O-97-33ORDINANCE NO. 0 -97- 3 3 AN ORDINANCE AUTHORIZING AN AMENDMENT TO SPECIAL USE INDUSTRIAL PLANNED UNIT DEVELOPMENT (PARKWAY NORTH - APPROVAL OF AMENDMENT TO CONCEPT PLAN AND APPROVAL OF PRELIMINARY PLAN AND FINAL PLANSI Published in pamphlet form this 18 tWay of August , 1997 by the President and Board of Trustees of Deerfield. 1KS 152870 . l August 15, 1997 ORDINANCE NO. 0 -97- 3 3 AN ORDINANCE AUTHORIZING AN AMENDMENT TO SPECIAL USE INDUSTRIAL PLANNED UNIT DEVELOPMENT (PARKWAY NORTH - APPROVAL OF AMENDMENT TO CONCEPT PLAN AND APPROVAL OF PRELIMINARY PLAN AND FINAL PLANSI WHEREAS, the Plan Commission of the Village of Deerfield has heretofore held a public hearing on the application of Carr Parkway North 1 Corporation and CarrAmerica Realty Corporation (hereinafter collectively referred to as "Applicant "), to authorize an amendment to the previously approved Concept Plan and to authorize approval of a Preliminary Development Plan and certain Final Development Plans for a portion of certain real estate described on Exhibit A hereto (the "Property ") to be developed as a Special Use - Planned Unit Development in the I -1 Office, Research, Restricted Industrial District, under and pursuant to the provisions of Articles 6.01 -C,5, 12.01, 12.08, 12.09 and 13.11 of the Zoning Ordinance of the Village of Deerfield, as amended; and WHEREAS, said hearing was held pursuant to duly published notice thereof and was in all respects held according to law; and WHEREAS, following consideration of the recommendations of the Plan Commission, the President and Board of Trustees have considered and reviewed the Preliminary Site Plan proposal for the Property prepared by SDI Consultants Ltd. dated June 25, 1997 and the Landscaping Plan prepared by The Lakota Group dated June 25, 1997 and last revised as to Sheets L2, L3, L4 and L5 as of July 17, 1997 and as to Sheet L 1 as of July 24, 1997 (collectively, the "Preliminary Development Plan") attached hereto and made a part hereof as Exhibit B; and WHEREAS, following consideration of the recommendations of the Plan Commission, the President and the Board of Trustees have considered and reviewed the Final Site Plans proposed for portions of the Property as depicted thereon prepared by SDI Consultants Ltd. dated July 17, 1997 and July 21, 1997, for Building Six and the Thorngate Clubhouse, respectively, the Final Landscaping Plan for Building Six and the Thorngate Clubhouse prepared by The Lakota Group dated July 17, 1997 and last revised August 13, 1997, respectively, and last revised as to Sheets L8, L9 and L10 as of July 17, 1997 and as to Sheet L11 as of Ausgust 13, 1997, and the Final Plat of Resubdivision prepared by Compass Ltd. dated as of July 22, 1997 (collectively, the "Final Development Plan") attached hereto and made a part hereof as Exhibit C; and WHEREAS, the Applicant has presented testimony, both written and oral, to the Plan Commission, the President and the Board of Trustees as to Architectural Renderings, Additional Landscaping Plans, Preliminary and Final Engineering and Traffic Plans and Studies, each of JKS 152870 . 1 August 18, 1997 ORDINANCE NO. 0 -97- 3 3 AN ORDINANCE AUTHORIZING AN AMENDMENT TO SPECIAL USE INDUSTRIAL PLANNED UNIT DEVELOPMENT (PARKWAY NORTH - APPROVAL OF AMENDMENT TO .CONCEPT PLAN AND APPROVAL OF PRELIMINARY PLAN AND FINAL PLANSI WHEREAS, the President and Board of Trustees of the Village of Deerfield have determined that the best interests of the Village will be served by the authorization and granting of an Amendment to Special Use so as to authorize and permit the amendment to the Concept Plan for the undeveloped portions of the Property and to grant approval to the Preliminary Plan and Final Development Plans for a portion of the Property, as depicted therein, each in accordance with Exhibits B and C attached hereto and made a part hereof. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS SECTION That the President and Board of Trustees do hereby affirmatively find that ONE: the Amendment to Special Use as hereby authorized, fully complies with the requirements and standards set forth in Articles 12.08 and 13.11 -D of the Village Zoning Ordinance, and the Concept Plan for the undeveloped portions of the Property and the Preliminary Development Plan and the Final Development Plans and Plat of Resubdivision for a portion of the Property, as depicted therein, as part of the Amendment to Special Use of the Property, as and for the purposes of an Industrial Planned Unit Development as set forth on Exhibits B and C be and the same are, hereby authorized and approved subject to the conditions hereinafter set forth. SECTION That the approval and authorization of said Amendment to Special Use TWO: hereby granted is subject to compliance of the Applicant with both the Preliminary Development Plan and Final Development Plan for a portion of the Property attached as Exhibits B and C, respectively, and compliance with all other applicable codes and ordinances of the Village of Deerfield in addition to compliance with the terms and provisions of the Fifth Amendment to Annexation Agreement between the Applicant and the Village of Deerfield.
