O-00-16ORDINANCE NO. 0 -00 -16 AN ORDINANCE AUTHORIZING THE CONVEYANCE OF REAL ESTATE WHEREAS, the Village of Deerfield is authorized to acquire real estate, including the right to exercise eminent domain if necessary, for the purpose of acquiring real estate for downtown redevelopment purposes pursuant to the provisions of 5/11 -61 -1 and 5/11- 74.4-4 of Chapter 65 of the 1996 Illinois Compiled Statutes; and WHEREAS, the Village of Deerfield has acquired certain real estate and leasehold interests within the southwest quadrant of the Village Center Project Area for the purposes of downtown redevelopment; and WHEREAS, the Village of Deerfield published a notice and formall requested proposals requesting bids to develop a portion of the southwest quadrant of the Village of Deerfield known as the "South Commons "; and WHEREAS, the Village of Deerfield has selected a developer to develop the southwest quadrant of the Village, and entered into a redevelopment agreement with South Commons Venture, an Illinois general partnership, on January 4, 1999; and WHEREAS, under the terms of this redevelopment agreement, the Village of Deerfield is obligated to convey certain properties pursuant to that redevelopment agreement. WHEREAS, the Village has conveyed a portion of those properties to the developer pursuant to Ordinance No. 0- 99 -56, and is now obligated to convey the remaining properties pursuant to the redevelopment agreement and the amendments thereto. NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION The Village of Deerfield shall convey fee simple title to South ONE: Commons Venture, an Illinois general partnership, or its nominee, pursuant to the terms of a redevelopment agreement dated January 4, 1999, as amended, between the Village of Deerfield and South Commons Venture. SECTION Special Counsel for the Village of Deerfield, Joseph T. TWO: Morrison, is hereby authorized and directed to take all steps necessary to convey title to the properties described on Exhibit A to South Commons Venture, an Illinois general partnership, ORDINANCE NO. 0 -00 -16 or its nominee. Special Counsel Joseph T. Morrison is also authorized to execute such documents as may be required by Chicago Title Insurance Company to convey title in a form acceptable to South Commons Venture and Chicago Title Insurance Company.
