JKS \33323.1 8/28/95 ORDINANCE NO. 0 -95 -35 AN ORDINANCE AUTHORIZING AN AMENDED SPECIAL USE FOR THE KIPLING ELEMENTARY SCHOOL WHEREAS, the Plan Commission of the Village of Deerfield has heretofore held a public hearing on the application of the Board of Education of School District 109 (herein the "Petitioner ") to authorize an amendment to the existing Special Use of Kipling Elementary School, Deerfield, Illinois to approve a further expansion of Kipling Elementary School by the construction of a building addition as more particularly described in the materials furnished by Petitioner, all in accordance with Articles 7.02 and 13.11 of the Zoning Ordinance of the Village of Deerfield, as amended; and WHEREAS, said hearing was held pursuant to duly published notice thereof and was, in all respects, held according to law; and WHEREAS, the Plan Commission of the Village of Deerfield after considering and reviewing the evidence adduced, as contained in the filing package furnished by Petitioner, including, but not limited to, the Site Plan dated August 2, 1995 and prepared by Legat Architects and Metro Design Associates, Inc. (the "Site Plan ") attached hereto as Exhibit B, made written findings of fact, including express affirmative findings of compliance with the provisions of Articles 7.02 and 13.11 of the Village Zoning Ordinance and recommended that said Amendment to Special use of said real estate be approved and authorized in accordance with the Site Plan and related materials presented and the testimony adduced by the Petitioner at said hearing, subject to certain conditions and restrictions hereinafter set forth. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That the findings and recommendations of the Plan ONE: Commission are concurred in and adopted as the findings of the President and Board of Trustees and the Amendment to Special Use of the real estate legally described in Exhibit A attached hereto and made a part hereof, be and the same, is hereby authorized and approved. SECTION That any violation of any of the conditions THREE: hereinabove set forth by the Petitioner or its successors, grantees, transferees or assigns, shall authorize the revocation of the Amendment to Special Use hereby authorized. SECTION That all approval and authorization of said FOUR: Amendment to Special Use is hereby given subject to the requirements that this Ordinance including Exhibit B shall be recorded in the Office of the Recorder of Deeds of Lake County, Illinois, and all fees for such recordation and expenses incurred therefor shall be paid by the Petitioner. The petitioners have submitted revised site plans for Kipling School. The first site plan (plan # C1.OE - as labeled in lower right hand corner) shows no change in the existing paved parking area or the existing parking layout. This plan provides 92 striped parking spaces on the property. When the area adjacent to the ball fields is counted as parallel parking, then twelve (12) more parking spaces can be provided, bringing the total number of on- site parking spaces to 104 for this site plan. The second site plan (plan # Cl. OD) shows a landbanked parking area (which is indicated by small squares on the site plan - see item # 2 in legend) and a new parking layout. In the event the Board decides to require the School District to install the landbanked parking, the new parking layout as shown on this site plan would be installed. This plan provides 105 striped parking spaces on the property. MEMORANDUM TO: Bob Franz FROM: Jeff Ryckaert, Planner DATE: September 11, 1995 RE: Kipling School Revised Site Plan til At their August 21, 1995 meeting, the Board of Trustees indicated that they wanted no additional parking lot paving to be installed at Kipling School, but required the petitioners to landbank parking for possible future use. The petitioners have submitted revised site plans for Kipling School. The first site plan (plan # C1.OE - as labeled in lower right hand corner) shows no change in the existing paved parking area or the existing parking layout.. This plan provides 92 striped parking spaces on the property. When the area adjacent to the ball fields is counted as parallel parking, then twelve (12) more parking spaces can be provided, bringing the total number of on- site parking spaces to 104 for this site plan. The second site plan (plan # C l. OD) shows a landbanked parking area (which is indicated by small squares on the site plan - see item # 2 in legend) and a new parking layout. In the event the Board decides to require the School District to install the landbanked parking, the new parking layout as shown on this site plan would be installed. This plan provides 105 striped parking spaces on the property.
