JKS94ORDS.VODA2040794 /30 ORDINANCE NO. 0 -94 -14 AN ORDINANCE GRANTING MODIFICATION FROM THE SIGN PROVISIONS OF THE ZONING ORDINANCE WITH RESPECT TO THE PROPERTY COMMONLY KNOWN AS THE BRISTOL ESTATES OF DEERFIELD, DEERFIELD, ILLINOIS WHEREAS, the Kogen Development Corp. ( "Petitioner ") has petitioned for a modification from the strict provisions of Article 13.08 of the Zoning Ordinance of the Village of Deerfield, passed April 7, 1978, as amended, to permit the establishment of three non - illuminated double -faced 4 feet by 6 feet, 24 square feet per face, development /construction temporary signs in lieu of the permitted 10 square feet; and WHEREAS, pursuant to notice duly published, as required by statute, a public hearing on said petition was held and conducted by the Zoning Board of Appeals of the Village of Deerfield; and WHEREAS, the Zoning Board of Appeals has filed with the President and Board of Trustees its written findings of fact and recommendation in favor of Petitioner's request. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That the findings of fact and recommendation of ONE: the Zoning Board of Appeals recommending approval of the petition are adopted by the President and Board of Trustees. SECTION That the President and Board of Trustees find TWO: that unnecessary or undesirable circumstances would result from carrying out the strict letter of the provisions of the Zoning Ordinance of the Village of Deerfield as applied to Petitioner's property, which is legally described on Exhibit A attached hereto and made a part hereof. SECTION That a modification from the strict provisions THREE: of Article 9'03-C of the Zoning Ordinance of the Village of Deerfield, passed April 17, 1978, as amended, with respect to the property hereinabove described is hereby granted so as to permit the display of the following signs: ORDINANCE NO. 0 -94 -14 AN ORDINANCE GRANTING MODIFICATION FROM THE SIGN PROVISIONS OF THE ZONING ORDINANCE WITH RESPECT TO THE PROPERTY COMMONLY KNOWN AS THE BRISTOL ESTATES OF DEERFIELD, DEERFIELD, ILLINOIS Three non - illuminated double -faced development /construction signs up to 24 square feet in size per face, to be permitted for a period not to exceed 12 months at the following locations: (a) on Lake Cook Road, within 50' of the lot line between lot 8 and lot 9; (b) on Lake Cook and Pfingsten, within 25' of the lot line between lots 4 and 5; and (c) on Pfingsten within 10' of the south property line of lot 34. SECTION That the modification hereby granted is subject FOUR: to compliance by the Petitioner with all other applicable provisions of the Zoning Ordinance and with all other applicable ordinances of the Village of Deerfield and to the further condition that Petitioner waive its rights to the individual construction signs on all individual lots, and further that any real estate signs will be displayed on the interior side of the lot on which the real estate sign is located and agrees that the three signs requested will not be erected more than sixty days prior to the application for a building permit. SECTION That this ordinance shall be in full force and FIVE: effect from and after its passage, approval and publication, as provided by law.
