ORDINANCE NO. 0-95-05 AN ORDINANCE AUTHORIZING THE ACQUISITION OF, PROPERTY THROUGH CONDEMNATION OR OTHERWISE . WHEREAS, the President and Board of Trustees of the Village of Deerfield have determined that the acquisition of certain property hereinafter described for the purpose of redevelopment is necessary, useful, advantageous and desirable for the Village of Deerfield and the acquisition of said property constitutes a public purpose; and WHEREAS, the Village of Deerfield is authorized to exercise the power of eminent domain for the purpose of acquiring property for redevelopment pursuant to the provisions of 5/11 -61 -1 and 5/11- 74.4 -4 of Chapter 65 of the 1992 Illinois Compiled Statutes; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That it is hereby determined that the following", described ONE: property, to -wit: Lots 11 and 12 and the W 10 feet of Lot 10 in Woodman's Re -Sub of Lots 1, 2 and 3 in Block 4 and Lots 2 to 7 inclusive in Block 5 and vacated street between said Blocks 4 and 5, all in Hall and Osterman's Add. to Deerfield in Sec. 33 T.43N., R12 E. of the 3rd PM, and That part of Lot 19 in Owners First Add. to Deerfield in Sec. 33 T.43N., R12 E of the 3rd PM described as follows: beginning at a point in the South line of Lot 10 in Woodman's Resub., said point being 10 feet East of the Southwest corner of said lot, thence South parallel to the West line of Lot 10 extended 10.3 feet thence S.23 E 356.95 feet to a point which is 305 feet Easterly of the Center line of the Right of Way of the C.M. & St.P. Ry. Co. measured at right angles thereto, thence Southerly parallel to the Easterly Right of Way line of said Railway 300 feet thence Westerly at right angles to last mentioned line 255 feet to East Right of Way line of said Railway, thence Northerly 300 feet along the East line of the Right of Way of said Railway, thence Easterly at right angles to said East Right of Way line 125 feet thence Northerly on a curve concentric to the center line of said Right of Way and 175 feet Easterly therefrom 429.5 feet to the Northwest corner of said Lot 19, thence Easterly 147.9 feet to the place of beginning all in Lake County, Illinois. be acquired for the purpose of redevelopment. That the acquisition of said property for the purpose of redevelopment is necessary and convenient for public use and is authorized by the statute in such cases made and provided. ORDINANCE NO. 0-95-05 AN ORDINANCE AUTHORIZING THE ACQUISITION OF PROPERTY THROUGH CONDEMNATION OR OTHERWISE SECTION That it is hereby determined that it is necessary, useful, TWO: advantageous and desirable that the Village shall acquire title to and possession of the real estate hereinabove described which real property is necessary, required and needed for redevelopment for the public welfare, which property lies wholly within the limits of the Village of Deerfield. SECTION That Special Legal Counsel, JACK M. SIEGEL, is authorized, THREE: empowered and directed to negotiate with the owner or owners of the hereinabove described real estate for the purpose of acquiring the same by said Village. SECTION That in the event that the Village is unable to agree with the FOUR: owners of said property as to the compensation to be paid therefor, then title and possession of said real property legally described hereinabove shall be acquired by the Village of Deerfield through condemnation and JACK M. SIEGEL, as special attorney for the Village, is hereby authorized, empowered and directed to institute proceedings in any court of competent jurisdiction to acquire title to and possession of said property for said Village in accordance with the eminent domain laws of the State of Illinois. SECTION That this ordinance shall be in full force and effect from and FIVE: after its passage, approval and publication in pamphlet form in the manner provided by law.
