JKS 279001 v1 July 20, 2000 ORDINANCE NO. 0-00- 2 7 AN ORDINANCE AMENDING A SPECIAL USE IN C -1 VILLAGE CENTER DISTRICT WHEREAS, Deerfield Village Centre L.L.C., an Illinois limited liability company (the "Applicant ") has filed an application to authorize the development of the properties legally described in Exhibit A (the "Subject Property "), attached hereto and made a part hereof, for an Amendment to Special Use - Planned Development as a shopping center for consideration by the Plan Commission of the Village of Deerfield; and WHEREAS, by virtue of Ordinance No. 0 -99 -34 adopted by the Corporate Authorities of the Village of Deerfield conceptual approval was granted for the overall development of the Subject Property and requiring proposed Special Uses therein to be specifically approved; and WHEREAS, the-Plan Commission of the Village of Deerfield has heretofore held a public meeting on the application of the Applicant and to authorize the development and use of the Subject Property for an Amendment to Special Use - Planned Development to include and permit the construction of a Mail Boxes, Etc. as more particularly described below, in accordance with Article 5.01 -C,2, g,(5) of the Zoning Ordinance of the Village of Deerfield; and WHEREAS, the Plan Commission of the Village of Deerfield considered and reviewed the evidence adduced, including the Project Plans and Elevations prepared by Antunovich Associates and dated May 25, 2000 attached hereto and made a part as Exhibit B, and thereafter, the Plan Commission made written findings of fact and did not recommend the approval of the Mail Boxes, Etc. store for said Special Use of said real estate for a shopping center; and WHEREAS, the President and Board of Trustees of the Village of Deerfield have determined that the best interests of the Village will be served by the authorization and granting of said Amendment to Special Use as set forth on Exhibit B, for Mail Boxes, Etc. in accordance with the plans and exhibits presented by Applicant and included in Exhibit B attached hereto and made a part hereof. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS AS FOLLOWS: SECTION That the President and Board of Trustees do hereby affirmatively find that the ONE: Amendment to Special Use as set forth on Exhibit B, as hereby authorized, fully complies with the requirements and standards set forth in the applicable provisions of the Village Zoning Ordinance, and the Amendment to Special Use of the Subject Property, as and for a Mail Boxes, Etc., as specifically proposed, be and the same is hereby authorized and approved. (B) That except to the extent specifically modified hereby, the provisions of Ordinance No. 0 -99 -34 shall remain in full force and effect as they pertain to the Subject Property. SECTION That any violation of any of the conditions hereinabove set forth shall TWO: authorize the revocation of the Amendment to Special Use hereby authorized. SECTION That the Village Clerk is hereby directed to publish this Ordinance in THREE: pamphlet form and see to its recordation in the office of the Recorder of Deeds of Lake County, Illinois at Applicant's expense. SECTION That this Ordinance shall be in full force and effect from and after its passage, FOUR: approval and publication as provided by law.
