I December 28, 1998 ORDINANCE NO. 0-99- 0 3 AN ORDINANCE AUTHORIZING AN AMENDED SPECIAL USE FOR THE SOUTH PARK SCHOOL WHEREAS, the Plan Commission of the Village of Deerfield has heretofore held a public hearing on the application of the Board of Education of School District 109 (herein the "Petitioner ") to authorize an amendment to the existing Special Use of South Park School, Deerfield, Illinois to approve the (i) construction of a two -story addition, (ii) the vacation of an existing 30 foot building line on the west side of the subject property legally described on Exhibit A attached hereto and made a part hereof, and (iii) the vacation of 30 feet of unimproved Village Right of Way on Kenmore Avenue and also to approve a Plat of Consolidation, all as more particularly described in the materials furnished by Petitioner, all in accordance with Articles 7.02 and 13.11 of the Zoning Ordinance of the Village of Deerfield, as amended; and WHEREAS, said hearing was held pursuant to duly published notice thereof and was, in all respects, held according to law; and WHEREAS, the Plan Commission of the Village of Deerfield after considering and reviewing the evidence adduced, as contained in the filing package furnished by Petitioner, including, but not limited to, (i) the Site Plan dated November 12, 1998 and the Preliminary Engineering Concept Plan dated October 27, 1998 each prepared by STR Partners (collectively, the "Site Plan") attached hereto as Exhibit B, and (ii) the Consolidation Plat prepared by Glen D. Krisch Land Surveyor, Inc. attached hereto as Exhibit C (the "Plat of Consolidation "), made written findings of fact, including express affirmative findings of compliance with the provisions of Articles 7.02 and 13.11 of the Village Zoning Ordinance and recommended that said Amendment to Special Use of said real estate be approved and authorized in accordance with the Site Plan, the Plat of Consolidation and related materials presented and the testimony adduced by the Petitioner at said hearing, subject to certain conditions and restrictions hereinafter set forth. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That the findings and recommendations of the Plan Commission are ONE: concurred in and adopted as the findings of the President and Board of Trustees and the Amendment to Special Use of the real estate legally described in Exhibit A attached hereto and made a part hereof, be and the same, is hereby authorized and approved. SECTION That the approval and authorization of said Amendment to Special Use in TWO: accordance with the Site Plan and Plat of Consolidation and related materials, and Articles 7.02 and 13.11 of the Zoning Ordinance of the JKS 214662. 1 December 28, 1998 ORDINANCE NO. 0 -99- 0 3 AN ORDINANCE AUTHORIZING AN AMENDED SPECIAL USE FOR THE SOUTH PARK SCHOOL Village of Deerfield, as amended, is hereby given subject to the requirements that (i) all use shall be in accordance with all exhibits, testimony, and representations submitted and made by the Petitioner to the Plan Commission and the President and Board of Trustees, (ii) the Petitioner prepare and submit to the Village for its review a perpetual Grant of Easement for sanitary sewer purposes for that portion of the subject property so identified on Exhibit C, (iii) the Corporate Authorities of the Village of Deerfield adopt an ordinance vacating that portion of Kenmore Avenue as requested by Petitioner, and (iv) that Petitioner comply with all other applicable provisions of the Zoning Ordinance and any other applicable Village codes and ordinances. SECTION That any violation of any of the conditions hereinabove set forth by the THREE: Petitioner or its successors, grantees, transferees or assigns, shall authorize the revocation of the Amendment to Special Use hereby authorized. SECTION That all approval and authorization of said Amendment to Special Use is FOUR: hereby given subject to the requirements that this Ordinance including Exhibit B and Exhibit C shall be recorded in the Office of the Recorder of Deeds of Lake County, Illinois, and all fees for such recordation and expenses incurred therefor shall be paid by the Petitioner. SECTION That the Village Clerk is hereby directed to publish this Ordinance in FIVE: pamphlet form. SECTION That this Ordinance shall be in full force and effect from and after its SIX: passage, approval and publication, as provided by law.
