O-96-26ORDINANCE NO. 0 -96 -26 AN ORDINANCE AUTHORIZING AN AMENDMENT TO SPECIAL USE - COMMERCIAL PLANNED UNIT DEVELOPMENT Published in pamphlet form this 21st day of June , 1996 by the President and Board of Trustees of Deerfield JKS \71248.1 6/18/96 ORDINANCE NO. 0 -96 -26 AN ORDINANCE AUTHORIZING AN AMENDMENT TO SPECIAL USE - COMMERCIAL PLANNED UNIT DEVELOPMENT WHEREAS, the Plan Commission of the Village of Deerfield has heretofore held a public hearing on the application of CORNERSTONE REAL ESTATE ADVISORS, INC. and MASSACHUSETTS MUTUAL LIFE INSURANCE COMPANY(herein collectively referred to as "Applicant ") to authorize the development and use of certain real estate described on Exhibit A hereto for an Amended Special Use - Commercial Planned Unit Development of the development previously approved by Ordinance 81 -28, as amended, to permit modification to the Site Plan to allow parking lot changes, additions to the building, contruction of a double truck loanding area modification of the Landscaping Plan and changes to the existing ground sign under and pursuant to the provisions of Articles 5.02 -C,9, 12.01, 12.05 and 13.11 of the Zoning Ordinance of the Village of Deerfield; and WHEREAS, said hearing was held pursuant to duly published notice thereof and was, in all respects, held according to law; and WHEREAS, following consideration of the recommendations of the Plan Commission, by the President and Board of Trustees, the President and Board of Trustees have considered and reviewed the Final Development Plan submitted by Applicant consisting of a Proposed Site Plan dated April 30, 1996, and a Proposed Facade and Canopy Design dated June 11, 1996, each prepared by Jensen & Fore Architects (collectively, the "Final Development Plan ") reflecting all revisions from the original approved Development Plan; and WHEREAS, the President and Board of Trustees of the Village of Deerfield have determined that the best interests of the Village will be served by the authorization and granting of said Amendment to Special Use - Commercial Planned Unit Development in accordance with a certain Final Development Plan marked Exhibit B and attached hereto and made a part hereof, and that certain exceptions and variations from the otherwise applicable regulations of this Ordinance as reflected on said Exhibit B are warranted. JKS \71248.1 6/18/96 ORDINANCE NO. 0 -96 -26 AN ORDINANCE AUTHORIZING AN AMENDMENT TO SPECIAL USE - COMMERCIAL PLANNED UNIT DEVELOPMENT NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That the President and Board of Trustees do hereby ONE: affirmatively find that the Amendment to Special Use, as hereby authorized, fully complies with the requirements and standards set forth in Articles 12.05 and 13.11- 4 of the Village Zoning Ordinance, and the Amendment to Special Use of the real estate, as and for purposes of a Commercial Planned Unit Development as set forth on Exhibit B, be and the same is hereby authorized and approved subject to the conditions hereinafter set forth. SECTION That the approval and authorization of said TWO: Amendment to Special Use hereby granted is subject to the following conditions: (A) That all use, construction and development shall be in accordance with the Final Development Plan, a copy of which is marked Exhibit B and attached hereto and made a part hereof, all other documentary and exhibit filings made pursuant to Planned Unit Development Procedures as set forth in Article 12.09 of the Village Zoning Ordinance, the terms of this Ordinance, and all representations by the Applicant to the Plan Commission and President and Board of Trustees. (B) That except to the extent specifically modified hereby, the provisions of Ordinance 81 -28, as amended, shall remain in full force and effect. SECTION That in connection with the approval of the THREE: above - described Amendment to Special Use the Applicant is granted a parking variation to maintain 340 parking spaces on the subject premises in lieu of the 423 parking spaces required. SECTION That the Village Clerk is hereby directed to FIVE: publish this Ordinance in pamphlet form and see to its recordation in the office of the Recorder of Deeds of Lake County, Illinois at Applicant's expense. SECTION That this Ordinance shall be in full force and SIX: effect from and after its passage, approval and publication, as provided by law.
