O-97-46ORDINANCE NO. 0 -97- 4 6 AN ORDINANCE GRANTING A VARIATION FROM THE PROVISIONS OF THE ZONING ORDINANCE WITH RESPECT TO THE PROPERTY COMMONLY KNOWN AS 1107 FOREST AVENUE, DEERFIELD, ILLINOIS WHEREAS, Mr. and Mrs. Stephen Jones have petitioned for a variation from the strict provisions of Article 4.03 -F,3,b of the Zoning Ordinance of the Village of Deerfield, passed April 17, 1978, as amended, as applied to the property legally described below which would permit a sideyard of 4.84 feet in lieu of the required 8 feet and a combined sideyard of 17.62 feet in lieu of the required 20 feet to accommodate an addition to the existing structure; and WHEREAS, pursuant to notice duly published, as required by statute, a public hearing on said petition was held and conducted by the Zoning Board of Appeals of the Village of Deerfield; and WHEREAS, the Zoning Board of Appeals has filed with the President and Board of Trustees its written findings of fact and recommendation. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS AS FOLLOWS: SECTION That the findings of fact and recommendations of the Zoning Board of ONE: Appeals are concurred in and adopted as the findings of fact of the President and Board of Trustees. SECTION That the Board of Trustees finds that there are practical difficulties and TWO: particular hardships in the way of carrying out the strict letter of the provisions of the Zoning Ordinance of the Village of Deerfield as applied to Petitioners' property, which is legally described below and made a part hereof. THE SOUTHERLY 50 FEET OF LOT 2 IN BLOCK 6 IN THE REPLATTING OF LOTS 67 TO 74, BOTH INCLUSIVE, IN BLOCK 6 AND OTHER LOTS IN DEERFIELD PARK LAND AND IMPROVEMENT ASSOCIATION SUBDIVISION, IN THE SOUTHEAST QUARTER OF SECTION 29, TOWNSHIP 43 NORTH, RANGE 12, EAST OF THE THIRD PRINCIPAL MERIDIAN, ACCORDING TO THE PLAT OF SAID REPLATTING RECORDED MARCH 24, 1911, AS DOCUMENT NO. 13561 IN BOOK "H" OF PLATS, PAGE 97, IN LAKE COUNTY, ILLINOIS. JKS 160058 .1 October 9, 1997 ORDINANCE NO. 0 -97- 4 6 AN ORDINANCE GRANTING A VARIATION FROM THE PROVISIONS OF THE ZONING ORDINANCE WITH RESPECT TO THE PROPERTY COMMONLY KNOWN AS 1107 FOREST AVENUE, DEERFIELD, ILLINOIS SECTION That a variation from the strict provisions of Article 4.03 -F,3,b of the THREE: Zoning Ordinance of the Village of Deerfield, passed April 17, 1978, as amended, with respect to the property hereinabove described, is hereby granted so as to permit a sideyard of 4.84 feet in lieu of the required 8 feet and a combined sideyard of 17.62 feet in lieu of the required 20 feet to accommodate an addition to the existing structure. SECTION That the variation hereby granted is subject to compliance by the FOUR: Petitioners with all other applicable provisions of the Zoning Ordinance and with all other applicable ordinances of the Village of Deerfield. SECTION That this Ordinance shall be in full force and effect from and after its FIVE: passage, approval and publication as provided by law.
