December, 1998 by the President and Board of Trustees of Deerfield. !KS 210811 . l November 24, 1998 429"722 0 ORDINANCE NO. 0 -98- 5 6 AN ORDINANCE AUTHORIZING AN AMENDMENT TO SPECIAL USE INDUSTRIAL PLANNED UNIT DEVELOPMENT (PARKWAY NORTH - APPROVAL OF PRELIMINARY PLAN AND FINAL PLAN AND RESUBDIVISION) WHEREAS, the Plan Commission of the Village of Deerfield has heretofore held a public hearing on the application of CarrAmerica Realty Corporation (hereinafter collectively referred to as "Applicant "), to authorize approval of a Preliminary Development Plan and a Final Development Plan for certain real estate described on Exhibit A hereto (the "Property ") to be developed as a Special Use - Planned Unit .Development in the I -1 Office, Research, Restricted Industrial District, under and pursuant to the provisions of Articles 6.01 -C,5, 12.01, 12.08, 12.09 and 13.11 of the Zoning Ordinance of the Village of Deerfield, as amended, in addition to a consideration of a Final Plat of Subdivision for the Property; and WHEREAS, said hearing was held pursuant to duly published notice thereof and was in all respects held according to law; and WHEREAS, following consideration of the recommendations of the Plan Commission, the President and Board of Trustees have considered and reviewed the Final Site Plan proposal for the Property prepared by SDI Consultants Ltd. dated October 1, 1998 and the Landscaping Plan prepared by The Lakota Group last revised as of November 2, 1998 (collectively, the "Development Plan") attached hereto and made a part hereof as Exhibit B, and the Final Plat of Resubdivision prepared by Compass Ltd. dated as of October 1, 1998 attached hereto and made a part hereof as Exhibit C; and WHEREAS, the Applicant has presented testimony, both written' and oral, to the Plan Commission, the President and the Board of Trustees as to Architectural Renderings, Landscaping Plans, Preliminary and Final Engineering, Traffic Plans and Studies, and Photometrics Site Lighting Plans each of which are deemed to be the, representation of the Applicant to the Village of Deerfield as contained in Applicant's Petition; and WHEREAS, the President and Board of Trustees of the Village of Deerfield have determined that the best interests of the Village will be served by the authorization and granting of an Amendment to Special Use so as to authorize and to grant approval to the Development Plan and the Resubdivision of the Property, as depicted therein, each in accordance with Exhibits B and C attached hereto and made a part hereof. That the President and Board of Trustees do hereby affirmatively find that ONE: the Amendment to Special Use as hereby authorized, fully complies with the requirements and standards set forth in Articles. 12.08 and 13.11 -D of the Village Zoning Ordinance and the Preliminary Development Plan and the Final Development Plan and Plat of Resubdivision for the Property, as depicted therein, as part of the Amendment to Special Use of the Property, as and for the purposes of an Industrial Planned Unit Development as set forth on Exhibits B and C be and the same are, hereby . authorized and approved subject to the conditions hereinafter set forth. SECTION That the approval and authorization of said Amendment to Special Use TWO: hereby granted is subject to compliance of the Applicant with the Development Plan for the Property attached as Exhibit B, and compliance with all other applicable codes and ordinances of the Village of Deerfield in addition to compliance with the terms and provisions of the Fifth Amendment to Annexation Agreement between the Applicant and the Village of Deerfield. SECTION That any violation of any of the conditions hereinabove set forth by the THREE: Applicant or its successors, grantees, transferees or assigns shall authorize the revocation of the Amendment to Special Use hereby authorized. JKS 210811 . 