O-00-39ORDINANCE NO. 0-00- 3 9 AN ORDINANCE AUTHORIZING AN AMENDED SPECIAL USE FOR THE DEERFIELD HIGH SCHOOL Published in pamphlet form this 6th day of November 2000 by the President and Board of Trustees of Deerfield JKS 286273 v October 10, 2000 ORDINANCE NO. 0 -00- 3 9 AN ORDINANCE AUTHORIZING AN AMENDED SPECIAL USE FOR THE DEERFIELD HIGH SCHOOL WHEREAS, the Plan Commission of the Village of Deerfield has heretofore held a public hearing on the application of the Board of Education of Township High School District 113 (herein the "Petitioner ") to authorize an amendment to the existing Special Use of Deerfield High School, Deerfield, Illinois to approve the renovation and expansion of the School by the construction of four additions as more particularly described in the materials furnished by Petitioner, all in accordance with Articles 7.02 and 13.11 of the Zoning Ordinance of the Village of Deerfield, as amended; and WHEREAS, said hearing was held pursuant to duly published notice thereof and was, in all respects, held according to law; and WHEREAS, the Plan Commission of the Village of Deerfield after considering and reviewing the evidence adduced, as contained in the filing package furnished by Petitioner and subsequently amended, including, but not limited to, the Site Plan dated September 19, 2000 prepared by Legat Architects Inc. and a Landscape Development Plan prepared by Metro Design Associates, Inc. and dated September 11, 2000 (collectively the "Site. Plan") attached hereto as Exhibit B, made written findings of fact, including express affirmative findings of compliance with the provisions of Articles 7.02 and 13.11 of the Village Zoning Ordinance and recommended that said Amendment to Special Use of said real estate be approved and authorized in. accordance with the Site Plan and related materials presented and the testimony adduced by the Petitioner at said hearing, subject to certain conditions and restrictions hereinafter set forth; and NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That the findings and recommendations of the Plan Commission are ONE: concurred in and adopted as the findings of the President and Board of Trustees and the Amendment to Special Use of the real estate legally described in Exhibit A attached hereto and made a part hereof, be and the same, is hereby authorized and approved. SECTION That the approval and authorization of said Amendment to Special Use to TWO: construct the four additions all in accordance with the Site Plan and related materials, and Articles 7.02 and 13.11 of the Zoning Ordinance of the Village of Deerfield, as amended, is hereby given subject to the requirements that (i) all use shall be in accordance with all exhibits, testimony, and representations submitted and made by the Petitioner to the Plan Commission and the President and Board of Trustees, (ii) that Petitioner revise the Site JKS 286273 v October 10, 2000 ORDINANCE NO. 0 -00 -39 AN ORDINANCE AUTHORIZING AN AMENDED SPECIAL USE FOR THE DEERFIELD HIGH SCHOOL Plan to eliminate the gravel road depicted thereon and add thereto a fence and gate at the bridge as requested by the President and Board of Trustees, and (iii) that Petitioner complies with all other applicable provisions of the Zoning Ordinance. SECTION That any violation of any of the conditions hereinabove set forth by the THREE: Petitioner or its successors, grantees, transferees or assigns, shall authorize the revocation of the Amendment to Special Use hereby authorized. SECTION That all approval and authorization of said Amendment to Special Use is FOUR: hereby given subject to the requirements that this Ordinance including Exhibit B shall be recorded in the Office of the Recorder of Deeds of Lake County, Illinois, and all fees for such recordation and expenses incurred therefor shall be paid by the Petitioner. SECTION That the Village Clerk is hereby directed to publish this Ordinance in FIVE: pamphlet form. SECTION That this Ordinance shall be in full force and effect from and after its passage, SIX: approval and publication, as provided by laws.
