I August 22, 1997 ORDINANCE NO. 0-97- 3 9 AN ORDINANCE AUTHORIZING A SPECIAL USE (ST. LOUIS BREAD COMPANY I WHEREAS, the Plan Commission of the Village of Deerfield has heretofore held a public hearing on the application of Heritage Realty and St. Louis Bread Company (hereinafter collectively the "Applicant ") to authorize a Special Use for a restaurant and retail bakery, all in accordance with Articles 5.02 -C,l,d and 13.11 of the Zoning Ordinance of the Village of Deerfield; WHEREAS, said hearing was held pursuant to duly published notice thereof and was in all respects held according to law; and WHEREAS, the Plan Commission of the Village of Deerfield after considering and reviewing the evidence adduced and the site plan as to additional parking area prepared by MFH Associates dated July 23, 1997 submitted by Applicant (the "Parking Plan"), made written findings of fact and recommended that said Special Use of said real estate be approved and authorized subject to certain conditions and restrictions hereinafter set forth. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS AS FOLLOWS: SECTION That the findings and recommendations of the Plan Commission are ONE: concurred in and adopted as the findings of the President and Board of Trustees and the Special Use of the real estate legally described in Exhibit A attached hereto and made a part hereof to approve the operation of a restaurant and retail bakery in accordance with Applicant's proposal, and in accordance with a 25% reduction in required parking, be and the same is hereby authorized and approved. SECTION That the approval and authorization of said Special Use is hereby given TWO: subject to the requirements that (i) all use shall be in accordance with all exhibits, testimony, representations submitted and made by the Applicant to the Plan Commission and President and Board of Trustees, (ii) the Applicant continue to lease the 14 parking spaces on the adjoining property for the use of the restaurant and retail bakery in accordance with the Parking Plan, and (iii) is also subject to compliance by Applicant with all other applicable provisions of the Zoning Ordinance. SECTION That the Village Clerk is hereby directed to publish this Ordinance in FOUR: pamphlet form. SECTION That this Ordinance shall be in full force and effect from and after its FIVE: passage, approval and publication as provided by law.
