O-00-34ORDINANCE NO. 0 -00- 3 4 AN ORDINANCE AUTHORIZING AN AMENDMENT TO SPECIAL USE INDUSTRIAL PLANNED UNIT DEVELOPMENT (PARKWAY NORTH - APPROVAL OF FINAL PLAN - BUILDING NINE Published in pamphlet form this 2nd day of October 2000 by the President and Board of Trustees of Deerfield JKS 283719 v September 12, 2000 ORDINANCE NO. 0-00- 3 4 AN ORDINANCE AUTHORIZING AN AMENDMENT TO SPECIAL USE INDUSTRIAL PLANNED UNIT DEVELOPMENT (PARKWAY NORTH - APPROVAL OF FINAL PLAN - BUILDING NINE WHEREAS, the Plan Commission of the Village of Deerfield has heretofore held a public hearing on the application of CarrAmerica Realty Corporation (hereinafter referred to as "Applicant "), to authorize approval of a Final Development Plan for certain real estate described on Exhibit A hereto (the "Property ") to be developed as a Special Use - Planned Unit Development in the I -1 Office, Research, Restricted Industrial District, under and pursuant to the provisions of Articles 6.01 -C,5, 12.01, 12.08, 12.09 and 13.11 of the Zoning Ordinance of the Village of Deerfield, as amended; and WHEREAS, said hearing was held pursuant to duly published notice thereof and was in all respects held according to law; and WHEREAS, following consideration of the recommendations of the Plan Commission, the President and Board of Trustees have considered and reviewed the Final Site Plan proposal for the Property prepared by SDI Consultants Ltd. dated July 26, 2000 and the Landscaping Plan prepared by The Lakota Group dated July 28, 2000 (collectively, the "Development Plan") attached hereto and made a part hereof as Exhibit B; and WHEREAS, the Applicant has presented testimony, both written and oral, to the Plan Commission, the President and the Board of Trustees as to Architectural Renderings, Landscaping Plans, Preliminary and Final Engineering, Traffic Plans and Studies, and Photometrics Site Lighting Plans each of which are deemed to be the representation of the Applicant to the Village of Deerfield as contained in Applicant's Petition; and WHEREAS, the President and Board of Trustees of the Village of Deerfield have determined that the best interests of the Village will be served by the authorization and granting of an Amendment to Special Use so as to authorize and to grant approval to the Development Plan in accordance with Exhibit B attached hereto and made a part hereof. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS AS FOLLOWS: SECTION That the President and Board of Trustees do hereby affirmatively find that the ONE: Amendment to Special Use as hereby authorized, fully complies with the requirements and standards set forth in Articles 12.08 and 13.11 -D of the Village Zoning Ordinance and the Final Development Plan for the Property, as depicted therein, as part of the Amendment to Special Use of the Property, as and for the purposes of an Industrial JKS 283719 v September 12, 2000 ORDINANCE NO. 0 -00 3 4 AN ORDINANCE AUTHORIZING AN AMENDMENT TO SPECIAL USE INDUSTRIAL PLANNED UNIT DEVELOPMENT (PARKWAY NORTH - APPROVAL OF FINAL PLAN - BUILDING NINE Planned Unit Development as set forth on Exhibit B be and the same is, hereby authorized and approved subject to the conditions hereinafter set forth. SECTION That the approval and authorization of said Amendment to Special Use hereby TWO: granted is subject to compliance of the Applicant with the Development Plan for the Property attached as Exhibit B, and compliance with all other applicable codes and ordinances of the Village of Deerfield in addition to compliance with the terms and provisions of the Fifth Amendment to Annexation Agreement between the Applicant and the Village of Deerfield. SECTION That any violation of any of the conditions hereinabove set forth by the THREE: Applicant or its successors, grantees, transferees or assigns shall authorize the revocation of the Amendment to Special Use hereby authorized. SECTION That the Village Clerk is hereby directed to publish this Ordinance in FOUR: pamphlet form and to record said Ordinance and Exhibit B known as the "Development Plan" in the office of the Recorder of Deeds of Lake County, Illinois at Applicant's expense.
