AN ORDINANCE GRANTING A VARIATION FROM THE PROVISIONS
OF THE ZONING ORDINANCE WITH RESPECT TO THE PROPERTY
COMMONLY KNOWN AS 1304 CARLISLE PLACE, DEERFIELD, ILLINOIS
WHEREAS, CHRIS and SHIRLEY SERBIN have petitioned for a
variation from the strict provisions of Articles 10.01 -D,5,a and
2.02 -E,3,a of the Zoning Ordinance of the Village of Deerfield,
passed April 17, 1978, as amended, as applied to the property
legally described below-to permit the construction of an addition
increasing an existing non - conformity by allowing an additional
16 feet of proposed wall structure to be extended along the south
line of the existing garage, parallel to and within 5.46 feet of
the south property line and also to permit an additional 4 inches
of eave and gutter encroachment beyond the 18 inches permitted;
and
WHEREAS, pursuant to notice duly published, as required by
statute, a public hearing on said petition was held and conducted
by the Zoning Board of Appeals of the Village of Deerfield; and
WHEREAS, the Zoning Board of Appeals has filed with the
President and Board of Trustees its written findings of fact and
recommendation.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES,
ILLINOIS, AS FOLLOWS:
SECTION That the findings of fact and recommendation
ONE: of the Zoning Board of Appeals are concurred in
and adopted as the findings of fact of the
President and Board of Trustees.
SECTION That the Board of Trustees finds that there
TWO: are practical difficulties and particular
hardships in the way of carrying out the strict
letter of the provisions of the Zoning Ordinance of the Village
of Deerfield as applied to Petitioners, property, which is
legally described on Exhibit A, attached hereto and made a part
hereof.
SECTION That a variation from the strict provisions of
THREE: Articles 10.01 -D,5,a and 2.02 -E,3,a of the Zoning
Ordinance of Village of Deerfield, passed April
17, 1978, as amended, with respect to the property hereinabove
described, is hereby granted so as to permit the construction of
an addition increasing an existing non - conformity by allowing an

FOUR: compliance by the Petitioner with all other
applicable provisions of the Zoning Ordinance and
with all other applicable ordinances of the Village of Deerfield
and with the condition that if the addition permitted hereby is
subsequently removed the variation granted to permit said
addition shall lapse and be of no further effect.
SECTION That this Ordinance shall be in full force and

provided by law.
