow certain projecting signs for Sage Hen, Hi Ricky and Trax restaurants in
Building 7; and,
WHEREAS, the Plan Commission of the Village of Deerfield has held a public hearing to
consider said amendment to the approved Signage Plan for Building 7 in Deerfield Square to
allow projecting wall signs for Sage Hen, Hi Ricky and Trax restaurants, said hearing being held
pursuant to public notice and conforming in all respects, in both manner and form, with the
requirements of the statutes of the State of Illinois and the Zoning Ordinance of the Village of
Deerfield; and,
WHEREAS, the Plan Commission of the Village of Deerfield, after considering the
proposed amendment to the approved Signage Plan for Building 7, and the evidence and

supporting materials offered at said hearing, has submitted its written report and recommendation
to the President and Board of Trustees of the Village of Deerfield that said amendment to the
approved Signage Plan for Building 7 be approved, with modifications, as an amendment to the
Special Use Planned Unit Development for Deerfield Square in the C -1 Village Center District;
and,
WHEREAS, the President and Board of Trustees of the Village of Deerfield find that said
amendment to the approved Signage Plan for Building 7 in Deerfield Square should be approved
as an amendment to the Special Use Planned Unit Development of the Deerfield Square property
in the C -1 Village Center District, authorizing and permitting the projecting wall signs for Sage
Hen, Hi Ricky and Trax restaurants in Building 7 in Deerfield Square, all in accordance with the
plans and exhibits presented by the Petitioner and listed on Exhibit B attached hereto;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES,
ILLINOIS, in the exercise of its home rule powers, as follows:
SECTION 1: That the President and Board of Trustees of the Village of Deerfield do
hereby find that the amendment to the approved Signage Plan for Building 7 in Deerfield Square
fully complies with the requirements and standards set forth in Article 5.01 -C,2 and Article 13.11
of the Zoning Ordinance of the Village of Deerfield.
SECTION 2: That the President and Board of Trustees of the Village of Deerfield do
hereby authorize and approve the following amendment to the approved Signage Plan for
Deerfield Square as an amendment to the Special Use Planned Unit Development of the Subject
Property in the C -1 Village Center District, subject to the conditions, regulations and restrictions
set forth in Section 3 of this Ordinance:

A. In lieu of the otherwise permitted wall sign, one projecting sign shall be
allowed for each business in Building 7 in Deerfield Square facing Deerfield Road.
B. A projecting wall sign may not exceed six feet (6), six inches (6 ") in height
and is limited to nineteen and one -half (19.5) square feet in area.
C. A projecting wall sign shall not extend more than four feet (4) six inches
(6 ") from the face of the wall to which it is attached.
D. The bottom of a projecting wall sign shall have the following minimum
clearances above the sidewalk level over which it projects: (i) thirteen feet one inch
(13' 1 ") at the Sage Hen Cafe tenant space; (ii) nine feet one inch (9' 1 ") at the Hi
Ricky tenant space; and (iii) eight feet seven inches (8' 7 ") at the Trax tenant
space.
SECTION 3: That the approval and authorization of said amendment to the approved
Signage Plan for Building 7 in Deerfield Square is hereby granted subject to the following
conditions:
A. That all construction, maintenance and use of projecting wall signs for
Sage Hen Cafe, Hi Ricky and Trax Restaurants in Building 7 of the Deerfield
Square Development shall be in accordance with the documents, materials and
exhibits comprising the amendment to the Signage Plan for Deerfield Square
attached hereto and made a part hereof as Exhibit B.
B. Except as expressly provided herein, the construction, development and
use of Building 7 in Deerfield Square shall be in accordance with the Final
Development Plan heretofore approved as a Special Use Planned Unit
Development of the Subject Property in the C -1 Village Center District.
SECTION 4: That the amendment to the approved Signage Plan for Building 7 in
Deerfield Square hereby approved and authorized as an amendment Special Use Planned Unit
Development of the Subject Property shall be binding upon and inure to the benefit of Petitioner's
successors, grantees, transferees and assigns, and any violation of the conditions hereinabove set
forth by Petitioner or its successors, grantees, transferees or assigns shall authorize the revocation
of the amended special use hereby authorized.

SECTION 5: That the Village Clerk is hereby authorized and directed to record this
ordinance in the office of the Recorder of Deeds of Lake County, Illinois, at Petitioner's expense.
SECTION 6: That this Ordinance, and each of its terms, shall be the effective legislative
act of a home rule municipality without regard to whether such Ordinance should: (a) contain
terms contrary to the provisions of current or subsequent non - preemptive state law; or, (b)
legislate in a manner or regarding a matter not delegated to municipalities by state law. It is the
intent of the corporate authorities of the Village of Deerfield that to the extent that the terms of
this Ordinance should be inconsistent with any non - preemptive state law, this Ordinance shall
supersede state law in that regard within its jurisdiction.
SECTION 7: That this Ordinance shall be in full force and effect from and after its
passage, approval and publication as provided by law.

TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES,

SECTION 4: That the amendment to the approved Signage Plan for Building 7 in
Deerfield Square hereby approved and authorized as an amendment Special Use Planned Unit
Development of the Subject Property shall be binding upon and inure to the benefit of Petitioner's