1 November 24, 1998 ORDINANCE NO. 0-98- 5 6 AN ORDINANCE AUTHORIZING AN AMENDMENT TO SPECIAL USE INDUSTRIAL PLANNED UNIT DEVELOPMENT (PARKWAY NORTH - APPROVAL OF PRELIMINARY PLAN AND FINAL PLAN AND RESUBDIVISION) WHEREAS, the Plan Commission of the Village of Deerfield has heretofore held a public hearing on the application of CarrAmerica Realty Corporation (hereinafter collectively referred to as "Applicant "), to authorize approval of a Preliminary Development Plan and a Final Development Plan for certain real estate described on Exhibit A hereto '(the "Property ") to be developed as a Special Use - Planned Unit Development in the I -1 Office, Research, Restricted Industrial District, under and pursuant to the provisions of Articles 6.01 -C,5, 12.01, 12.08, 12.09 and 13.11 of the Zoning Ordinance of the Village of Deerfield, as amended, in addition to a consideration of a Final Plat of Subdivision for the Property; and WHEREAS, said hearing was held pursuant to duly published notice thereof and was in all respects held according to law; and WHEREAS, following consideration of the recommendations of the Plan Commission, the President and Board of Trustees have considered and reviewed the Final Site Plan proposal for the Property prepared by SDI Consultants Ltd. dated October 1, 1998 and the Landscaping Plan prepared by The Lakota Group last revised as of November 2, 1998 (collectively, the "Development Plan") attached hereto and made a part hereof as Exhibit B, and the Final Plat of Resubdivision prepared by Compass Ltd. dated as of October 1, 1998 attached hereto and made a part hereof as Exhibit C; and WHEREAS, the Applicant has presented testimony, both written and oral, to the Plan Commission, the President and the Board of Trustees as to Architectural Renderings, Landscaping Plans, Preliminary and Final Engineering, Traffic Plans and Studies, and Photometrics Site Lighting Plans each of which are deemed to be the representation of the Applicant to the Village of Deerfield as contained in Applicant's Petition; and WHEREAS, the President and Board of Trustees of the Village of Deerfield have determined that the best interests of the Village will be served by the authorization and granting of an Amendment to Special Use so as to authorize and to grant approval to the Development Plan and the Resubdivision of the Property, as depicted therein, each in accordance with Exhibits B and C attached hereto and made a part hereof. JKS 210811 . 1 November 24, 1998 ORDINANCE NO. 0-98- 5 6 AN ORDINANCE AUTHORIZING AN AMENDMENT TO SPECIAL USE INDUSTRIAL PLANNED UNIT DEVELOPMENT (PARKWAY NORTH - APPROVAL OF PRELIMINARY PLAN AND FINAL PLAN AND RESUBDIVISION) NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND, COOK COUNTIES, ILLINOIS AS FOLLOWS: SECTION That the President and Board of Trustees do hereby affirmatively find that ONE: the Amendment to Special Use as hereby authorized, fully complies with the requirements and standards set forth in Articles 12.08 and 13.11 -D of the Village Zoning Ordinance and the Preliminary Development Plan and the Final Development Plan and Plat of Resubdivision for the Property, as depicted therein, as part of the Amendment to Special Use of the Property, as and for the purposes of an Industrial Planned Unit Development as set forth on Exhibits B and C be and the same are, hereby authorized and approved subject to the conditions hereinafter set forth. SECTION That the approval and authorization of said Amendment to Special Use TWO: hereby granted is subject to compliance of the Applicant with the Development Plan for the Property attached as Exhibit B, and compliance with all other applicable codes and ordinances of the Village of Deerfield in addition to compliance with the terms and provisions of the Fifth Amendment to Annexation Agreement between the Applicant and the Village of Deerfield. SECTION That any violation of any of the conditions hereinabove set forth by the THREE: Applicant or its successors, grantees, transferees or assigns shall authorize the revocation of the Amendment to Special Use hereby authorized. SECTION That the Village Clerk is hereby directed to publish this Ordinance in FOUR: pamphlet form and to record said Ordinance and Exhibits B and C known as the "Development Plan" and the "Plat of Resubdivision" in the office of the Recorder of Deeds of Lake County, Illinois at Applicant's expense.
