O-95-16ORDINANCE NO. 0 -95 -16 AN ORDINANCE AUTHORIZING THE ACQUISITION OF PROPERTY THROUGH CONDEMNATION OR OTHERWISE Published in pamphlet form this 18th day of April , 1995, by the President and Board of Trustees of Deerfield ORDINANCE NO. 0 -95 -16 AN ORDINANCE AUTHORIZING THE ACQUISITION OF PROPERTY THROUGH CONDEMNATION OR OTHERWISE WHEREAS, the President and Board of Trustees of the Village of Deerfield have determined that the acquisition of certain property hereinafter described for the purpose of redevelopment is necessary, useful, advantageous and desirable for the Village of Deerfield and the acquisition of said property constitutes a public purpose; and WHEREAS, the Village of Deerfield is authorized to exercise the power of eminent domain for the purpose of acquiring property for redevelopment pursuant to the provisions of 5/11 -61 -1 and 5/11- 74.4 -4 of Chapter 65 of the 1992 Illinois Compiled Statutes; and NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That it is hereby determined that the following described ONE: property, to -wit: The East 40 feet of Lot 3 and all of Lot 4 in William W. Clark's Subdivision, of part of the Northwest 1/4 of Section 33, Township 43 North, Range 12 East of the 3rd Principal Meridian, in the Village of Deerfield, Lake County, Illinois be acquired for the purpose of redevelopment is necessary and convenient for public use and is authorized by the statute in such cases made and provided. SECTION That it is hereby determined that it is necessary, useful, TWO: advantageous and desirable that the Village shall acquire title to and possession of the real estate hereinabove described which real property is necessary, required and needed for redevelopment for the public welfare, which property lies wholly within the limits of the Village of Deerfield. SECTION That Special Legal Counsel, JACK M. SIEGEL, is authorized, THREE: empowered and directed to negotiate with the owner or owners of the .hereinabove described real estate for the purpose of acquiring the same by said Village. SECTION That in the event that the Village is unable to agree with the FOUR: owners of said property as to the compensation to be paid therefor, then title and possession of said real property legally described hereinabove shall be acquired by the Village of Deerfield through condemnation and JACK M. SIEGEL, as special attorney for the Village, is hereby authorized, empowered and directed to institute proceedings in any court of competent jurisdiction to acquire title to and possession of said property for said Village in accordance with the eminent domain laws of the State of Illinois. I further certify that on April 17, 1995, the corporate authorities of the said Village passed and approved Ordinance No. 0- 95 -16, entitled: AN ORDINANCE AUTHORIZING THE ACQUISITION OF PROPERTY THROUGH CONDEMNATION OR OTHERWISE which provided by its terms that it should be published in pamphlet form. The pamphlet form of Ordinance No. 0- 95 -16, including the Ordinance and cover sheet thereof, was prepared and a copy of such ordinance was posted at the Deerfield Village Hall, commencing on April 18, 1995, and continuing for at least ten days thereafter. Copies of such ordinance were also available for public inspection upon request in the Office of the Village Clerk.
