RESOLUTION NO. 0 -87 -09
A RESOLUTION ESTABLISHING A MUTUAL ASSISTANCE AGREEMENT
BETWEEN THE LAKE COUNTY SHERIFF'S POLICE EMERGENCY SERVICES
AND THE VILLAGE OF DEERFIELD, ILLINOIS
WHEREAS, the Lake County Emergency Services Department is in the process
of accrediting local community Emergency Services and Disaster programs as part
of the State mandated emergency planning concept;.and
WHEREAS, eligibility for County accreditation requires that all parti-
cipating local governments execute a Mutual Assistance Agreement; and
WHEREAS, a Mutual Assistance Agreement is to outline the formal
conditions whereby assistance may be requested and /or rendered by participating
governmental agencies during times of a major disaster; and
WHEREAS, the Illinois Emergency Services and Disaster Agency has approved
an acceptable form for said Mutual Assistance Agreement; and
WHEREAS, it is appropriate and necessary that the County of Lake through
its Department of Emergency Services, execute said Mutual Assistance Agreement:
NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Board'of".Trustees of
the Village of Deerfield that there is hereby executed a Mutual Assistance
Agreement with the County of Lake Department of Emergency Services for major
disasters, said agreement attached hereto and made a part hereof; and
BE IT FURTHER RESOLVED that the Village Clerk is hereby authorized to
distribute a certified copy of this Resolution to the Sheriff; the Coordinator
of the Department of Emergency Services; the County Administrator; and the
Illinois Emergency Services and Disaster Agency.

MUTUAL'ASSISTANCE AGREEMENT
(Approved by the: Illinois Emergency Services and-.Disaster Agency
on August 9, 1984)
SECTION ONE - PURPOSE
The purpose of this Agreement is to provide for a program of Mutual
Assistance between all of the Participating Agencies whereby the Aiding
Agencies can be requested to respond to a Stricken Agency with such
assistance as determined by the magnitude of the disaster.
SECTION TWO - DEFINITIONS
For the purpose of this Agreement, the following'terms--are defined:`
A. "Agency ": An Emergency Services and Disaster Agency of a
political subdivision such as a county, city, village or
incorporated town.
B. "Aiding Agency ": An Agency furnishing assistance, manpower,
equipment or resources to a Stricken Agency.
C. "Disaster ": An occurrence or threat of widespread or severe
damage, injury or loss of life or property resulting from any
natural or man -made cause, including but not limited to fire,
flood, earthquake, wind, storm, oil spill or other water
contamination requiring emergency action to avert danger or
damage, epidemic, air contamination, blight, extended periods
of severe and inclement weather, drought, infestation,
critical shortages of essential fuels and energy, explosion,
riot, or hostile military or paramilitary action. "Disaster"
includes but is not limited to all occurrences and threats
thereof which are contemplated by the concept of "emergency
services and disaster operations ". For purposes of this
Agreement, it is understood that to be classified as a
disaster, the occurrence must be too large to be handled by
the resources of the Stricken Agency.
D. "Emergency Services and Disaster Agency ": A Government Agency
acting during emergency conditions.
E. "Participating Agency ": An Agency that commits itself to this
Mutual Assistance Agreement by adopting an ordinance or
agreement authorizing participation-in the program with other
Participating Agencies for.rendering and receiving Mutual
Assistance in the event of disaster.
F. "Principal executive officer of a political subdivision ": The
chairman of the county board in the county, mayor of a city or
incorporated town in the city or incorporated town
respectively, president of a village in the village, or in
their absence or disability, the interim successor as
established pursuant to section 7 of the "Emergency Interim
Executive Succession Act" as now or hereafter amended.
G. "Stricken Agency ": The Agency requiring mutual assistance
because of a disaster. -
SECTION THREE - AGREEMENT TO EXECUTE THE
MUTUAL ASSISTANCE AGREEMENT
It is hereby agreed by all present and future Participating Agencies
that Mutual Assistance shall be rendered, subject to amendment by the
Agencies from time to time, as follows:
A. The Stricken Agency shall take the following actions:
1. Immediately determine what resources are required'to"meet
the needs of coping with the disaster. -
2. Whenever a disaster is of such magnitude and /or
consequence that assistance is necessary, the official in
charge of the emergency services operation of the
Stricken Agency or his designated agent shall have the
authority to request same from an Aiding Agency.
3. The Stricken Agency shall immediately establish an
identifiable command post and, if necessary, activate an
emergency operation center.
B. The Aiding Agency shall take the following actions:
1. Immediately determine if the required resources can be
committed in response to.the request from the Stricken
Agency.
2. Dispatch immediately the resources required to the
Stricken Agency in accordance with preplanned
arrangements to a definite location for assignment.
C. The rendering of assistance under the terms of this Agreement
shall not be mandatory if conditions prohibit response. In
that event it is the responsibility of the Aiding Agency to
immediately notify the Stricken Agency of said conditions.
D. All of the Participating Agencies agree to waive all claims
against the other Participating Agencies for compensation for
any loss, damage, personal injury or death occurring in
consequence of the performance of this Mutual Assistance
Agreement. General liability insurance, personal injury and
property damage.insurance against loss or damage of equipment
1s*the responsibility of each Participating Agency as it
applies to their resources. All services performed
under this Mutual Assistance Agreement shall be rendered
without reimbursement from any other Participating Agency.
Any Agency may withdraw from this Mutual Assistance Agreement
by notifying the other Participating Agencies in writing.

official shall assign personnel and equipment of the- Aiding
Agency when and where necessary.

exchanged this document. This Agreement shall be amended and expanded
from time to time by the addition of new Agencies who adopt an ordinance

participate therein as indicated by the signature -of --its principle
executive officer.
