JKS 219586 v3 March 8, 1999 ORDINANCE NO. 0-99-10 AN ORDINANCE AUTHORIZING A CLASS B SPECIAL USE - C -1 VILLAGE CENTER DISTRICT - WORLD WIDE LIQUORS WHEREAS, the Plan Commission of the Village of Deerfield has heretofore held a public hearing on the application of World Wide Liquors Inc. and Irl H. Marshall (collectively, the "Applicant "), to authorize the establishment of a Class B Special Use for certain real estate described on Exhibit A hereto as a liquor store under and pursuant to the provisions of Articles 5.01- 6,2a(6) and 13.11 of the Zoning Ordinance of the Village of Deerfield; and WHEREAS, said hearing was held pursuant to duly published notice thereof and was in all respects held according to law; and WHEREAS, following consideration of the recommendations of the Plan Commission by the President and Board of Trustees, the President and Board of Trustees have considered and reviewed the proposed Class B Special Use for a liquor store as submitted by Applicant; and WHEREAS, the President and Board of Trustees of the Village of Deerfield have determined that the best interests of the Village will be served by the authorization and granting of said Class B Special Use in accordance with all the testimony and evidence presented by the Applicant for the Subject Property. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS AS FOLLOWS: SECTION That the President and Board of Trustees do hereby affirmatively find the ONE: Class B Special Use, as hereby authorized, fully complies with the requirements and standards set forth in Articles 5.01- 6,2a(6) and 13.11 of the Village Zoning Ordinance and the Class B Special Use for the Subject Property, permitting the liquor store in the manner described by the Applicant, be and the same is, hereby authorized and approved subject to the conditions hereinafter set forth. SECTION That the approval and authorization of said Class B Special Use of the Subject TWO: Property as and for the use as more specifically described above and as hereby granted is subject to the conditions that said Class B Special Use conform to all applicable codes, ordinances and regulations of the Village of Deerfield and further that said liquor store: (i) will not open for business on Sundays provided however the store may be open between the hours of 11:30 a.m. to 7:00 p.m. on the Sunday of the following five national holiday weekends of Labor Day, Memorial Day, Christmas Day, New Years Day and Independence Day in the event that any of these national holidays occur on a Saturday, Sunday or Monday; (ii) will close JKS 219586 v3 March 8, 1999 ORDINANCE NO. 0-99- 10 AN ORDINANCE AUTHORIZING A CLASS B SPECIAL USE - C -1 VILLAGE CENTER DISTRICT - WORLD WIDE LIQUORS no later than 9:00 p.m. on Monday through Thursday and 10:00 p.m. on Friday and Saturday; (iii) will not place liquor advertising signs nor liquor cases on or against the Waukegan Road window of the store or the windows on the east side of the building; and (iv) will carefully monitor the premises to avoid accumulation'of litter and refuse. SECTION That any violation of the condition hereinabove set forth by the Applicant or THREE: its successors, grantees, transferees or assigns shall authorize the revocation of the Class B Special Use hereby authorized. SECTION That the Village Clerk is hereby directed to publish this Ordinance in FOUR: pamphlet form. SECTION That this Ordinance shall be in full force and effect from and after its passage, FIVE: approval and publication as provided by law.
