JKS 175757 . 1 February 19, 1998 ORDINANCE NO. 0 -98- 11 AN ORDINANCE AUTHORIZING AN AMENDMENT TO SPECIAL USE - ATM AT DRIVE -IN BANK FACILITY WHEREAS, the Plan Commission of the Village of Deerfield has heretofore held a public hearing on the application of Success National Bank (hereinafter referred to as "Applicant ") for approval of an amendment to Ordinance No. 93 -40 previously granting a Special Use for a Drive - In Bank Facility on the premises legally described on Exhibit A attached hereto and made a part hereof (the "Subject Property ") to permit a drive -up ATM and related site improvements under and pursuant to the provisions of Articles 5.01- C,2,b(2), 13.04 -B,2 and 13.11 of the Zoning Ordinance of the Village of Deerfield; and WHEREAS, said hearing was held pursuant to duly published notice thereof and was in all respects held according to law; and WHEREAS, the Plan Commission of the Village of Deerfield, after considering the evidenced adduced, made written findings of fact and recommended that the Amendment to Special Use as proposed be approved and authorized subject to certain conditions and restrictions hereinafter set forth; and WHEREAS, the President and Board of Trustees of the Village of Deerfield have determined that the best interests of the Village will be served by the approval of the Amendment to Special Use in accordance with the testimony and documentary evidence presented by Applicant to the Corporate Authorities. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS AS FOLLOWS: SECTION That the President and Board of Trustees do hereby affirmatively find that ONE: the Amendment to. Special Use as proposed by the Applicant fully complies with the requirements and standards set forth in Article 13.11 -D of the Zoning Ordinance of the Village of Deerfield, and the Amendment to Special Use of the Subject Property to permit a drive -up ATM and related site improvements, as proposed by the Applicant, be and the same is hereby authorized and approved subject to the conditions hereinafter set forth. SECTION That the approval and authorization of said Amendment to Special Use TWO: hereby granted is subject to the following conditions: (a) That all use, construction and development shall be in accordance with the Partial Proposed Site Plan and Floor Plan, each prepared by Wexler/Kollman P.C., Ltd. dated September 18, 1997 and September 9, 1997, respectively (collectively, JKS 175757 . 1 February 19, 1998 ORDINANCE NO. 0 -98 -11 AN ORDINANCE AUTHORIZING AN AMENDMENT TO SPECIAL USE - ATM AT DRIVE -IN BANK FACILITY the "Plan of Development ") and marked as Exhibit B, attached hereto and made a part hereof, all other documentary and exhibit filings made pursuant to the Special Use provisions of the Village Zoning Ordinance, the terms of this Ordinance, and all representations by the Applicant to the Plan Commission and President and Board of Trustees. (b) That Applicant comply with all other applicable Codes and Ordinances of the Village of Deerfield. SECTION That any violation of any of the conditions hereinabove set forth or THREE: cessation of use in accordance with the evidence adduced before the Plan Commission and the Corporate Authorities shall result in the revocation of the Amendment to Special Use hereby authorized. SECTION That the approval and authorization of said Amendment to Special Use FOUR: hereby given is subject to the requirement that this Ordinance shall be recorded in the Office of the Recorder of Deeds of Lake County, Illinois and all fees for such recordation and expenses incurred therefor shall be paid by the Applicant. SECTION That the Village Clerk is hereby directed to publish this Ordinance in FIVE: pamphlet form. SECTION That this Ordinance shall be in full force and effect from and after its SIX: passage, approval and publication as provided by law.
