O-96-06ORDINANCE NO. 0 -96 -06 AN ORDINANCE AMENDING PORTIONS OF ARTICLES 6 AND 8 OF THE ZONING ORDINANCE OF THE VILLAGE OF DEERFIELD Published in pamphlet form this 20th day of February , 1996 by the President and Board of Trustees of Deerfield JKS \71248.1 1/26/96 ORDINANCE NO. 0 -96 -06 AN ORDINANCE AMENDING PORTIONS OF ARTICLES 6 AND 8 OF THE ZONING ORDINANCE OF THE VILLAGE OF DEERFIELD WHEREAS, the Plan Commission of the Village of Deerfield has heretofore. held a public hearing on the application of JFMC FACILITIES CORPORATION, an Illinois not - for - profit corporation (the "Applicant ") to consider certain text amendments to the Zoning Ordinance of the Village of Deerfield relative to permitting a residential assisted - living facility for the elderly in an I -1 Office, Research and Restricted Industrial Zoning District as a Special Use upon certain conditions and in certain circumstances; and WHEREAS, said hearing was held pursuant to duly published notice thereof and was in all respects held according to law; and WHEREAS, the Plan Commission of the Village of Deerfield after considering the evidence adduced, made written findings of fact and recommended a text amendment to the Zoning Ordinance of the Village of Deerfield to achieve the objectives sought by the Applicant; and WHEREAS, the President and Board of Trustees of the Village of Deerfield have determined that the recommendation of the Plan Commission will serve the best interests of the Village of Deerfield. NOW, THEREFORE, BE IT ORDAINED BY THE TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE ILLINOIS, AS FOLLOWS: SECTION That Article 6, Section 6.0 ONE: Ordinance of the Village of be and the same, is further thereto the following subsection 15. PRESIDENT AND BOARD OF AND COOK COUNTIES, L -C of the Zoning Deerfield, as amended, amended by adding 1115. Residential Assisted - Living Facilities for the Elderly Residential facilities for the elderly who are physically frail and /or cognitively impaired when such facilities are developed as part of an Industrial Planned Unit Development of 35 acres or JKS \71248.1 2/6/96 ORDINANCE NO. 0 -96 -06 AN ORDINANCE AMENDING PORTIONS OF ARTICLES 6 AND 8 OF THE ZONING ORDINANCE OF THE VILLAGE OF DEERFIELD more and such Planned Unit Development is located adjacent to the Interstate Highway 294 (also known as the Tri -State Tollway) and Interstate Highway 94 (also known as the Edens Spur). a. Accessory Uses: (1) Administrative and Support Offices; (2) Group Dining Areas; (3) Food Preparation Areas; (4) Central Laundry; (5) Activity Rooms; (6) Snack Shop for the residents, employees, and their guests; (7) Lounge Areas; (8) Beauty Shop for the convenience of the residents; (9) Exercise Room (10) Similar uses. b. Ancillary Uses not necessarily for the convenience of the residents but related to the overall operation of the facility: (1) Senior Day Care; (2) Home delivered meals; (3) Resource Center and Community Services Office; and (4) Similar uses." SECTION That Article 6.01 -F of the Zoning Ordinance of the TWO: Village of Deerfield, as amended, be and the same, is further amended by adding thereto the following subsection c. 116.01 -F,1 Minimum Lot Area C. For a Residential Assisted - Living Facility when such facilities are developed as part of an I -1, Planned Unit Development, a minimum lot area of 10 acres may be required as a condition for authorization." SECTION That Article 6.01 -F,5 of the Zoning Ordinance of THREE: the Village of Deerfield, as amended, be and the same, is further amended by renumbering Article 6.01 -F,5 to 6.01 -F,5a and by adding thereto the following subsection b. JKS \71248.1 1/29/96 ORDINANCE NO. 0 -96 -06 AN ORDINANCE AMENDING PORTIONS OF ARTICLES 6 AND 8 OF THE ZONING ORDINANCE OF THE VILLAGE OF DEERFIELD 116.01 -F,5 Maximum Building Height b. No building or structure for a Residential Assisted - Living Facility may be erected or structurally altered to exceed 75 feet in height when such a facility is part of an I- 1, Planned Unit Development having buildings of 75 feet in height." SECTION That Article 8- 02 -E,1 of the Zoning Ordinance of FOUR: the Village of Deerfield, as amended, be and the same, is further amended by adding thereto the following subsection c: "c. Residential Assisted - Living Facilities for the Elderly The Board of Trustees shall determine, following a public hearing by the Plan Commission and receipt and review of the recommendation of that body, the number of parking spaces required for such a facility based on the number of employees present at various times of the day, the number of resident vehicles anticipated, the number of visitors anticipated, and the number of spaces necessary to accommodate any ancillary uses conducted at the facility. Consideration may be given to situations where overflow parking is available on adjacent property by virtue of reciprocal parking agreements." SECTION That the Village Clerk is hereby directed to FIVE: publish this Ordinance in pamphlet form.
