JKS\71248.1 12/7/95 ORDINANCE NO. 0-97-12 AN ORDINANCE AMENDING THE ZONING MAP AND APPROVING A SPECIAL USE IN C -2 OUTLYING COMMERCIAL DISTRICT WHEREAS, the Plan Commission of the Village of Deerfield has heretofore held a public hearing on the application of the Red Roof Inn, Inc., ( "Applicant ") for the classification of certain real estate located within the Village in the C -2 Outlying Commercial District and as legally described on Exhibit A attached hereto (the "Subject Property "); and WHEREAS, the Plan Commission of the Village of Deerfield has also heretofore held a public hearing on the application of the Applicant to authorize the development and use of the Subject Property to be zoned in the C -2 Outlying Commercial District for a Special Use to permit the establishment of the Red Roof Inn Motel and a What's Cooking Restaurant in accordance with Articles 5.02 -C,1,d and 13.11 of the Zoning Ordinance of the Village of Deerfield; and WHEREAS, said hearing was held pursuant to duly published notice thereof and was, in all respects, held according to law; and WHEREAS, the Plan Commission of the Village of Deerfield after considering and reviewing the evidence adduced, including a Site Plan (the "Site Plan ") prepared by Quintas & Associates Inc. dated September 27, 1996, and attached hereto and made a part hereof as Exhibit B made written findings of fact and recommended that said Special Use of said real estate for the establishment of the Red Roof Inn Motel and a What's Cooking Restaurant subject to certain conditions and restrictions hereinafter set forth. WHEREAS, the President and Board of Trustees of the Village of Deerfield have determined that the best interests of the Village will be served by the classification of the Subject Property as recommended by the Plan Commission; and WHEREAS, the President and Board of Trustees of the Village of Deerfield have determined that the best interests of the Village will be served by the authorization and granting of said Special Use in accordance with the plans and exhibits presented by Applicant and marked Exhibit B and attached hereto and made a part hereof. JKS \71248.1 12/7/95 ORDINANCE NO. 0-97-12 AN ORDINANCE AMENDING THE ZONING MAP AND APPROVING A SPECIAL USE IN C -2 OUTLYING COMMERCIAL DISTRICT NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That the Zoning Map of the Village of Deerfield ONE: included and made a part of the Village Zoning Ordinance passed April 17, 1978, as amended, is hereby further amended by zoning and classifying the property described in Exhibit A, attached hereto and made a part hereof, to the C -2 Outlying Commercial District. SECTION That the President and Board of Trustees do hereby TWO: affirmatively find that the Special Use, as hereby authorized, fully complies with the requirements and standards set forth in the applicable provisions of the Village Zoning Ordinance, and the Special Use of the real estate, as and for the Red Roof Inn and the What's Cooking Restaurant set forth on Exhibit B, submitted by Applicant, be and the same is hereby authorized and approved subject to the conditions hereinafter set forth. SECTION That the approval and authorization of the Special THREE: Use hereby granted is subject to the following conditions: that all use, construction and development of the Subject Property shall be in accordance with the Site Plan submitted by Applicant, marked Exhibit B attached hereto and made a part hereof, all other documentary and exhibit filings made pursuant to the Special Use provisions of the Village Zoning Ordinance, the terms of this Ordinance and other governing codes and ordinances of the Village of Deerfield and all representations by the Applicant to the Plan Commission and President and Board of Trustees, including, but not limited to, provision of an appropriate amount of additional improved parking area on adjacent property. SECTION That any violation of any of the conditions FOUR: hereinabove set forth shall authorize the revocation of the Special Use hereby authorized. SECTION That the Village Clerk is hereby directed to FIVE: publish this Ordinance in pamphlet form and see to its recordation in the office of the Recorder of Deeds of Cook County, Illinois at Applicant's expense.
