JKS \33323.1 8/22/95 ORDINANCE NO. 0 -95 -27 AN ORDINANCE AMENDING THE ZONING MAP AUTHORIZING AN AMENDMENT TO SPECIAL USE - INDUSTRIAL PLANNED UNIT DEVELOPMENT (CORPORATE 500 CENTRE) WHEREAS, the Plan Commission of the Village of Deerfield has heretofore held a public hearing on the application of the County of Cook, a body politic and corporate of the State of Illinois, American National Bank and Trust Company of Chicago, as Trustee under Trust No. 65110 and Matas Corporation (collectively the "Applicant ") for the classification of certain real estate located within the Village and hereinafter described on Exhibit A in the I -1 Office, Research and Restricted Industrial District and to authorize an amendment to the previously approved Special Use for certain real estate to permit changes to the Site Plan, Landscaping Plan and Signage Plan for the property described on Exhibit A hereto (the "Property ") under and pursuant to the provisions of Articles 6.01 -C, 12.01, 12.08, 13.10 and 13.11 of the Zoning Ordinance of the Village of Deerfield; and WHEREAS, said hearing was held pursuant to duly published notice thereof and was in all respects held according to law; and WHEREAS, Applicant presented a series of Exhibits for review and consideration by the Plan Commission, including a Group Exhibit entitled "Corporate 500 /New Entry" prepared by The Brickman Group, Ltd. which includes among other elements, (i) Site Plan; (ii) Landscape Plan; and (iii) Signage Location Plan (which Group Exhibit and all of its elements are hereinafter referred to as the "Amended Final Development Plan" which is attached hereto and made a part hereof as Exhibit B); and WHEREAS, the Plan Commission of the Village of Deerfield, after considering the evidence adduced including Exhibit B, the Amended Final Development Plan, made written findings of fact and recommended a map amendment to the Zoning Map of the Village of Deerfield, the issuance of an Amended Special Use Permit to approve the addition to the previously approved Industrial Planned Unit Development in accordance with the Amended Final Development Plan to achieve the objectives sought by the Applicant; and WHEREAS, the President and Board of Trustees of the Village of Deerfield have determined that the best interests of the Village will be served by the classification of said real estate in the manner aforesaid, the approval of the requested Amendment to Special Use for an Industrial Planned Unit Development as requested by Applicant and by the approval of portions of a Revised Signage Plan as hereinafter described on Exhibit C JKS \33323.1 8/22/95 ORDINANCE NO. 0 -95 -27 AN ORDINANCE AMENDING THE ZONING MAP AUTHORIZING AN AMENDMENT TO SPECIAL USE - INDUSTRIAL PLANNED UNIT DEVELOPMENT (CORPORATE 500 CENTRE) attached hereto in lieu of portions of the Signage Plan presented to the Plan Commission. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That the Zoning Map of the Village of Deerfield ONE: included and made a part of the Village Zoning Ordinance passed April 17, 1978, as amended, is hereby further amended by zoning and classifying the property described in Exhibit "A ", attached hereto and made a party hereof, to the I -1 Office Research and Restricted Industrial. SECTION That the President and Board of Trustees do TWO: hereby affirmatively find that the Amended Special Use, as hereby authorized, fully complies with the requirements and standards set forth in Articles 12.8 and 13.11 -D of the Village Zoning Ordinance, and the addition of the Property to the previously approved Special Use as an Amended Special Use of the Property, as and for purposes of an Industrial Planned Unit Development as set forth on Exhibit B be the same is, hereby authorized and approved subject to the conditions hereinafter set forth. SECTION That the zoning map amendment approval hereby THREE: granted, the authorization and approval of the Amended Special Use for an Industrial Planned Development is conditioned upon and subject to: (a) compliance by Applicant, its successors and assigns with all elements of the Amended Final Development Plan described in the foregoing recitals and as attached hereto as Exhibit B; (b) relocation of the existing Corporate 500 Centre sign either as depicted in the Signage Plan or to the front median of the new driveway, including the Marriott Residence Inn sign all as depicted on Exhibit C attached hereto; (c) approval of only the signage depicted as "directional signs" on the Signage Plan; (d) the landscaping as depicted in the Landscaping Plan will not be permitted to obscure the existing wall signage on the south wall of the adjoining Kleinschmidt Building, the tree canopies will not be permitted to overhang the Kleinschmidt property, and Applicant covenants to maintain the landscaping on an ongoing basis to continue to meet these standards; and (e) compliance by JKS \33323.1 8/22/95 ORDINANCE NO. 0 -95 -27 AN ORDINANCE AMENDING THE ZONING MAP AUTHORIZING AN AMENDMENT TO SPECIAL USE - INDUSTRIAL PLANNED UNIT DEVELOPMENT (CORPORATE 500 CENTRE) Applicant, its successors and assigns with all other applicable codes and ordinances of the Village of Deerfield. SECTION That failure of the Applicant, its successors and FOUR: assigns to comply with the conditions set forth herein shall.result in the revocation of the permit for Amended Special Use for the Industrial Planned Unit Development. SECTION That all approval and authorization of said FIVE: Amended Special Use hereby given is subject to the requirement that this Ordinance shall be recorded in the Office of the Recorder of Deeds of Lake County, Illinois, and all fees for such recordation and expenses incurred therefor shall be paid by the Applicant. SECTION That the Village Clerk is hereby directed to SIX publish the Ordinance in pamphlet form. SECTION That this Ordinance shall be in full force and SEVEN: effect from and after its passage, approval and publication, as provided by law.
