O-02-084975493 VILLAGE OF DEERFIELD LAKE AND COOK COUNTIES, ILLINOIS ORDINANCE NO. 0-02-08 AN ORDINANCE AMENDING THE PEDESTRIAN AND BICYCLE WAYS SECTION OF THE COMPREHENSIVE PLAN OF THE VILLAGE OF DEERFIELD WHEREAS, the Plan Commission of the Village of Deerfield has held a public hearing to consider certain amendments to the Pedestrian and Bicycle Ways section of the Comprehensive Plan of the Village of Deerfield; and, WHEREAS, said hearing was held pursuant to public notice, said hearing and notice conforming in all respects; in both manner and form, with the requirements of the statutes of the State of Illinois and the Zoning Ordinance of the Village of Deerfield, as amended; and, WHEREAS, the Plan Commission of the Village of Deerfield has recommended that the proposed amendments to the Comprehensive Plan of the Village of Deerfield be approved by the corporate authorities of the Village of Deerfield; and, WHEREAS, the President and Board of Trustees of the Village of Deerfield concur in the recommendation of the Plan Commission that the Pedestrian and Bicycle Ways section of the Comprehensive Plan of the Village of Deerfield should be amended as provided herein; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, in the exercise of its home rule powers, as follows: r 4915493 SECTION 1: That the first sentence of the first paragraph of the Pedestrian and Bicycle Ways section of the Comprehensive Plan, reading as follows, shall be deleted: It is estimated that the number of bicycles in Deerfield is far greater than the number of cars and almost as high as the number of residents. SECTION 2: That the following amendments are hereby made to the Objectives portion of the Pedestrian and Bicycle Ways section of the Comprehensive Plan of the Village of Deerfield: A. The last sentence of Objective No. 1 shall be revised to read as follows: The highest priority is the sidewalk/bike path along the south side of Deerfield Road from Waukegan Road to the east border of Deerfield. B. The last sentence of Objective No. 2, which reads as follows, shall be deleted: A safe connection from the terminus of the sidewalk on the west side of Waukegan Road to the northern municipal limits should be installed. C. Objective No. 3 shall be revised to read as follows: Assure that bushes and trees adjacent to sidewalks are kept trimmed so that they do not extend across the public right -of -way or hang so low over the right -of -way to be a potential hazard. D. Objective No. 4 shall be revised to read as follows: Work to install sidewalks on the north side of Lake Cook Road from Waukegan Road to Carlisle Avenue. E. .Objective No. 8 is revised by deleting "Milwaukee Road" and substituting "Metra" in lieu thereof. F. Objectives No.9 and No. 10 are deleted, and a new Objective No. 9 shall be added to the Comprehensive Plan to read as follows: 9. Work to connect Deerfield's dual function sidewalks to the pedestrian and bicycle ways of adjacent communities, and to provide dual function sidewalks, where appropriate, into all parks and school grounds. 4975493 G.. Objective No. 11 shall be renumbered as Objection No. 10. H. A new Objective No. 11 shall be added reading as follows: 11. Require all commercial, residential, and public developments to provide for: A. Bicycle storage facilities if appropriate; B. Ease of bicycle ingress and egress; C. Connections to adjacent bike paths and other developments, where appropriate; and, D. The safe and smooth circulation of bicycle traffic throughout the development itself and in the design of any significant transportation improvements. SECTION 3: That this Ordinance, and each of its terms, shall be the effective legislative act of a home rule municipality without regard to whether such Ordinance should: (a) contain terms contrary to the provisions of current or subsequent non - preemptive state law; or, (b) legislate in a manner, or regarding a matter not delegated to municipalities by state law. It is the intent of the corporate authorities of the Village of Deerfield that to the extent that the terms of this Ordinance should be inconsistent with any non - preemptive state law, this Ordinance shall supersede state law in that regard within its jurisdiction. SECTION 4: That the Village Clerk of the Village of Deerfield is authorized and directed to file notice of the adoption of this amendment to the Comprehensive Plan of the Village of Deerfield, with the Lake County Recorder of Deeds and the Cook County Recorder of Deeds. SECTION 5: That this Ordinance shall be in full force and effect from and after its passage and approval as provided by law.
