O-00-18ORDINANCE NO. 0 -00 -18 AN ORDINANCE GRANTING A VARIATION FROM THE PROVISIONS OF THE ZONING ORDINANCE WITH RESPECT TO THE PROPERTY COMMONLY KNOWN AS 1006 JOURNAL PLACE, DEERFIELD, ILLINOIS WHEREAS, Mr. and Mrs. Anton Katz have petitioned for a variation from the strict provisions of Article 10.01 -A,4 of the Zoning Ordinance of the Village of Deerfield, passed April 17, 1978, as amended, as applied to the property legally described below which would permit an encroachment into the sideyard to within 2 inches of the south property line to accommodate the reconstruction of a porch addition on the existing concrete foundation; and WHEREAS, pursuant to notice duly published, as required by statute, a public hearing on said petition was held and conducted by the Zoning Board of Appeals of the Village of Deerfield; and WHEREAS, the Zoning Board of Appeals has filed with the President and Board of Trustees its written findings of fact and recommendation. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS AS FOLLOWS: SECTION That the findings of fact and recommendations of the Zoning Board of ONE: Appeals are not concurred in and adopted as the findings of fact of the President and Board of Trustees. SECTION That the Board of Trustees finds that there are practical difficulties and TWO: particular hardships in the way of carrying out the strict letter of the provisions of the Zoning Ordinance of the Village of Deerfield as applied to Petitioners' property, which is legally described below and made a part hereof. LOTS 35 AND 35 IN BLOCK 4 IN DEERFIELD PARK LAND IMPROVEMENT ASSOCIATION SUBDIVISION, SITUATED IN THE VILLAGE OF DEERFIELD IN THE SOUTH EAST QUARTER OF SECTION 29, TOWNSHIP 43 NORTH, RANGE 2, EAST OF THE THIRD PRINCIPAL MERIDIAN, IN LAKE 4 COUNTY, ILLINOIS. JKS 272985 Q ORDINANCE NO. 0-00-18 AN ORDINANCE GRANTING A VARIATION FROM THE PROVISIONS OF THE ZONING ORDINANCE WITH RESPECT TO THE PROPERTY COMMONLY KNOWN AS 1006 JOURNAL PLACE, DEERFIELD, ILLINOIS SECTION That a variation from the strict provisions of Article 10.01 -A,4 of the Zoning THREE: Ordinance of the Village of Deerfield, passed April 17, 1978, as amended, with respect to the property hereinabove described, is hereby granted so as to permit a sideyard encroachment to within 2 inches of the south property line to accommodate the reconstruction of a porch on existing concrete foundation, with the stipulations that (i) the Petitioners only be permitted to replace the trellis columns, install a small roof and, at the Petitioner's election install a guardrail around the platform in order to use the structure as an unenclosed exterior porch and (ii) that the removal of the existing framing be completed within thirty (30) days after the adoption of this Ordinance. SECTION That the variation hereby granted is subject to compliance by the Petitioners FOUR: with all other applicable provisions of the Zoning Ordinance and with all other applicable ordinances of the Village of Deerfield. SECTION That this Ordinance shall be in full force and effect from and after its passage, FIVE: approval and publication as provided by law.
