O-99-40ORDINANCE NO. 0-99- 4 0 ORDINANCE APPROVING A SPECIAL USE IN 1 -1 OFFICE, RESEARCH, RESTRICTED INDUSTRIAL DISTRICT - HAZELDEN Published in pamphlet form this 5th day of October , 1999 by the President and Board of Trustees of Deerfield AS 245315 vl September 10, 1999 ORDINANCE NO. 0 -99= 4 0 ORDINANCE APPROVING A SPECIAL USE IN 1 -I OFFICE, RESEARCH, RESTRICTED INDUSTRIAL DISTRICT - HAZELDEN WHEREAS, the Plan Commission of the Village of Deerfield has heretofore held a public hearing on the application of Hazelden Foundation (the "Applicant ") to authorize the development and use of the property legally describe on Exhibit A attached hereto (the "Subject Property ") as a Special Use to permit the establishment of a clinical services office in accordance with Articles 6.01 - C,1(b) and 13.11 of the Zoning Ordinance of the Village of Deerfield; and WHEREAS, said hearing was held pursuant to duly published notice thereof and was in all respects held according to law; and WHEREAS, the Plan Commission of the Village of Deerfield after considering the evidence adduced by applicant made written findings of fact and recommended that said Special Use of said real estate for a clinical services office subject to certain conditions and restrictions hereinafter set forth be approved; and WHEREAS, the President and Board of Trustees of the Village of Deerfield have determined that the best interests of the Village of Deerfield will be served by the authorization and granting of said Special Use in accordance with the evidence and testimony presented by Applicant. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOKCOUNTIES, ILLINOIS, AS FOLLOWS: SECTION That the President and Board of Trustees do hereby affirmatively find that the ONE: Special Use, as hereby authorized, fully complies with the requirements and . standards set forth in the applicable provisions of the Village Zoning Ordinance, and the Special Use of the real estate, as and for the establishment of a clinical services office, be and the same is hereby authorized and approved subject to the conditions hereinafter set forth. SECTION That the approval and authorization of the Special Use hereby granted is TWO: subject to the following conditions: (i) that all use, construction and development of the Subject Property shall be in accordance with the evidence and testimony presented by the Applicant to the Plan Commission and President and Board of Trustees, all other documentary and exhibit filings made pursuant to the Special Use provisions of the Village Zoning Ordinance, and the terms of this Ordinance; and (ii) that the hours of operation, maximum patient attendance and staff utilization be as set forth in Exhibit B attached hereto and made a part hereof.
