AN ORDINANCE AUTHORIZING AN AMENDMENT TO
SPECIAL USE - 660 LAKE -COOK ROAD - SHAW'S SEAFOOD GRILL
WHEREAS, the Plan Commission of the Village of Deerfield has heretofore held a public
hearing on the application of Lettuce Entertain You Enterprises, Inc. (the "Applicant ") for an
Amendment to a Special Use to permit an outdoor seating area as hereinafter more particularly
described at the existing restaurant at certain property legally described on Exhibit A attached hereto
(hereinafter the "Subject Property") located within the Village in the C -2 Outlying Commercial
District under and pursuant to the provisions of Articles 5.02 -Cl,d; 5.02 -G4,b and 13.11; and
WHEREAS, said hearing was held pursuant to duly published notice thereof and was in all
respects, held according to law; and
WHEREAS, following consideration of the recommendations of the Plan Commission, the
President and Board of Trustees have considered and reviewed the 'submitted the proposed plan
prepared by Aria Group Architects, Inc. and submitted by Applicant and attached hereto and made
a part hereof as Exhibit .B (the "Revised Seating Plan"); and
WHEREAS, the President and Board of Trustees of the Village of Deerfield have determined
that the best interests of the Village will be served by the authorization and granting of said
Amendment to Special Use for the Subject Property in accordance with the Revised Seating Plan
for the Subject Property.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS
AS FOLLOWS:
SECTION That the President and Board of Trustees do hereby affirmatively find that the
ONE: Amendment to Special Use as hereby authorized, fully complies with the
requirements and standards set forth in Articles 5.02 -Cl,d; 5.02 -G4,b and
13.11 of the Village Zoning Ordinance, and the Amendment to Special Use of the real estate, to
permit the establishment of a outdoor seating area, as set forth on Exhibit B subject to certain
conditions as more particularly set forth below, shall be and the same is hereby authorized and
approved subject to the conditions hereinafter set forth in Section Two.

SECTION That the approval and authorization of said Amendment to Special Use is
TWO: hereby granted subject to the requirements that all use, construction and
development shall be in accordance with, in addition to the submitted Revised
Seating Plan, all documentary and exhibit filings made pursuant to Planned Unit Development
procedures of the Village Zoning Ordinance, the terms of this Ordinance, all representations
submitted and made by the Applicant to the Plan Commission and President and Board of Trustees,
and is also subject to compliance by Applicant with all other applicable provisions of the Village
Zoning Ordinance.
SECTION That the Amendment to Special Use hereby authorized shall be binding upon
THREE: and inure to the benefit of Applicant's successors, grantees, transferees and
assigns, and any violation of the conditions, hereinabove set forth by the
Applicant or its successors, grantees, transferees or assigns shall authorize the revocation of the
Amendment to Special Use hereby authorized. .
SECTION That the Village Clerk is hereby directed to.publish this Ordinance in
FOUR: pamphlet form and to record said Ordinance and that portion of Exhibit B
known as the "Revised Seating Plan" in the office of the Recorder of Deeds
of Lake County, Illinois at Applicant's expense.
SECTION That. this Ordinance shall be in full force and effect from and after its passage,
FIVE: approval and publication as provided by law.
