O-97-47ORDINANCE NO. 0 -97= 4 7 AN ORDINANCE FOR THE AMENDMENT OF THE AGREEMENT ESTABLISHING THE SOLID WASTE AGENCY OF LAKE COUNTY, ILLINOIS WHEREAS, the Solid Waste Agency of Lake County, Illinois was formed on or about February 21, 1991 by Intergovernmental Agreement (hereinafter referred to as the "Agreement "; and WHEREAS, the Village of Deerfield became a member of the Solid Waste Agency of Lake County, Illinois on or about September 21, 1991; and WHEREAS, the Agreement provides for amendment of the Agreement only upon the written agreement of all of the Members of the Solid Waste Agency of Lake County, Illinois, said agreement to be authorized by a duly enacted ordinance; and WHEREAS, The Solid Waste Agency wishes to amend the Agreement to authorize the amendment of the By -Laws by a 2/3 affirmative vote of all the Members as opposed to the current 3/4 affirmative vote required by the Agreement. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION Section 10. By -Laws of the Agreement Establishing the Solid Waste ONE: Agency of Lake County, Illinois is hereby amended and shall read as follows: The Board of Directors shall adopt By -Laws for the Agency which shall, among other matters, set forth provisions for the holding, notice, call and conduct of meetings of the Board of Directors and Executive Committee, the adoption of annual budgets and appropriations, the entering into of contracts and purchases by the Agency, the adoption of regulations, approval of amendments or updates to the Plan, or such other measures as are necessary to the performance of its obligations pursuant to this Agreement. The By -Laws may be adopted or amended only upon the affirmative vote of not less than 2/3 of the then Directors. The By -Laws may provide additional requirements and procedures with respect to amendment of the By- Laws. SECTION That all ordinances or parts of ordinances in conflict herewith are TWO: expressly repealed.
