O-00-36ORDINANCE NO. 0-00-3 6 AN ORDINANCE AMENDING A SPECIAL USE IN C -1 VILLAGE CENTER DISTRICT Published in pamphlet form this 6th day of November, 2000 by the President and Board of Trustees of Deerfield JKS 286265 v October 12, 2000 ORDINANCE NO. 0-00-3 6 AN ORDINANCE AMENDING A SPECIAL USE IN C -1 VILLAGE CENTER DISTRICT WHEREAS, Kirby Limited Partnership, an Illinois limited partnership, CRM Properties Group Ltd. and Deerfield Square Limited Partnership (collectively the "Applicant ") has filed an application to authorize the development of the property legally described in Exhibit A (the "Subject Property "), attached hereto and made a part hereof, for an Amendment to Special Use - Planned Development to be included as part of a shopping center for consideration by the Plan Commission of the Village of Deerfield; and WHEREAS, by virtue of Ordinance No. 0 -98 -34 adopted by the Corporate Authorities of the Village of Deerfield conceptual approval was granted for Deerfield Square and subsequently final approvals have been granted for portions thereof from time to time; and WHEREAS, the Applicant desires that the Subject Property be developed as part of Deerfield Square as Building 11; and WHEREAS, the Plan Commission of the Village of Deerfield has heretofore held a public meeting on the application of the Applicant to authorize the development and use of the Subject Property for an Amendment to Special Use - Planned Development, including a Special Use approval of Building 11 for office use, in accordance with Articles 5.01 -C,2; 5.01- C,2,j; and 13.11 of the Zoning Ordinance of the Village of Deerfield; and WHEREAS, the Plan Commission of the Village of Deerfield considered and reviewed the evidence adduced, including a Site Plan, Elevations and Plans for Building 11 prepared by Knauer Incorporated dated September 8, 2000 and August 30, 2000 and a Landscape Plan prepared by Geno Landscape Company dated September 11, 2000 each attached hereto and made a part hereof as Exhibit B; and . WHEREAS, and thereafter, the Plan Commission made written findings of fact and recommended that said Amended Special Use of said real estate for office use as depicted in the Final Development Plan for Building 11 all as identified above, be granted, subject to certain conditions and restrictions hereinafter set forth; and NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS AS FOLLOWS: SECTION That the President and Board of Trustees do hereby affirmatively find that the ONE: Amendment to Special Use consisting of the Final Development Plan for JKS 286265 v October 12, 2000 ORDINANCE NO. 0-00- 3 6 AN ORDINANCE AMENDING A SPECIAL USE IN C -1 VILLAGE CENTER DISTRICT Building 11, as depicted on Exhibit B, as hereby authorized, fully complies with the requirements and standards set forth in the applicable provisions of the Village Zoning Ordinance, and the Amendment to Special Use of the Subject Property, be and the same is hereby authorized and approved. The foregoing authorization and approval is subject to the following conditions: (i) that all use, construction and development shall be in accordance with all elements of Exhibit B as more particularly described above, attached hereto and made a part hereof, (ii) all other documentary and exhibit filings made pursuant to Planned Unit Development procedures as set forth in Article 12.09 of the Village Zoning Ordinance, (iii) the terms of this Ordinance, and (iv) all representations by the Applicant to the Plan Commission and President and Board of Trustees. SECTION That any violation of any of the conditions hereinabove set forth shall TWO: authorize the revocation of the Amendment to Special Use hereby authorized. SECTION That the Village Clerk is hereby directed to publish this Ordinance in THREE: pamphlet form and see to its recordation in the office of the Recorder of Deeds of Lake County, Illinois at Applicant's expense. SECTION. That this Ordinance shall be in full force and effect from and after its passage, FOUR: approval and publication as provided by law.
