O-96-05M ORDINANCE NO. 0 -96 -05 AN ORDINANCE AUTHORIZING A CLASS B SPECIAL USE - C -1 VILLAGE CENTER DISTRICT Published in pamphlet form this 5th day of February , 1996 by the President and Board of Trustees of Deerfield JKS \71248.1 1/4/96 ORDINANCE NO. 0 -96 -05 AN ORDINANCE AUTHORIZING A CLASS B SPECIAL USE - C -1 VILLAGE CENTER DISTRICT WHEREAS, the Plan Commission of the Village of Deerfield has heretofore held a public hearing on the application of James A. Healy and Simon Chen (collectively the "Applicant "), to authorize the development and use of certain real estate described on Exhibit A hereto for a Class B Special Use as a restaurant and under and pursuant to the provisions of Articles 5.01 -C, 2 and 13.11 -D of the Zoning Ordinance of the Village of Deerfield; and WHEREAS, said hearing was held pursuant to duly published notice thereof and was in all respects held according to law; and WHEREAS, following consideration of the recommendations of the Plan Commission by the President and Board of Trustees, the President and Board of Trustees have considered and reviewed the proposed Class B Special Use as a restaurant as submitted by Applicant; and WHEREAS, the President and Board of Trustees of the Village of Deerfield have determined that the best interests of the Village will be served by the authorization and granting of said Class B Special Use in accordance with all the testimony and evidence presented by the Applicant for the Subject Property. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That, the President and Board of Trustees do hereby ONE: affirmatively find the Special Use, as hereby authorized, fully complies with the requirements and standards set forth in Articles 5.01 -C, 2 and 13.11 -D of the Village Zoning Ordinance and the Class B Special Use of the Subject Property, as a restaurant, be and the same is, hereby authorized and approved subject to the conditions hereinafter set forth. SECTION That the approval and authorization of said TWO: Class B Special Use of the Subject Property as and for the use as more specifically described above and as hereby granted is subject to the condition that said Class B Special Use conform to all other applicable codes, ordinances and regulations of the Village of Deerfield, including, but not limited, to conformity with sign ordinance regulations. SECTION That all approval and authorization of said Class FOUR: B Special Use hereby given is subject to the requirement that this Ordinance shall be recorded in the Office of the Recorder of Deeds of Lake County, Illinois, and all fees for such recordation and expenses incurred therefor shall be paid by the Applicant. SECTION That the Village Clerk is hereby directed to FIVE: publish this Ordinance in pamphlet form. SECTION That this Ordinance shall be in full force and SIX: effect from and after its passage, approval and publication, as provided by law.
