JKS \5691.1 5/5/94 ORDINANCE NO. 0 -94 -17 AN ORDINANCE AUTHORIZING AN AMENDED SPECIAL USE FOR THE KIPLING ELEMENTARY SCHOOL WHEREAS, the Plan Commission of the Village of Deerfield has heretofore held a public hearing on the application of the Board of Education of School District 109 (herein the "Petitioner ") to authorize an amendment to the existing Special Use of Kipling Elementary School, Deerfield, Illinois to approve the expansion of Kipling Elementary School by the construction of a� building addition as more particularly described in the materials furnished by Petitioner, all in accordance with Articles 7.02 and 13.11 of the Zoning Ordinance of the Village of Deerfield, as amended; and WHEREAS, said hearing was held pursuant to duly published notice thereof and was, in all respects, held according to law; and WHEREAS, the Plan Commission of the Village of Deerfield after considering and reviewing the evidence adduced, as contained in the filing package furnished by Petitioner; including, but not limited to, the Overall Site Plan dated February 3, 1994 and prepared by Legat Architects and Metro Design Associates, Inc. (the "Site flan ") attached hereto as Exhibit B, made written findings of fact, including express affirmative findings of compliance with the provisions of Articles 7.02 and 13.11 of the Village Zoning Ordinance and recommended that said Amendment to Special use of said real estate be.approved and authorized in accordance with the Site Plan and related materials presented and the testimony adduced by the Petitioner at said hearing, subject to certain conditions and restrictions hereinafter set forth. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That the findings and recommendations of the Plan ONE: Commission are concurred in and adopted as the findings of the President and Board of Trustees and the Amendment to Special Use of the real estate legally described in Exhibit A attached hereto and made a part hereof, be and the same, is hereby.authorized and approved. JKS \5691.1 5/5/94 ORDINANCE NO. 0 -94 -17 AN ORDINANCE AUTHORIZING AN AMENDED SPECIAL USE FOR THE KIPLING ELEMENTARY SCHOOL SECTION That the approval and authorization of said TWO: Amendment to 'Special Use to expand Kipling Elementary School by construction of an addition, all in accordance with the Site Plan and related materials, and Articles 7.02 and 13.11 of the Zoning Ordinance of the Village of Deerfield, as amended, is hereby given subject to the requirements that (i) all use shall be in accordance with all exhibits, testimony, and representations submitted and made by the Petitioner to the Plan Commission and the President and Board of Trustees, (ii) Petitioner complies with all other applicable provisions'of the Zoning Ordinance and (iii) that Petitioner's storm water detention plans and utilities relocation plan are approved by the Village Engineer. SECTION That any violation of any of the conditions THREE: hereinabove set forth by the Petitioner or its successors, grantees, transferees or assigns, shall authorize the revocation of the Amendment to Special Use hereby authorized. SECTION That all approval and authorization of said - FOUR: Amendment to Special Use is hereby given subject to the requirements that this Ordinance including Exhibit B shall be recorded in the Office of the Recorder of Deeds of Lake County, Illinois, and all fees for such recordation and expenses incurred therefor shall be paid by the Petitioner. SECTION That the Village Clerk is hereby directed to FIVE: publish this Ordinance in pamphlet form. SECTION That this Ordinance shall be in full force and SIX: effect from and after its passage, approval and publication, as provided by law.
