O-94-44Y , ORDINANCE NO. 0 -94 -44 AN ORDINANCE AMENDING THE ZONING MAP AND APPROVING A SPECIAL USE IN P -1 PUBLIC LANDS DISTRICT -FIRE STATION Published in pamphlet form this 5th day of December , 1994, by the President and Board of Trustees of Deerfield. ORDINANCE NO. 0 -94 -44 AN ORDINANCE AMENDING THE ZONING MAP AND APPROVING A SPECIAL USE IN P -1 PUBLIC LANDS DISTRICT -FIRE STATION WHEREAS, the Plan Commission of the Village of Deerfield has heretofore held a public hearing on the application of the Deerfield- Bannockburn Fire Protection District ( "Applicant ") for the classification of certain real estate located within the Village in the P -1 Public Lands District and as legally described on Exhibit A attached hereto (the "Subject Property "); and WHEREAS, the Plan Commission of the Village of Deerfield has also heretofore held a public hearing on the application of the Applicant to authorize the development and use of the Subject Property and to be zoned in the P -1 Public_Lands District for a Special Use to permit construction of a fire station in accordance with the applicable provisions of the Zoning Ordinance of the Village of Deerfield; and WHEREAS, said hearing was held pursuant to duly published notice thereof and was, in all respects, held according to law; and WHEREAS, the Plan Commission of the Village of Deerfield, after considering the evidence adduced, made written findings of fact recommending that the Zoning Map be amended to include the Subject Property in the P -1 Public Lands District; and WHEREAS, the President and Board of Trustees of the Village of Deerfield have determined that the best interests of the Village will be served by the classification of the Subject Property as recommended by the Plan Commission; and WHEREAS, the President and Board of Trustees of the Village of Deerfield have determined that the best interests of the Village will be "served by the authorization and granting of said Special Use in accordance with the plans and exhibits prepared by Rust Environment and Infrastructure, dated October 5, 1994 and consisting of a Concept Site Development Plan, a Concept Landscape Plan, First Floor Plan, Basement Plan and Building Elevations (collectively the "Development Plan ") and presented by Applicant and which Development Plan is marked Exhibit B and attached hereto and made a part hereof. NOW, THEREFORE, BE TRUSTEES OF THE VILLAGE ILLINOIS, AS FOLLOWS: SECTION That the ONE: included Ordinance IT ORDAINED BY THE PRESIDENT AND BOARD OF OF DEERFIELD, LAKE AND COOK COUNTIES, Zoning Map of the Village of Deerfield and made a part of the Village Zoning passed April 17, 1978, as amended, is ORDINANCE NO. 0 -94 -44 AN ORDINANCE AMENDING THE ZONING MAP AND APPROVING A SPECIAL USE IN P -1 PUBLIC LANDS DISTRICT -FIRE STATION hereby further amended by zoning and classifying the property described in Exhibit A, attached hereto and made a part hereof, to the P -1 Public Lands District. SECTION That the President and Board of Trustees do hereby TWO: affirmatively find that the Special Use, as hereby authorized, fully complies with the requirements and standards set forth in the applicable provisions of the Village Zoning Ordinance, and the Special Use of the real estate, as and for construction of a fire station as set forth on Exhibit B, prepared by Applicant, be and the same is hereby authorized and approved subject to the conditions hereinafter set forth. SECTION That the approval and authorization of the Special THREE: Use hereby granted is subject to the following conditions: that all use, construction and development of the Subject Property shall be in accordance with the Development Plan as described above and submitted by Applicant, marked Exhibit B attached hereto and made a part hereof, all other documentary and exhibit filings made pursuant to the Special Use provisions of the Village Zoning Ordinance, the terms of this Ordinance, and all representations by the Applicant to the Plan Commission and President and Board of Trustees. SECTION That any violation of any of the conditions FOUR: hereinabove set forth shall authorize the revocation of the Special Use hereby authorized. SECTION That the Village Clerk is hereby directed to FIVE: publish this Ordinance in pamphlet form and see to its recordation in the office of the Recorder of Deeds of Lake County, Illinois at Applicant's expense. SECTION That this Ordinance shall be in full force and SIX: effect from and after its passage, approval and publication, as provided by law.
