ORDINANCE NO. 0-02-09
AN ORDINANCE AMENDING THE ZONING ORDINANCE
OF THE VILLAGE OF DEERFIELD TO PROVIDE FOR
THE DEVELOPMENT OF BICYCLE FACILITIES
WHEREAS, the Plan Commission of the Village of Deerfield has recommended that a
new Section 2.09, `Bicycle Facilities," be added to the Zoning Ordinance of the Village of
Deerfield to require that developments in certain zoning districts provide, among other things, for
bicycle storage, circulation of bicycle traffic, and connections to adjacent developments and bike
paths; and,
WHEREAS, the Plan Commission of the Village of Deerfield has further recommended
that Article 14 of the Zoning Ordinance of the Village of Deerfield be amended to add a definition
of the term "Development "; and,
WHEREAS, the Plan Commission of the village of Deerfield held a public hearing
pursuant to public notice to consider said proposed amendments, said hearing and notice
conforming in all respects, in both manner and form, with the requirements of the statutes of the
State of Illinois and the provisions of the Zoning Ordinance of the Village of Deerfield, as
amended; and,
WHEREAS, the President and Board of Trustees of the Village of Deerfield concur in the
recommendation of the Plan Commission as provided herein.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES,
ILLINOIS, in the exercise of its home rule powers, as follows:
SECTION 1: That Article 2, General Provisions, of the Zoning Ordinance of the Village
of Deerfield, be and the same is hereby amended to add the following as Article 2.09 thereof
2.09 -B BICYCLE FACILITIES
Where appropriate, all multi - family developments in the R -5 General
Residence District, and all developments in the C -1 Village Center District,
the C -2 Outlying Commercial District, the C -3 Limited Commercial Office
District, the I -1 Office, Research, Restricted Industrial District, and the P -1
Public Lands District shall provide for the following:
1. Bicycle Storage
Facilities for the storage of bicycles as appropriate for the
development;
2. Internal Circulation
Safe and smooth circulation of bicycle traffic throughout the
development; and,
3. Access
Connections to adjacent developments and bike paths.
SECTION 2: That Article 14.02, Definitions, of the Zoning Ordinance of the Village of
Deerfield be and the same is hereby amended to add the following definition:
DEVELOPMENT: The construction, reconstruction, conversion, substantial
structural alteration, . or substantial enlargement of any
building(s) housing the primary use of the property.
SECTION 3: That this Ordinance, and each of its terms, shall be the effective legislative
act of a home rule municipality without regard to whether such Ordinance should: (a) contain
terms contrary to the provisions of current or subsequent non - preemptive state law; or, (b)
legislate in a manner or regarding a matter not delegated to municipalities by state law. It is the
intent of the corporate authorities of the Village of Deerfield that to the extent that the terms of
this Ordinance should be inconsistent with any non - preemptive state law, this Ordinance shall
supersede state law in that regard within its jurisdiction.
SECTION 4: That this Ordinance shall be in full force and effect from and after its
passage, approval and publication as provided by law.
